From the very learned lawyers Chaly Associates Ernakulam, it is understood my best course of action to
recover over Rs.7 lakhs damages from Star Homes due to their failure to completen all works in my flat
No-8-LM-1 by April 2009. While they have set harsh terms in the agreement of sale, such as upto 21%
p.a. interest for failures on my part (pages 6 & 8 of the agreement of sale) with big question am not I
also entitled to equal right for damages they caused me. But the very learned lawyers pointed out as at
page 9 there is a clause for sole arbitration at Ernakulam under provisions of Indian Arbitration and
Conciliation Act.

If necessary arrange a personal detailed explanation with clear proof of (1) adequacy and (2) legal
validity of such arrangements for compensation. I also will attend the personal detailed explanation
interview with my advocate.
On a previous occasion it was explained the compensation arrangement cannot be explained by email. So
kindly make arrangements to explain it all as above.
This maybe treated as Urgent. Kindly reply by email within 2 days by 6-5-2015. Otherwise, I may have to
go ahead with serving of Legal Notice on Star Homes for effecting the arbitration as in sales agreement
at page-9 of that agreement.
