Jim,

Thank you for following up on this. I was on the Fair St non-motorized
path the other day and share your assessment.

With your original prompting we started unraveling this mystery in
mid-February. Planning and Public Services had different answers for
us, and that was part of the problem (I'll forward that set of emails).

Wendy, Crain, any answers to the following would be helpful:

1. Kirk stated that the Fair path is privately owned, but Mark thought
it was in the ROW. If in the ROW, that would make the apartment owners
responsible for maintenance and Community Standards responsible for
enforcement. If not in the ROW, we need to know.

2. Kirk stated that Elder is a vacant lot and, thus, indirectly
indicated that it is not part of our path system and will not be
maintained by anyone. Please confirm.

3. Karla indicated that the Eberwhite paths (Russel, Northwood) are
indeed in the ROW, but that the adjacent property owners were
responsible for maintenance per Chapter 49, not the city. If the
property owners are responsible, which ones? These paths are adjacent
to multiple properties. Who should Community Standards notify? Are the
property owners responsible for both repair / replacement and
maintenance? Who owns the Northwood fences: city or property owners?

Thanks to staff for any clarity. It'd be helpful to get this
straightened out before the snow starts falling again.
