We have received your invoice no AR/25-26/0056 in which you have charged Club Membership Differential Charge along with HVAC Water Pumping Charge and HVAC Routine Maintenance Charge.
For your information, I would like to inform you that Club Membership Charge is levied by the builder which is a lump sum amount and this charge was taken by the builder from us at the time we purchased the flat.
For HVAC Water Pumping Charge and HVAC Routine Maintenance, I would like to inform you that RWA was instructed by the Hon'ble District Registrar's Order No DR/DIC/GGM/1013-1014 Dated 17/04/25. -
The governing Body of VCAOA is hereby directed to initiate necessary amendments in its Byelaws to specifically incorporate any special charges after proper approval in a GBM, as mandated under the Act. As per the order of the respected District Registrar, before levying any special charge, you will have to change the Bye-Laws and changes in Bye-Laws can be made only by GBM within the ambit of law.
You have also written in the circular that you had a meeting with the respected District Registrar and in the meeting the respected District Registrar gave you approval to levy this charge. If there is any such approval, please share its copy with me.
The respected District Registrar has also appointed an inquiry officer to calculate the CAM of VCAOA on a complaint related to the above subject and the inquiry has not ended yet.
Therefore, this bill sent by you is completely wrong and is a violation of the order of the respected District Registrar.
You are requested to cancel this bill and wait untill the inquiry report comes. If the Inquiry Officer in his report says that levying the charges is justified then you can send the bill after changing the Bye-Laws, all the residents including me will gladly pay it but no extra interest will be given on it because it is still under inquiry.
If you do not cancel this unauthorized bill then I will not pay this bill, until the inquiry report is released and thereafter the necessary amendments in Bye-Laws are made.
I further reiterate that I’m not paying this bill sent by you just because the inquiry is not yet complete, as per DR’s order.
I pay all my bills on time, but if RWA levies any illegal charges, as a resident it is my right to oppose it, so this should not be seen with any wrong intention. If after this mail if you will try to disrupt my electricity, water, AC etc. any of the services with malicious intent then it will be considered a crime and a complaint will be made to the concerned authorities as per the rules framed in to protect my rights of a resident.
The circular sent by you, the bill and the copy of the order sent by the District Registrar's Office are enclosed.
