Captain’s Comments

Wednesday March 25th 2009



Where does one start when trying to comprehend the horrific tragedy that

occurred in Oakland over the weekend. This terrible event brought to

the forefront of the public what Police all over deal with EVERDAY! I

have shown numerous times since I started writing this letter the

situations the Officers of Southern Station go through. They recover an

average of 9 guns a month. The Officers have taken the guns off people

walking down the street, riding bikes, motorcycles, inside cars, after a

struggle, while suspects were transporting narcotics, and at the site of

a domestic dispute. Guns have been found in baby carriages and also

hidden inside toy guns. This is why Police Officers give commands to

stay in the car on traffic stops, tell the occupants to put their hands

up, or people are cuffed prior to a cursory search. People act highly

insulted that the Police tell them what to do. But it is the only

recourse we have for our protection. The Police have to abide by rules;


bad guys don’t. The bad guys don’t care. They are looking for a

weakness to escape or attack. And we the Police don’t have a crystal

ball to know every

time who the bad guy is.

This tragedy has touched so many lives of families, friends, and

co-workers. One of the members of Southern Station is the

brother-in-law of one of the Officers that was killed. Families of law

enforcement Officers stress levels go up after a tragedy, since they

worry about their moms, dads, sons, daughters, etc. and they think it

could have been one of their loved ones.

The outpouring of sympathy by the community as seen on the news is a

reflection of the true feelings toward the Oakland Police Department by

responsible individuals. The callous remarks, by a few disgruntled

people, also posted by news organizations show the ignorance and lack of

understanding of just what police are about. Even in the worst of

neighborhoods, it is the Police who make it possible for people to hang

on the corner. Without these brave Oakland Officers just think how much

worse it would be in that city.

I wonder though, where do the Police go to demonstrate and vent their

anger. Should they go on a rampage and start turning over cars! Where

are all those people who have cried out for justice so recently? I

still see a prominent attorney on the news applying his one sided view

of justice. It’s of no significance to them that

4 brave men who set out to help the community were murdered. They gave

everything to serve those who couldn’t protect themselves and made the

ultimate sacrifice.

Arrest Log

Tuesday 03/17/2009 03:52PM, Market & Taylor: Ofcs. Buhagiar, Razzak &
Cole were in the area working plain-clothes narcotics detail when they
observed behavior between two females that was consistent with a
narcotics transaction in progress. Female #1 walked up to female #2 and
spit out suspected narcotics from her mouth to her right hand. Female
#2 was holding U.S. Currency and about to give it up when they were
warned by a passerby who yelled out “Police”. Female #1 started to walk
away but not before throwing two rocks of suspected crack cocaine to the
ground. She was quickly arrested and admitted to having sixteen more
rocks stuffed down her pants.

Tuesday 03/17/2009 05:00PM, 1206 Mariner Drive on Treasure Island: Ofc.
Oryall and Ofc. Cairel responded to the location per the request of Lt.
Falvey for the purpose of conducting a well being check on a female
victim of domestic violence. On arrival, they met with the victim who
told the officers that she was afraid of her boyfriend who was not
currently home. The officers advised the victim to call 911 if the
victim’s boyfriend returned home. Having not heard from her, the
officers later returned to find the boyfriend answering the front door.
He was arrested and served with a restraining order. The female victim
was not home.

Wednesday 03/18/2009 05:50PM, 11th & Harrison: Ofcs. Auyoung,
Cunningham, Leong, Garrett and Sgt. Ernest responded to the location on
the report of a suspect on the Muni bus with a gun. On arrival, a
citizen told Ofc. Auyoung that the suspect was walking down 11th Street
and pointed him out to the officer. The officer proceeded to make
contact with the suspect who he observed take off his jacket and hide
inside a nearby restaurant. The officer detained the suspect and no gun
was located. According to several witnesses on the bus, the suspect was
verbally harassing a female passenger and would not leave her alone.
When a male passenger on the bus attempted to intervene, he was slapped
by the suspect who said: “You can’t tell me who to talk to, shut up and
stop talking to me. I ought to kick your ass” and “I ought to shoot you
if I had a gun”. Based on several witness statements, the suspect was
placed under arrest for battery and being under the influence of
alcohol.

Thursday 03/19/2009 12:01AM, Mission & 3rd: While on patrol, Sgt.
Bragagnolo and Sgt. Christ observed a traffic violation and conducted a
traffic stop. Upon detecting narcotics paraphernalia inside the
vehicle, combined with a strong odor of suspected marijuana coming from
inside the vehicle, both the driver and front passenger were placed
under arrest. The driver was found to be operating his vehicle on a
suspended drivers license, and in the possession of powder cocaine and
crack cocaine. The passenger also had suspected narcotics in his
possession, as well as zip lock baggies that are commonly used in
narcotics sales. The driver had a pending narcotics case out of
Missouri. Now he has one in San Francisco. Both the driver and
passenger were booked and the vehicle was towed.

Friday 03/20/2009 04:43AM, Colin P. Kelly & Brannan: Ofc. Forneris and
Ofc. Junio responded on the report of an auto burglary that had just
occurred. According to dispatch, the suspect was walking up Brannan and
the responding Officers quickly located the suspect. When the suspect
noticed the Officers approaching they observed him throw an item into
the bushes. The suspect was detained and spontaneously stated: “I only
took the cradle, not the unit”. A nearby building security officer
responded to the scene and advised the Officers that he witnessed the
suspect break into the BMW and remove the GPS cradle. The suspect was
found to be on active parole and was subsequently booked for vehicle
burglary. I wonder if he actually thinks the crime is less serious
since he only broke the window to steal the GPS cradle and did not get
the actual unit?

Friday 03/20/2009 08:34AM, 669 Minna: Ofcs. Bernal and Ramos responded
to this location on the report of a domestic violence incident. They
located a victim who was crying and appeared nervous. The victim stated
that her former boyfriend had physically assaulted her and broke into
her apartment while she was sleeping because he thought she was sleeping
with someone else. The incident took place over the past four days and
involved the suspect entering the victim’s apartment without her
permission, taking her personal property and assaulting her. The victim
called the police after the suspect called her 24 times and left her 30
text messages. The victim was afraid for her safety and requested that
the officers obtain an Emergency Protective Order. The officers
proceeded to the last known address of the suspect and placed him under
arrest for various charges including domestic battery, burglary and
false imprisonment.

Friday 03/20/2009 08:02AM, 443 Stevenson: Ofcs. Lee and Young, who are
assigned to the Market Street foot beat detail, were walking up
Stevenson when they observed a female sitting on the public sidewalk.
They contacted the female and discovered she was homeless and on active
probation with a search condition. The officers conducted a search of
the female subject and discovered a crack pipe in her front pocket. She
was issued a citation for possession of narcotics paraphernalia.

Friday 03/20/2009 09:04AM, 1095 Market Street: Ofcs. Lee and Young,
made their way to Market Street and from the inside 1095 Market they
began observing activity at 7th and Market. The officers are aware that
this area is known to have a significant amount of illegal narcotics
activity. It was not long before they observed a suspect loitering and
engaging in activity that was consistent with narcotics sales. They
made contact with the suspect and asked him what he had and the suspect
replied: “Just these” and preceded to hand over 16 pills which were
later confirmed to be Clonazepam which is a schedule 4 controlled
substance. The suspect admitted he was attempting to sell the pills for
the purpose of making enough money to purchase beer, cigarettes and
adult entertainment. The suspect was subsequently booked on felony
charges.



Friday 03/20/2009 09:35AM, 50 United Nations Plaza: Ofc. Mariles and
Ofc. Faye, assigned to the Market Street foot beat detail observed two
subjects cooking suspected heroin in a tin can. The officers made
contact with the two and observed suspect #1 throw the tin can behind
him in an attempt to conceal the can. He was arrested and booked for
possession of suspected heroin and paraphernalia. During the arrest,
suspect #1 said: “Come on man, don’t arrest me, my mom does not know
that I shoot heroin, that was just a little amount I needed for a fix”.
A record check revealed suspect #2 was on active felony probation. A
probation search discovered an illegal knife and the suspect #2 was
cited and released to community court.

Friday 03/20/2009 10:29AM, 91 6th Street: Ofc. Altorfer and Wilhelm,
assigned to the Market Street foot beat detail, were walking up 6th
Street when they observed a subject, who was known to the officers,
sitting in the door way of a Chinese restaurant. The officers had
previously arrested this subject for violation of a stay away order from
this same area. They advised the subject that he was again in violation
of his stay away order and placed him under arrest. An arrest search
revealed suspected methamphetamine in his possession. This subject has
been arrested seven times for narcotics related offenses and two times
previously for violation of the stay away order.

Friday 03/20/2009 12:27PM, 6th & Minna: Ofc. Lee and Young were on their
foot beat detail at 6th and Minna when they observed a female subject
littering at 6th and Minna. Upon making contact with the subject for
the violation, they discovered she was on active probation and had a
stay away order from the area. The officers then observed the female
subject attempt to conceal something from them and upon attempting to
take physical control of her she resisted arrest and dropped suspected
marijuana on the ground. It was discovered that the suspect had a long
time extensive criminal history dating back to 1997. She was booked for
the marijuana, resisting arrest, violation of a stay away order and
probation violation. Oh yeah, and littering. Don’t be a litter bug.

Friday 03/20/2009 06:30PM, 5th & Market: Ofc. Spears responded to the
area on the report of a stabbing. On arrival she observed a victim
being treated by a paramedic crew and the victim was suffering from a
serious wound to his hand. The victim told Ofc. Spears that his
girlfriend attempted to kill him and proceeded to point out his
girlfriend who was standing nearby. The officer made the arrest and
discovered that the girlfriend tried to stab the victim several times
with a broken piece of glass and made several verbal statements that she
wanted to kill him. The suspect was arrested and later told the
officer: “That’s okay, I wish I would have killed him”.

Friday 03/20/2009 06:50PM, Division & Bryant: Ofc. Elias and Kane were
on patrol in the area when they observed a Honda Accord with license
plates belonging to a Toyota Land Rover. Believing that the vehicle was
possibly stolen, the officers conducted a high risk traffic stop against
the vehicle along with Ofc. Kugler, Simmons and Hom. A record check
revealed that the vehicle was not stolen although the driver was
attempting to conceal that the vehicle was not registered. Further, it
was discovered that the driver was on active felony probation out of San
Francisco and that the driver was unlicensed. The driver was booked for
possession of stolen property, probation violation and driving without a
license.

Saturday 03/21/2009 12:18AM, 1148 Mission: While on patrol, Ofc. Junio
and Lucas observed a traffic violation and conducted a stop of the
vehicle. Upon contacting the driver, they discovered that he did not
have a current license and was wanted out of Contra Costa on a $50,000
warrant for DUI and driving on a suspended license. The subject was
arrested and booked for driving without a license and the outstanding
warrant.

Saturday 03/21/2009 12:24AM, 888 Brannan Street: Ofc. Reyes and Marquez
responded for the purpose of conducting a premise check at this
location, which is the San Francisco Jewelry Mart. According to
dispatch, there was an open phone line coming from this location. On
arrival, they observed a vehicle parked in front and occupied by two
subjects. They made contact with the two subjects and smelled a strong
odor of marijuana coming from inside the vehicle. The officers could see
in plain view suspected marijuana inside the vehicle center console.
The two subjects were arrested and a search incident to arrest revealed
a large amount of marijuana packaged for sale as well as a narcotics
scale. One of the suspects, the passenger was released and the driver
was booked for the suspected marijuana as well as a no bail warrant out
of Contra Costa.

Saturday 03/21/2009 09:45AM, 1201 Market Street: Ofc. Toomer was on his
Market Street foot beat detail when he observed a subject sleeping
inside a doorway. Upon conducting a well being check he observed that
the subject was in possession of a crack pipe that contained an off
white rock substance suspected to be crack cocaine inside. A computer
check revealed that the suspect was on active felony probation for
drugs. He was booked on the above charges including a violation of his
probation.

Sunday 03/22/2009 12:40AM, 1535 Folsom: Ofc. Leung and Pena were
approached by a subject who appeared to be highly intoxicated and
bleeding from his mouth. The subject requested that the police officers
file an assault report however he was unable or unwilling to provide any
suspect information or any details. At some point the subject became
aggressive toward Ofc. Leung and pushed him. Based on this, the
officers attempted to place the subject under arrest and he resisted.
Several Southern Station officers responded and a crowd became hostile
toward the officers. As such, five highly intoxicated subjects received
a complementary trip to the sobering cell at the County Jail.

Sunday 03/22/2009 11:16AM, 6th & Jessie: Ofc. Constantine and Perez were
on bike patrol when they observed a subject drinking an open container
of alcohol. Upon making contact they discovered that this subject was
wanted on an outstanding $35,000 warrant for drugs. He was arrested and
transported to County Jail.

Sunday 03/22/2009 07:00PM, 996 Mission: Ofc. Pena and Sgt. Ernest
responded to the area to back up Ofc. Hom and Simmons on a traffic stop.
The officers observed a vehicle driving in an unsafe manner and
conducted a traffic stop to discover a strong smell of an alcoholic
beverage coming from inside the vehicle. A preliminary field screening
revealed a B.A.C. of 0.247% which is three times the legal limit. The
subject was transported to County Jail and booked for D.U.I. and driving
without a license.

Monday 03/23/2009 12:25AM, 9th & Mission: Sgt. Bragagnolo observed a
traffic violation at this location and conducted a stop of the vehicle.
Upon contacting the driver to issue a citation, the driver was unable to
provide any identification. Further, there was a strong odor of
marijuana coming from inside the vehicle with the assistance of Ofc.
Canning and Campbell both subjects were removed from the vehicle. A
subsequent search revealed marijuana, suspected Oxycontine & Valium.
Because neither of these subjects possessed any of the required
prescriptions for these drugs, they were arrested on felony charges.

Monday 03/23/2009 12:52AM, Ellis & Hyde: Sgt. Espinoza was on patrol
when he observed a vehicle travelling at a high rate of speed. Sgt.
Espinoza conducted a traffic stop and the driver was subsequently asked
to step out of the vehicle. Upon doing so, a firearm was located in
plain view behind the driver’s seat. It was later confirmed that this
subject is a known Norteno gang member. He was arrested and charged
with various felony charges and another bad guy is off the street.



Case UPDATE

Thursday 2/5/09 4:30 PM Mission St/9th St.: Officer Elias and Officer

Kane responded to the area regarding a fight upon a Samtrans Bus. Upon

arrival, Officer Chan, Sgt. Christ, and Sgt. Yee were on scene and had

two suspects detained. The Officers spoke with the bus driver who

stated he had picked up the two suspects in San Mateo County. During

his route, the suspects kept yelling and acting unruly. The bus driver

asked the suspects to keep the noise down several times. The suspects

would not comply. Instead they approached the bus driver and yelled at

him, “We are going to get you fired.” The suspect attempted to hit the

bus driver with a phone, the bus driver blocked the hit and the phone

fell to the floor. The suspects then grabbed the bus driver, shook him

violently, tearing his shirt. Both suspects then punched the bus driver

in the face and head multiple times. The bus driver was finally able to

break free and get the suspects off the bus. The police arrived on

scene and detained the two suspects. The suspects were sitting on the

curb while the Officers conducted their investigation. While speaking

with the two suspects, one of the suspects yelled racial slurs at Sgt.

Yee, threatened to kill him and attempted to knock Sgt. Yee to the

ground. Both suspects were booked at County Jail 9……however the suspect

who had the dirty mouth will have a longer stay.



FOLLOW UP: Both suspects were found guilty. The suspect who threatened

Sgt. Yee received 90 days in County Jail and 3 years probation. The

second suspect received 21 days in County Jail and 3 years probation.



Friday 2/28/09 11:57 PM 1000 Mission St.: Officer Salazar and Officer

Walker were on patrol when they observed a male operating a motorcycle

with the radio amplified over 50 feet. The Officer affected a traffic

stop and made contact with the driver. The driver was wearing a helmet,

dark sunglasses a mask with a skull print and bulky clothing. The

Officers asked the driver for his driver’s license. The driver

hesitated but finally presented his license. The Officers asked the

driver to take of his skull mask. The driver pulled down his mask to

below his chin but left his sunglasses on. The driver asked Officer

Salazar’s permission to get off his motorcycle. Officer Salazar told

him to stay on the motorcycle. The driver ignored Officer Salazar and

got off the motorcycle. While the driver got off the motorcycle Officer

Salazar observed the driver had a knife in his front waist band.

Officer Salazar told the driver to get back on the motorcycle. The

driver refused and put his hands in his front waist band where the knife

was. Officer Salazar attempted to control the driver’s hands and take

the knife away from him when the driver turned around and struck Officer

Salazar on the left side of his face and jaw. The driver attempted to

knock down Officer Salazar and flee the scene. Officer Salazar held on

to the driver who placed his hands by his waist band again. Officer

Walker grabbed the suspect from behind and tried to dislodge his hands

from his front waistband. The Officers continued to struggle with the

suspect. Officer Salazar radioed for back up. Officer Walker and

Officer Salazar continued to struggle with the combative driver. As

Sgt. Tom, Officer Martinez, Officer Schwab and Officer Lum arrived on

scene, Officer Walker and Officer Salazar were able to handcuff and

control the driver. During a search of the suspect, the Officers

recovered a bag of powder cocaine, the knife, and a LOADED HANDGUN.

The suspect was booked at County Jail 9.



FOLLOW UP: Suspect was released into Federal Custody for trigger lock

Federal prosecution.

MEDIA ALERT

I-280 N/B KING STREET EXIT TO BE CLOSED SATURDAY MARCH 28 -
WEDNESDAY APRIL 1ST (WEEKDAY MORNING COMMUTE HOURS EXCEPTED) and I-280
S/B
KING STREET ENTRANCE TO BE CLOSED SUNDAY MARCH 29 from 1 PM - 4 PM FOR
FILMING OF TV PILOT IN SAN FRANCISCO

NORTHBOUND TRAFFIC ON I-280 WILL BE DIVERTED TO 6TH STREET due to the
closure of the King Street off-ramp at Sixth Street in San Francisco on
Saturday, March 28 at 5:00 AM through Sunday, March 29 until 10 p.m. and
on
Monday, March 30, Tuesday March 31st and Wednesday, April 1 from 10 AM -
9
PM each day leaving the exit ramp available after 9 PM – 10 AM to
accommodate the weekday commute hours. Northbound traffic will be
diverted
onto the Sixth Street exit with detours set up to Embarcadero.

KING STREET ENTRANCE RAMP FOR SOUTHBOUND I-280 will be closed on Sunday
March 29th from 1 PM - 4 PM. Southbound traffic will be detoured from
King
Street to MARIPOSA STREET OR SIXTH STREET AT BRANNAN.

The closures are to facilitate the filming of action sequences for the
NBC
Universal TV drama pilot "Trauma," which features emergency responders
working a tanker truck crash.

The simulated freeway crash involving several cars and a tanker truck is
scheduled for Saturday March 28 and will include aerial helicopter
activity. The scenes to be filmed on Sunday will include an explosion
with
a fireball and billowing smoke. There will be aerial helicopter
activity
throughout the day.

Throughout filming, there will also be intermittent traffic stoppages at
the entrance to I-280 S/B at both 6TH Street and KING STREET whenever
there
is a stunt being filmed or a helicopter landing or taking off. These
brief
intermittent stoppages will take place randomly during filming on the
weekend and on the weekdays between 10 AM and 3 PM.

The California Highway Patrol, the San Francisco Police and Fire
Departments and other emergency service departments for the City of San
Francisco and the State of California have been notified in advance of
this
permitted filming.

NBC is currently shooting "Trauma" (working title) in San Francisco with
the cooperation of the San Francisco Film Commission, the California
State
Film Commission, CALTRANS, the CHP and the SFPD. Dario Scardapane is
writer and executive producer of the project, which will be directed by
executive producer Jeffrey Reiner (NBC's "Friday Night Lights"). Peter
Berg
("Hancock", "Friday Night Lights") and Sarah Aubrey ("Friday Night
Lights") are also executive producers of the pilot from Universal Media
Studios in association with Film 44. The stars include Derek Luke
("Notorious"), Cliff Curtis ("10,000 B.C"), Anastasia Griffith
("Damages"),
Aimee Garcia ("George Lopez"), Kevin Rankin ("Friday Night Lights") with
Jamey Sheridan ("Law & Order: Criminal Intent).

Police Chief Search Questionnaire On-line

The Police Commission has developed a questionnaire regarding its search
for candidates for the next Chief of Police. It is available to
interested parties (including Dept members) and can be found on the
Commission www page, accessed directly at
www.sfgov.org/policecommission. Follow the blue highlighted link on the

SFPD Recruitment

Due to budgetary constraints:

The written tests for Police Officer have been cancelled. We anticipate that the testing program will resume later in Spring 2009. No dates have
been given at this time.

The SFPD Academy is no longer 31 weeks currently the Academy has been
restructured to a 26 weeks program.

Cell Phone Safety

This lady has changed her habit of how she lists her names on her mobile
phone after her handbag was stolen. Her handbag, which contained her
cell phone, credit card, wallet... Etc...was stolen. 20 minutes later
when she called her hubby, from a pay phone telling him what had
happened, hubby says 'I received your text asking about our Pin number
and I replied a little while ago.’ When they rushed down to the bank,
the bank staff told them all the money was already withdrawn. The
thief had actually used the stolen cell phone to text 'hubby' in the
contact list and got hold of the pin number. Within 20 minutes he had
withdrawn all the money from their bank account.

Moral of the lesson: Do not disclose the relationship between you and
the people in your contact list. Avoid using names like Home, Honey,
Hubby, Sweetheart, Dad, Mom, etc...... And very importantly, when
sensitive info is being asked through texts, CONFIRM by calling back!!
Also, when you're being text by friends or family to meet them
somewhere, be sure to call back to confirm that the message came from
them. If you don't reach them, be very careful about going places to
meet 'family and friends' who text you. Along with that if you have an
entry called 'Home' with your actual home phone number it's not too hard
to do a reverse lookup on the
number to find the address. Now the robber has your home number, keys,
AND address.



Join The San Francisco Community Police Academy

The Community Police Academy is a 15-week program that meets once a week
and is designed to inform and teach interested participants various
aspects of municipal policing, including patrol and investigations
procedures, vehicle operations, arrest and control techniques, firearm
procedures and emergency communications.
The Academy’s goals are to develop community awareness through education
and to develop a closer understanding and working relationship between
the San Francisco Police Department and its communities. Members of the
community are encouraged to join and learn about the San Francisco
Police Department. Participants can ask questions and offer comments
within each class. The next class is scheduled to start on February 17,
2009. We now also have a Youth Community Police Academy, geared towards
high school students and will last 10 weeks, starting on March 24, 2009.
The Community Police Academy participants are selected by the program
coordinator after an application process. Enrollment is limited to
twenty-five students per class.

Graffiti Alert:
Day Watch Sgt. Christie is the Graffiti Abatement coordinator. Each
month he collects surveys from the various beat officers to report
graffiti to DPW and our own Graffiti Unit within the police department.

311 Customer Service Center:
What is 311? 311 is a toll free, NON-EMERGENCY phone number that the
public can call to access information about government services. A live
customer service representative will be available 24 hours a day, seven
days a week, and 365 days a year. The service is available to both wired
and wireless customers. Wireless customers should call (415) 701-2311.
311 employees will be able to provide translations services in more than
145 languages and dialects and will employ a diverse staff of customer
service representatives. Additionally, 311 is set up to accept calls
form the hearing impaired by utilizing a TTY System.

Cell phone 911:
How does 911 work on cell phones in San Francisco?
If you are on surface streets in San Francisco and dial 911, your call
will be answered by the San Francisco Department of Emergency Management
Services. Once the San Francisco Department of Emergency Management
Services determines what emergency services are needed, they will then
route your 911 call to the San Francisco Police Department or the San
Francisco Fire Department, including ambulance service.

If you are on a freeway in San Francisco and dial 911, your call will be
answered by either by the San Francisco Department of Emergency
Management Services or the California Highway Patrol Dispatch Center.
Regardless, your 911 call will be routed to the proper emergency agency,
the San Francisco Police Department, the California Highway Patrol, or
the San Francisco Fire Department, including ambulance service.
