Captain’s Comments

Friday 3/13/09



There have been times when I thought why did I ever become a Policeman?

But it doesn’t take long for me to remember why. Everyday it’s the good

guys vs. the bad guys! And I get to be one of the good guys! This has

been a job that never felt like work. What other job do you get to play

hide and go seek at three in the morning, looking for burglars, climbing

fences and searching buildings? Playing “I spy” all day. I spy with my

eyes John Doe on the corner who has a warrant! They pay me to drive a

car with a red light and siren. I can think of a lot of people who

would pay me if they could do that. I get to play in the rain. I was

always told to come in out of the rain but walking a beat in any weather

was always a joy. And I must admit there are times when giving a

traffic ticket to an obnoxious person is a great feeling. All this came

at a price however, there were injuries along the way. Bumps, bruises,

stitches, cuts, surgeries but I always came back for more. Sure there

are days when things look bleak. Then there are days when from the

homeless person on the corner, to the person living in the penthouse

would say, “I don’t know what we would do without you.”







The Community Meeting will be held on Wednesday March 18th at 6:00 PM

at the Old POA Building located at 510 7th St.



























Arrest Log

Thursday 3/5/09 8:30 AM Hyde St/Grove St: Officer Goodin and Officer

Sovig were dispatched to a call of a physical fight involving a child

being beaten. Sgt. Ernst arrived on scene and detained the suspect and

the child. The witness told Officer Sovig that she was walking behind

the suspect and child when she observed the suspect hitting the child on

the back of the head. The child was crying, pleading for the suspect to

stop. The suspect lifted the child up and struck him again several

times. The Officers spoke to the suspect who made several spontaneous

statements such as “smacking the kid” and “giving him what he deserved.”

The 7 year old boy was visibly upset. The Officers contacted the boy’s

mother who stated she was out of town and the suspect was babysitting

for her. The mother gave permission for the 7 year olds Uncle to pick

him up. The Officers transported the suspect and child to Southern

Station and contacted Sgt. Gordon from the Juvenile Division. The

suspect was cited for the offense and released from Southern Station.

The little boy’s Uncle responded to Southern Station and took custody of

the 7 year old. The Uncle told the Officers that the reason the 7 year

old was not in school was he had behavioral issues and told a teacher to

“suck his D---” and then called her a “B!@#$”. As a result, the 7 year

old was suspended from school. The Uncle also stated the 20 year old

suspect had mental problems and had very little patience when dealing

with the 7 year old. (Well maybe... …….don’t let him babysit children

anymore!!!!!)



Thursday 3/5/09 11:55 AM 587 Natoma St.: Officer Pena and Officer

Najarro were dispatched to an automobile break in. The subject fled and

was detained by Officer Simmons and Officer Cibotti. Dispatch advised

that the suspect didn’t break into a vehicle but had broken the front

window of a business. The suspect broke the window with his head during

what appeared to be an argument with his caretaker. The caretaker

stated the subject had a psychotic episode. The caretaker attempted to

calm him down but the subject broke the window with his head. The

subject stated he wanted to kill himself, was feeling depressed and was

upset about her life. The subject was transported to SFGH for a 72

hour mental evaluation. The owner of the store stated she did not want

to sign a citizen arrest for the broken window.



Thursday 3/5/09 11:58 AM Market St./Charles J. Brenham: Officer Faye

and Officer Johnson were on foot patrol when they observed the suspect

with an open container of alcohol. The Officers made contact with the

suspect. The Officers asked the suspect for his identification which

the suspect stated, “it’s in my pocket next to my knife. I ain’t got no

search nor seizure, you can’t talk to me. You don’t know where I am

from.”

The suspect started to flail both his arms in the air and move towards

the Officers. For the Officers safety, they placed the suspect into

handcuffs. The suspect’s identification card showed he was 19 years

old. An arrest search revealed the suspect had a knife in his front

pants pocket and a brass knuckle in his back pants pocket. The suspect

stated, I made those brass knuckles, I use them for protection, you

would too, if you lived where I live.” I should be noted that the

suspect lives in SAUSALITO CA. The suspect was booked at CJ9. The two

weapons he uses for protection against the dangerous people of Sausalito

were booked as evidence at Southern Station.



Thursday 3/5/09 1:31 PM Turk St/Taylor St.: Officer Bryant and Officer

Wong were conducting surveillance in the area when Officer Bryant

observed one male spit out a piece of rock cocaine from his mouth and

give it to another suspect. The second male then gave the first male US

Currency. The Officers arrested the two suspects and recovered 18

pieces of rock cocaine. (17 pieces came out of the seller’s mouth.) A

record’s check reveled the seller was already on probation for

narcotics. The suspects were booked at CJ 9.



Thursday 3/5/09 7:09 PM 960 4th St.: Officer Schwab and Officer Lum

were dispatched to a call of a person camping in front of a residence.

When the Officers arrived they met with the subject and advised him he

could not campout at this location. The subject started to take steps

toward the Officers and stated he was going to kill the Officers and

then kill himself. The Officers tried to calm the subject to no avail.

Instead the subject said, “Watch me kill myself.” The subject then

began to sprint down the sidewalk towards the street and towards an

on-coming bus. The Officers grabbed the suspect’s arm and restrained

him. The Officers transported the subject to SFGH PES for a 72 hour

mental health evaluation.



Thursday 3/5/09 11:01 PM Brannan St./4th St. Officer Woo and Officer

Frost were on patrol when they observed a suspect riding his bicycle on

the sidewalk. The suspect was looking into parked vehicles. The

Officers detained the suspect. The suspect stated he did not have any

identification on him. The suspect verbally gave the Officers a name.

No information came back on THAT name. During a search of the suspect,

the Officers recovered a knife strapped to his lower back. The blade

was five inches long and was contained in a makeshift sheath. The

suspect was transported to Southern Station. After further

investigation it was revealed that the suspect had lied about his name.

The suspect’s real name came back with a $25,000 warrant. The suspect

was booked at County Jail 9.



Friday 3/6/09 3:10 PM Gough St/Otis St.: Officer Pena and Officer

Najarro were dispatched to a call of a suspect attempting to break into

a vehicle. The Officers arrived on scene along with Officer Salmonson.

The Officers detained the suspect who was carrying a backpack. A search

of the back pack revealed numerous papers, a screwdriver, a brown purse,

a Nordstrom Rack bag containing a coat and a belt and A BULLET PROFF

VEST! The Officers made contact with the woman’s name on the paperwork.

The woman stated earlier that day her vehicle had been broken into and a

brown purse and a Nordstrom Rack bag containing a coat and a belt were

taken. The suspect was booked at County Jail 9.



Friday 3/6/09 4:06 PM 599 3rd St.: Officer Cato and Officer Anderson

were dispatched to a call of a person screaming and rolling around on

the ground. The subject was disoriented and agitated and told the

Officers that she had used “speed” earlier that day. The sad thing was

the woman was OBVIOUSLY PREGNANT!!! The subject insisted she was NOT

pregnant by had cancer. (But that was not true) Officer Cato and

Officer Anderson had recognized the subject from a call earlier that

day. When the Officers were talking to the subject earlier, Homeless

Outreach members appeared and stated they would evaluate the subject and

her pregnancy. The Homeless Outreach member stated she would take her

for further treatment. The Officers contacted the Homeless Outreach

worker from earlier who stated the subject refused to go with them.

Since the subject’s condition had deteriorated, and now she was a danger

to herself and her unborn child the Officers transported her to SFGH PES

for a mental health evaluation.



Friday 3/6/09 4:30 PM 45 6th St.: Officer Wong and Officer Bryant were

on patrol in the area when they observed several males loitering. The

Officers stopped one of the males that they knew was on parole. A

record’s check revealed the suspect had a NO BAIL CDC warrant for his

arrest. The suspect was booked at County Jail 9.



Friday 3/6/09 6:44 PM 462 Market St.: Officer Sherry and Officer Hom

were on patrol when they were dispatched to a call of a person receiving

threats. When the Officers arrived they spoke with the subject who

stated numerous unknown males confronted him and threatened to beat him

up. The subject started to look around at innocent bystanders and said,

“They are after me.” The subject was visibly paranoid and delusional and

stated he wanted to hurt himself by going into a retail store and

ingesting some household cleaners. The Officers transported the subject

to SFGH PES for a 72 hour mental health evaluation.



Friday 03/06/09 8:52 PM 44 9th St.: Ofc. Hom and Ofc. Sherry responded

to 44 9th Street on the report of an auto burglary in progress. Ofc.

Pomatto, who happened to be driving by the area when the call was

dispatched, identified a suspect matching the description inside the

front passenger seat of the vehicle. The suspect was ordered out of the

vehicle and upon doing so was holding coins, a passport and medication.

The suspect also had some broken spark plug pieces in his back pocket,

an item commonly used by criminals to break into vehicles. The owner of

the vehicle later confirmed that he did not know the suspect or give him

permission to take items of property from the vehicle. The suspect

invoked his right to remain silent (and is currently on felony probation

for burglary) and the arresting officers invoked their right to take him

to jail for vehicle burglary.



Friday 3/6/09 10:12 PM 4th St/Mission St.: Officer Bertrand and Officer

Cronin were on patrol when they were told by an unidentified male that

there was a fight around the corner. When the Officers approached the

area, they observed a group of juveniles challenging each other to

fight. The Officers separated the group and advised them to leave the

area. One of the juveniles refused. The Officers again advised the

juvenile to leave but he refused. Officer Bertrand detained the

juvenile and began to conduct a pat search. The juvenile tensed up his

arms, made fists with both of his hands, and attempted to flee. Officer

Bertrand and other Officers took the juvenile into custody. While

Officer Bertrand attempted to walk the juvenile to his patrol vehicle,

three males attempted to interfere but were quickly detained by Sgt.

Espinoza. The suspect was cited and released to his mommy.



Friday 3/6/09 10:25 PM 201 8th St.: Officer Schwab, Officer Lum,

Officer Frost, Officer Payne, and Captain McDonagh responded to a call

of a woman being battered. When Captain McDonagh arrived he spoke to

the victim. The 68 year old victim stated she was walking down 8th St.

with her dinner when she saw the suspect working on his bicycle. As the

victim passed the suspect, “he just went crazy.” The suspect grabbed

the victim’s food and then threw the victim on the ground. The suspect

then fled the area with the food. Officer Frost and Officer Payne

detained a suspect who matched the description given by dispatch. A

cold show was set up and the victim and a witness positively identified

the suspect. The suspect was booked at County Jail 9.



Saturday 3/7/09 9:06 AM 7th St./Market St.: Officer Wilhelm was on foot

patrol when he observed a male drinking a can of beer. Officer Wilhelm

made contact with the suspect. A record’s check revealed the suspect

had a NO BAIL CDC WARRANT for his arrest. The suspect was booked at CJ

9.



Saturday 3/7/09 3:11 PM Mission St/7th St.: Officer MacKenzie and

Officer Salmonson were dispatched to a call of an Off-Duty Officer who

had been battered by a suspect. When Officer MacKenzie and Officer

Salmonson arrived, Off-duty Officer Buckner pointed out the suspect.

Officer MacKenzie and Officer Salmonson ordered the suspect to stop and

put his hands behind his back, but the suspect refused and kept fleeing.

Sgt. Christie, Officer Arnswald and Officer Chan arrived on scene.

Officer Chan attempted to gain control of the suspect but the suspect

resisted and grabbed Officer Chan’s shirt. The suspect and Officer Chan

fell to the ground while the suspect continued to violently resist.

Sgt. Christie, Officer Arnswald, Officer Salmonson, and Officer

MacKenzie joined the struggle. The suspect then grabbed Officer Chan’s

duty belt, right behind his service pistol. Fearing that the suspect

would try and disarm Officer Chan, Officer Chan and Sgt. Christie struck

the suspect twice with a closed fist until the Officers were able to

gain control of the suspect and handcuff him.



Off-duty Officer Buckner stated he and his friend were just walking down

the street when the suspect spat in the face of his friend for no

reason. The suspect yelled at Off-Duty Officer Buckner’s friend, “I’m

tired of you white motherfu#$@!&” Officer Arnswald spoke to the

suspect’s mother who was with him at the time of the incident. The

mother stated that the suspect had been “acting crazy” and she wasn’t

sure if his behavior was a result of a mental illness or drug usage.

The suspect was cited and transported to SFGH-PES where he was admitted

for a mental health evaluation.



Saturday 3/7/09 1:18 PM 3rd St/Folsom St.: Officer Dickson and Officer

O’Connor were on patrol when they were dispatched to a call of a fight.

As Officer Dickson and Officer O’Connor were traveling to the area,

Officer Bertrand and Officer Cronin were already on scene. Officer

Bertrand and Officer Cronin advised the units that the victim was

suffering from multiple head injuries. Officer Bertrand also advised

that four male suspects fled the area in a red pick up truck. While

Officer Dickson and Officer O’Connor approached the area they observed

the suspect’s truck. The Officers conducted a traffic stop, pulled the

vehicle over and extracted the four suspects with out further incident.

The suspects were from Hayward, San Bruno and Union City. Three of the

suspects were 18 and one was 14. The victim was transported to SFGH.



Three witnesses who were still on scene stated they saw four suspects

punch the victim multiple times in the face. The victim then tried to

escapee but the suspects ran after him. The four suspects caught up to

the victim and pushed him to the ground. The four suspects than began

to kick the victim multiple times in the head. All three witnesses

positively identified the four suspects. The three 18 year old suspects

were booked at County Jail 9. The 14 year old suspect was booked at

Youth Guidance Center. (YGC)



Saturday 03/7/2009 2:46PM Turk/Taylor: Ofc. Bryant and Ofc. Wong were

conducting narcotics surveillance with Sgt. Yee. The surveillance team

observed a narcotics transaction between two females and an arrest was

made. Both female suspects were in possession of crack cocaine. The

seller, a 16year old from Hayward, was in possession of seventeen rocks

of suspected crack cocaine. Her mother was notified and she was booked

accordingly at Juvenile Hall.

Saturday 3/7/09 6:00 PM Grant Av/Sutter St.: Officer Hom and Officer

Sherry were on patrol when they observed a vehicle make an illegal left

hand turn and fail to stop at the red light. As the Officers were

affecting a traffic stop, Officer Sherry observed the vehicle was on the

stolen vehicle hot sheet. Officer Sherry confirmed that the vehicle was

stolen through dispatch. The Officers conducted a felony stop and took

the driver and passenger into custody without incident. The driver

spontaneously stated, “The car isn’t stolen, I bought it from a Mexican

guy in the Mission District.” The passenger stated she did not know

the vehicle was stolen. The passenger also stated when the Officers

were pulling over the vehicle the driver got really nervous and said no

way. The suspect was booked at CJ 9 and the passenger was issued an 849

B form and released from the Southern Station.



Saturday 3/7/09 9:30 PM 1190 Howard St.: Officer Lum and Officer Schwab

responded to a possible domestic violence call. Officer Dickson,

Officer O’Connor, and Officer Frost also responded to the scene. When

the Officers arrived they could hear yelling outside the apartment.

Officer Frost knocked on the door and eventually the witness answered

the door. The Officers entered the residence and observed blood on the

floor. The suspect had blood on her clothing and was trying to get into

the bathroom, where the victim was sitting on the toilet. The suspect

was irrational and screaming. The suspect struggled with the Officers

but was eventually handcuffed. In the bathroom, the Officers observed

the victim had a stab wound to his chest and left arm. The victim was

transported to SFGH. The witness told the Officers that the suspect and

victim were arguing when they came home. The suspect got so mad she

grabbed a knife and attempted to stab the victim. The victim was able

to grab the knife and hide it. The suspect got another knife and

stabbed the victim in the left arm. The victim was able to grab the

knife away and so the suspect grabbed a “long ass knife” and stabbed the

victim in the chest. Two of the knives and the bloody clothing were

booked at Southern Station as evidence. The suspect who was also on

parole was booked at County Jail 9.



Sunday 3/8/09 12:26 AM 1288 Mission St.: Officer Constantine provided

Officer Pedroza with information about a subject who had a No Bail

Warrant out of Texas. Officer Bernal and Officer Pedroza responded to

the suspect’s residence. The Officers knocked on the door. The suspect

opened the door and began to cry when she saw the Officers. The suspect

stated she knew the Officers were at her door because she had a warrant.

The suspect was taken into custody without incident. While the Officers

were inside the suspects room they observed numerous stickers with the

graffiti “tag” of TABS on it. The suspect stated TABS was her

identifying graffiti “tag”. The Officers booked the two stickers as

evidence. The Full Extraditable NO BAIL Graffiti/Vandalism Warrant was

confirmed by the Collin County Sheriffs Office in Texas. The suspect

was booked at County Jail 9 awaiting extradition to Texas.



Monday 3/9/08 12:42 AM Market/Jones St.: Officer Pedroza and Officer

Anderson were on patrol when they observed a male riding his bicycle on

Market St. without a head lamp. The Officers made contact with the

suspect who identified himself verbally. The Officers ran a record’s

check which came back with no record. The suspect finally remembered

his real name!! A record’s check of that name came back with a NO BAIL

WARRANT for his arrest!! SURPRISE SURPRSE! The suspect was booked at

County Jail 9.



Sunday 3/8/09 10:15 AM 74 Turk St.: Officer Wong, Officer Bryant and

Sgt. Yee were conducting narcotics surveillance in the area. Officer

Bryant was in a place of concealment using a pair of high powered

binoculars. Officer Bryant observed a male selling a female narcotics.

Officer Wong, Officer Bryant and Sgt. Yee placed the two suspects under

arrest. Officer Michaud responded to the scene. Officer Michaud knew

the female suspect from numerous past arrests. Officer Michaud told the

female suspect to give her the rock cocaine. The suspect was uncuffed

and reached into her rear waist band and gave Officer Michaud four

pieces of rock cocaine. The male suspect then handed Sgt. Yee a bag of

containing 21 pieces of rock cocaine. Both suspects were booked at

County Jail 9.



Sunday 3/8/09 1:20 PM 662 Mission St.: Officer O’Connor and Officer

Dickson responded to Club Fluid regarding an assault. When the Officers

arrived they spoke to the security guard who stated he observed the

suspect assault a female patron. The security guard had the suspect

detained. Officer Dickson spoke to the victim who stated she was taking

photos inside the club, when the suspect pushed her. The victim asked

the suspect not to push her. The suspect stated, “Don’t F#$!ing touch

me or I’ll punch you out.” The victim told the suspect she was going to

call security. The suspect stated, F!#$ security.” A few minutes

later, as the victim was taking more photos, the suspect tapped her on

the shoulder and punched her in the right side of her face. The suspect

then grabbed the victim’s camera and threw it on the floor.



While the Officers were taking the suspect into custody, a female

approached them yelling, “That’s my man, that’s my man.” The Officers

observed the female was intoxicated in a public place. Both suspects

were booked at County Jail 9.



Monday 03/09/2009 8:29 AM Eddy/Mason: Ofc. Balmy and Ofc. Bandoni

were on foot patrol when they were informed by a passing citizen that

there was a subject at the Powell Muni/Bart Station who was acting

suspiciously. The officers responded to the area and observed a suspect

loitering in the area with no apparent reason. The officers made

contact with the suspect and confirmed he was a registered sex offender

and wanted on an outstanding traffic warrant. The suspect was booked at

CJ9.



Monday 03/09/2009 11:55 AM 470 Stevenson St.: Ofc. Bandoni and Ofc.

Balmy were foot beat patrol again when they observed a known suspect who

was wanted for a $30,000 warrant. Ofc. Bandoni introduced the suspect

to his handcuffs and provided him with a complimentary ride to jail.



Monday 03/09/2009 9:20 PM 4th St/Market St.: Ofc. Campbell and Ofc.

Rosaia responded to the report of a robbery. Upon meeting with the

victim, they discovered he was walking southbound on 4th Street toward

Folsom when he was approached by three Hispanic male suspects who

proceed to stick what appeared to be a firearm in his back and say “Give

me all of your stuff, and don’t do anything!” The victim complied and

the suspects proceeded to ransack him for all of his personal

possessions including his cell phone, back pack, laptop and wallet. The

suspects made their get-away in a nearby vehicle. Our vigilant Officers

responded back to the scene where the suspects were seen driving away

from and located a security camera which later was helpful in positively

identifying the suspects. Later that night, two of the suspects were

arrested by San Bruno police in possession of the victim’s stolen

property. One of the suspects was a known Sureano gang member. The

suspects were booked at County Jail 9.



Tuesday 03/10/2009 11:30PM 6th St/Minna St: Ofc. Anderson and Ofc.

Pedroza were on patrol. Upon observing a suspect loitering at 6th and

Minna, the Officers stopped and detained him for the purpose of

admonishing him for loitering in a known drug/crime area. A record’s

check revealed the suspect had a $30,000 narcotics warrant. What a

surprise! The suspect was booked at County Jail 9.



Tuesday 03/10/2009 11:50AM, 525 5th St: Ofc. Anderson and Ofc. Cato

responded to a report of a person acting suspiciously with a crowbar.

Captain McDonagh also arrived on scene and detained the suspect who was

having some unknown psychiatric emergency and yelling racial epithets at

the responding Officers. According to the reporting party the suspect

was suffering from bipolar disorder and not taking his medications. The

Officers transported the subject to SFGH for psychiatric evaluation.



Tuesday 3/10/09 2:10AM 6th St/Stevenson: Ofc. Frost and Ofc. Crosby were

patrolling the area when they observed a subject sitting on the fire

hydrant on the same corner, in violation of the Municipal Police Code.

A consensual conversation with the suspect revealed he was on active

parole for marijuana sales. The subject is also a confirmed sex

registrant for sexual battery. The Officers conducted a parole search

and discovered, what else? … Marijuana packaged for sale. A search of

his room at the Windsor hotel also discovered large supply of DVD’s that

are suspected to be illegal copies and narcotics packaging supplies and

a scale. A CDC parole hold was requested and the suspect is heading

back to prison. Have a nice trip.



Wednesday 03/11/2009 8:58AM Mission/Mary: Ofc. Buckner, Ofc. Territo

and Ofc. Miranda observed an illegal encampment occupied by three

subjects. The officers provide homeless outreach in the Southern

District and have made dozens of contacts with these subjects for

illegal camping in the area. Ofc. Buckner has arrested one of these

subjects (8) prior times for camping in this area. All three were

subsequently arrested again for lodging and maintaining a public

nuisance. A search of their personal property revealed numerous

supplies of narcotics paraphernalia.



Wednesday 3/11/2009 at 7:13PM 939 Market St: Lt. Balma was walking a

foot beat when he observed a suspicious vehicle parked in the truck only

loading zone. Upon making contact with the driver, Lt. Balma detected a

strong odor of marijuana coming from inside the vehicle and the driver

was unable to produce a valid driver’s license. He told Lt. Balma he

was just waiting for a friend who was shopping at a nearby store. The

driver consented to a search of the vehicle and methamphetamine was

located inside the center console. A search of the driver discovered 25

rocks of crack cocaine. The driver was arrested and now he can wait for

his friend in jail.



Wednesday 3/11/2009 10:38PM 48 6th St.: Ofc. Pena and Ofc. Leung were

dispatched to a report of a noise complaint. On arrival the Officers

observed a suspect yelling from across the street. When the Officers

made contact with the subject, Ofc. Pena recognized that the suspect was

exhibiting signs of public intoxication. The Officer asked the suspect

if he was carrying any weapons and the suspect confirmed that he always

carries a knife. Upon checking the suspect for the weapon, Ofc. Pena

suffered a cut on his hand as the suspect was concealing the knife under

his jacket. The knife was a fixed blade open steak knife. The suspect

was subsequently arrested for being intoxicated in public and carrying a

concealed weapon.



















Case UPDATE



Saturday 2/7/09 8:20 PM Valencia/Market St.: Officer Anderson and

Officer Cunningham were on patrol when they observed a vehicle driving

without headlights. The Officers initiated a traffic stop and pulled

the vehicle over. When Officer Anderson asked the suspect to roll down

the window and put the vehicle in park, the suspect would not comply.

Officer Cunningham had to open the passenger side door and put the

vehicle into park for the suspect. The Officers had the suspect exit

the patrol vehicle and perform the field sobriety tests, which he

failed. The suspect, who the Officers believed was under the influence

of narcotics while driving was booked at County Jail 9.



Update: Dismissed by DA – Further investigation necessary



Thursday 2/12/09 7:30 AM 364 9th St.: Sgt. Delaney, Inspector Retto and

other Officers were conducting an undercover operation targeting

prostitution. Prior to the investigation, Sgt. Delaney discovered an ad

on Craig’s List displaying a photo of a young female offering sexual
