Before leaving the United States, all aliens (except those listed below under Aliens Not Required To Obtain Sailing or Departure Permits) must obtain a certificate of compliance. This document, also popularly known as the sailing permit or departure permit, must be secured from the IRS before leaving the U.S. You will receive a sailing or departure permit after filing a Form 1040-C, U.S. Departing Alien Income Tax Return or Form 2063, U.S. Departing Alien Income Tax Statement and Annual Certificate of Compliance.

If you are in one of these categories and do not have to get a sailing or departure permit, you must be able to support your claim for exemption with proper identification or give the authority for the exemption:

If you do not fall into one of the categories listed under Aliens Not Required To Obtain Sailing or Departure Permits, you must obtain a sailing or departure permit. To obtain a permit, file Form 1040-C or Form 2063 (whichever applies) with your local IRS office before you leave the United States. (Note: You must make an appointment for assistance at the local office. You can call 844-545-5640 between the hours of 7 a.m. and 7 p.m. local time to make the appointment. Depending on the time of year, some offices may not have available appointments within the 2 to 4 week time frame you must file so allow enough time to schedule your appointment before your departure date). You must also pay all the tax shown as due on Form 1040-C and any taxes due for past years. Refer to the information discussed under the heading entitled, Paying Taxes and Obtaining Refunds, later in this section.

It is advisable for aliens who have been working in the United States to get the permit from an IRS office in the area of their employment, but it also can be obtained from an IRS office in the area of their departure.

You should get your sailing or departure permit at least 2 weeks before you plan to leave. You cannot apply earlier than 30 days before your planned departure date. Do not wait until the last minute in case there are unexpected problems.

If you must get a sailing or departure permit, you must file Form 2063 or Form 1040-C. Both forms have a "certificate of compliance" section. When the certificate of compliance is signed by an agent of the Field Assistance Area Director, it certifies that your U.S. tax obligations have been satisfied according to available information. Your Form 1040-C copy of the signed certificate, or the one detached from Form 2063, is your sailing or departure permit.

Aliens in either of these categories who have not filed an income tax return or paid income tax for any tax year must file the return and pay the income tax before they can be issued a sailing or departure permit on Form 2063.

The sailing or departure permit detached from Form 2063 can be used for all departures during the current year. However, the IRS may cancel the sailing or departure permit for any later departure if it believes the collection of income tax is jeopardized by that later departure.

Ordinarily, all income received or reasonably expected to be received during the tax year up to and including the date of departure must be reported on Form 1040-C and the tax on it must be paid. When you pay any tax shown as due on the Form 1040-C, and you file all returns and pay all tax due for previous years, you will receive a sailing or departure permit. However, the IRS may permit you to furnish a bond guaranteeing payment instead of paying the taxes for certain years. The sailing or departure permit issued under the conditions in this paragraph is only for the specific departure for which it is issued.

Getting your sailing or departure permit will go faster if you bring to your appointment at the IRS office papers and documents related to your income and your stay in the United States. Bring the following records with you if they apply (see Instructions for Form 1040-CPDF):

If you furnish the IRS with information showing, to the satisfaction of the IRS, that you intend to return to the United States and that your departure does not jeopardize the collection of income tax, you can get a sailing or departure permit by filing Form 1040-C without having to pay the tax shown on it. You must, however, file all income tax returns that have not yet been filed as required, and pay all income tax that is due on these returns.

Your Form 1040-C must include all income received and reasonably expected to be received during the entire year of departure. The sailing or departure permit issued with this Form 1040-C can be used for all departures during the current year. However, the Service may cancel the sailing or departure permit for any later departure if the payment of income tax appears to be in jeopardy.

Except when a bond is furnished, or the IRS is satisfied that your departure does not jeopardize the collection of income tax, you must pay all tax shown as due on the Form 1040-C at the time of filing it. You must also pay any taxes due for past years. If the tax computation on Form 1040-C results in an overpayment, there is no tax to pay at the time you file that return. However, the IRS cannot provide a refund at the time of departure. If you are due a refund, you must file Form 1040 or Form 1040-NR as appropriate, at the end of the tax year.

When entering the United States as a nonimmigrant, the Customs Border Protection (CBP) officer examines your passport and visa and then issues either a passport admission stamp or a small white card called the Form I-94. This indicates how long a student or scholar is allowed to stay in the United States and proves that they arrived in the country legally.

On the passport admission stamp or the paper I-94 card, the inspector writes either a date or "D/S" (duration of status). Students and scholars on F or J status should receive a stamp marked "D/S" or "duration of status." This means that they may remain in the United States as long as they are properly maintaining status and their I-20 (F-1) or DS-2019 (J-1) has not expired. Students and scholars are required to keep the passport entry stamp or I-94 card for the duration of their visit. Make sure to keep it in a safe place so it doesn't get lost.

You will have to fill it with some of the asked details from the arrival card like the Family Name, Full Name, Middle Name, Date of Birth, Passport Number, Nationality, Flight Number, and Signature.

If a student has completed his/her academic program (i.e. graduated, or completed an approved OPT or Academic Training period during which they maintained status and did not exceed allowed unemployment days), the student is allowed a grace period at the end of the F-1 or J-1 program. When U.S. Citizenship and Immigration Services approves your Form I-765, you will receive a Form I-766, "Employment Authorization Document" (EAD) in the mail. This is your proof that you have authorization to work in the United States. You must carry this card with you when you travel. You may not begin to work until the date listed on your EAD; it also lists the date when your employment authorization ends.

Passengers may check in and drop off their baggage at the counter between 4 and 24 hours prior to their flight departure time. The baggage drop-off service is subject to a service fee of HK$120 per piece of baggage

When entering Canada for a trip that will be for less than 30 days, you should not hand over your I-94 card to airline personnel or Canadian officials. You will need the I-94 card when re-entering the U.S. This rule only applies when traveling to Canada or other contiguous territories for 30 days or less. The Canadian government requires that citizens from certain countries have a visa to enter Canada. Please consult with the Canadian Embassy to see if you need a visa to enter Canada.

Scholars and visitors planning to return to their home country once the J-1 program is complete will need to complete and return the Departure Form to the Office of International Affairs (OIA) prior to departure from the United States.

When leaving the country, you will be asked to surrender any paper versions of the Form I-94 at the border or airport (if applicable). This form is processed to record your departure date and the end of your US immigration status (if you are leaving after your program end date or work authorization end date).

If you were issued an I-94 (see above), you must submit your paper Form I-94 card upon leaving the United States in order to report the date of your departure (except for certain short-term visits to Canada or Mexico using Automatic Revalidation). Surrendering your paper Form I-94 card is especially important after completing your program at the University because doing so notes on your immigration records that you did not overstay your permissions.
