To ensure fairness and compliance under the PoSH Act, the Internal Committee (IC) must follow a structured and legally sound enquiry process.
🔹 The enquiry should be conducted in a manner similar to a domestic enquiry
🔹 Principles of Natural Justice must be strictly adhered to
🔹 Proper procedural protocols should be followed throughout the process
🔹 Both parties must be given an opportunity for examination and cross-examination
🔹 All relevant documents and evidence should be carefully considered
🔹 ❗ The enquiry should not be conducted in the absence of either the complainant or the respondent
🔹 The IC must be properly constituted as per Section 4 and Rule 4; otherwise, the proceedings may be deemed invalid
🔹 The process should ensure that the complainant feels safe and secure at all stages
A fair enquiry fosters trust, ensures transparency, and strengthens legal compliance—key elements for effective redressal.
