Complaint cases are carelessly heard, disposed and closed without ensuring information by Sri Jagadanand Mohanty, SIC, Odisha 

  .

If the Complainants appeal again for rehearing the case, the Information   Commission  refused  to hear   and advised  to go to High Court  for information.  The complainants will wait for unknown period   around 5 to 10  years to get  simple information which might not  have any relevance.  The Commission without being least concerned  about whether the  information ensured  enjoyed  colonial luxury  by taking  around 2 lakhs per month towards  their salary and allowances .  The  complainant-citizens  are  left  to the  state of frustration  and despair.  It  happens in Odisha.   I cite  herewith  my case , one of thousand cases  for the readers’ reference.

 

Dear friends

On  dt. 30.6.10, I had  submitted RTI Application to the PIO, office of  Chief District Medical Officer, Kondhamal district  seeking some information about  Project  implementation  plan  of NRHM for the year 2009-10, NGO engaged  in Malaria and TB eradication, ASHA training  conducted  by the NGOs etc. Finding no  information, I made  first appeal  to the First Appellate Authority (FAA) on 22.11.10  alleging incomplete information. The FAA heard the case  and directed the PIO to supply  the information. Finding no information,   I made second appeal  to  the State Information.

 

Sri Jagadanand Mohanty, SIC heard the case  and disposed on 10th April 2012. . But  without  enquiring into  my allegation  of incomplete information  and  ensuring   me the complete information, Sri jagadanand Mohanty  directed the District Programme Manager to set up  public disclosure as per section 4 of the RTI Act  which  was not my cup of tea.  I sought one information. Sri Jagadanand  gave another direction without giving justice to me. Such type of  careless handling of cases by Mr. Jagadanad has made many RTI-complainants frustrated.  Interestingly, though one years has passed,  no publis disclosure has been made  complying direction of the  Commission  by DPM, office of CDMO, Kondhamal.

 

Another discerning  fact  is that  the Commission is not entertaining the cases for  rehearing   which are  not  complied  by the PIOs.   Now only option is left to High Court  which the Commissions advises.   If a case is filed in High Court, it will take around  5 to 10 years for disposal. If a complainant gets  information after 5 years, it might not have  any relevance. This is the justice system of the Information Commission.   It has brought disaster to RTI regime in Odisah.
