A Sunnyvale woman who was originally booked on a murder charge for
allegedly running over her former girlfriend in Alviso last week now
faces a lesser charge of vehicular manslaughter instead.
Jennifer Bautista, 19, appeared shackled in a San Jose courtroom Monday,
where she was formally charged with vehicular manslaughter with gross
negligence � a crime that carries a prison sentence of up to seven
years.
Court papers indicated that the victim, Norma "Letty" Martinez, jumped
on the hood of Bautista's car after an early morning altercation between
the two women, which would mean that Bautista didn't intentionally run
her down. Bautista did, however, leave the scene and police spent two
days tracking her down.
The victim's family crowded into the courtroom Monday and expressed
outrage at the reduced charge. A first-degree murder conviction would
have carried a penalty of 25 years to life in prison
"I think it's all wrong. She took away Letty's life, and they're going
to let her walk away with that?" her sister, Evelyn Estrada, said
outside the courtroom.
"She should spend the rest of her life in prison," Mary Ramirez, the
victim's aunt, said.
District Attorney spokesman Nick Muyo declined to explain the facts of
the case, but he said that after reviewing police reports and witness
accounts, "we think we've properly charged this case."
Details were still sketchy, but new details emerged in court documents
Monday.
One witness told police she was looking out her window that faces
Michigan Avenue in Alviso shortly after 6 a.m. Dec. 28 when she saw the
women arguing in front of her house.
Moments later, she saw the victim riding on top of the hood of
Bautista's car as it went down the street. A second witness observed
Martinez actually jump on the hood of the car before it started down the
street.
"The witness saw the car stop briefly and later stopped a second time
further down the street for a longer period of time before it drove
away," according to court papers.
Bautista "did without malice" kill Martinez, the documents said. Still,
Bautista is being charged with vehicular manslaughter with gross
negligence because she should have stopped the car when Martinez was on
the hood. Bautista is also charged with hit-and-run for fleeing the
scene.
While early reports indicated Martinez may have been dragged for several
blocks, authorities would not verify that Monday. Martinez was
pronounced dead at Regional Medical Center at 10:30 that morning.
The Santa Clara County Coroner's office declined to discuss the cause of
death, calling the case "an open investigation."
The two women had been involved in an on-again, off-again relationship
for several years. A year ago, Bautista was granted a restraining order
against Martinez after a scuffle between the two in Sunnyvale.
Martinez's family said Monday, however, that Martinez had been "set up"
by Bautista in that case.
In court Monday, bail was set at $500,000. Bautista's family is
attempting to hire a private lawyer for the case. The next hearing is
set for 2 p.m. Monday, where a motion to reduce the bail amount is
expected.
Martinez's family will hold a viewing at Our Lady Star of the Sea Church
in Alviso today from 3 to 9 p.m., including a 7:30 p.m. rosary. Another
viewing will begin 10 a.m. Wednesday, followed by an 11 a.m. Mass at the
same church at 1385 Michigan Ave.

mother to get revenge on his brother.
Police say 19-year-old Gary Helms, Jr., raped his 45-year-old mother
this past weekend at Willow Terrace Trailer Park on Doyle Drive in
Albertville.
It's a twisted crime that police say Helms admits.
"From what we understand the rape stemmed from an argument between him
and his brother. And apparently they were arguing over a girlfriend.
And the rape was some sort of retaliation towards his brother," said
Sgt. Jamie Smith of the Albertville Police Department.
It was unusual retaliation on an unsuspecting victim.
Authorities say Helms' mother was apparently passed out drunk on the
couch when the rape started.
"During the attack she did come to and recognize her attacker.
(Reporter: As her son?) As her son," said Smith.
That's when, according to the police report, the mother "tried to get
away, but he held her down until he was finished."
"It's totally sick is what it is," said Smith.
Helms was arrested and charged with the 1st degree rape of his own
mother.
Smith says it's hard to wrap your mind around.
"Shocked, shocked would be more a better way to describe it. That
somebody would dip to the lows to do something of this nature. It's
just pretty much a shock to the conscience of the general public,"
said Smith.
Helms is being held in the Marshall County Jail on $100,000 bond.

Raping Paralyzed Male Patient
SANDUSKY, Ohio -- John Riems, 49, is charged with raping a paralyzed
patient at the nursing home where he was a night-side nurse, and police
say he claimed to have attacked scores of others - so many that he
