Google: Please Appeal ROCKY MOUNTAIN BANK v. GOOGLE (Case C 09-4385 PVT)

On August 12, the Rocky Mountain Bank of Wyoming sent an e-mail
containing sensitive customer data of 1325 individuals and businesses
to the wrong Gmail account. After the faux pax, the bank requested
Google to reveal the identity of the account holder who received the
data [1]. Google did not accommodate the bank so the bank filed suit
in the northern district of California [2].

The bank tried to file the case sealed, but U.S. District Court Judge
Ronald Whyte denied the request. Presumably, the bank was attempting
to subvert breach notification laws and offer the impression
competence. The bank claimed that the disclosure would create panic
and result in a surge of inquiries from customers.

On September 24, U.S. District Court Judge James Ware ordered Google
to deactivate the email account, and required Google to disclose the
Gmail account holder's identity and contact information [3].

Judge James Ware is a real piece of work. His CV includes lying which
cost him a seat in the Court of Appeals [4]. The man is morally
bankrupt and does not even deserve the privilege to preside over
matters.

Google, please 'do the right thing' and not allow this bank and this
judge to run over the account holder. Please appeal the judge's
decision.
