A 74-year-old Melbourne woman was today convicted of the murder of her estranged
husband.
Millicent May Cumberbatch showed no reaction as the guilty verdict was delivered
in the Supreme Court after 18-and-a-half hours of deliberations by the jury, who
retired to consider its verdict on Monday afternoon.
Cumberbatch had pleaded not guilty to the murder of 72-year-old Stanley
Cumberbatch, whose body was found at his home at Kalorama, Mount Dandenong, on
September 9, 2000.
He was bludgeoned to death and also had stab wounds to his neck and back.
Crown prosecutor Ray Elston had told the trial that Cumberbatch killed her
husband because she was jealous of his ex-lover and feared that she and her two
sons would be cut out of his will.
Defence counsel, David Drake said his client had been in such poor health that
she would have been physically incapable of carrying out the murder.
He said there was no forensic evidence against her, no weapon had been found and
the Crown could not rule out the fact that an intruder had committed the murder.
A pre-sentencing hearing will be held before Justice Geoffrey Flatman on May 17.
