C.P. Addition: Margaret de Clare, wife of Gilbert de Umfreville and Bartholomew de Badlesmere, 1st Lord Badlesmere

Complete Peerage 1 (1910): 371–372 (sub Badlesmere) has a good account of Sir Bartholomew de Badlesmere, 1st Lord Badlesmere [died 1322]. Regarding his marriage, the following information is provided:

"He married, before 30 June 1308, Margaret, widow of Gilbert de Umfreville (who died before 23 May 1303, son and heir apparent of Gilbert vii Earl of Angus), aunt and coheiress of Thomas de Clare, Steward of the Forest of Essex, daughter of Thomas de Clare (younger son of RIchard, Earl of Gloucester and Hertford), by Julian (not Amy), daughter of Sir Maurice Fitz Maurice, Lord Justice of Ireland." END OF QUOTE.

Although the connections cited by Complete Peerage are all sound, no documentation is provided for any of these statements.

As far as the date of the marriage of Sir Bartholomew and his wife, Margaret, is concerned, I find that they were married before Michaelmas 1305, as proven by the following Common Pleas lawsuit of that date:

In Michaelmas term 1305 Bartholomew de Badelesmere and Margaret his wife sued Robert de Gretham in the Court of Common Pleas in a Lincolnshire plea regarding a debt of £22 9s. Reference: Court of Common Pleas, CP40/153, image 761f (available at http://aalt.law.uh.edu/E1/CP40no153/aCP40no153fronts/IMG_0761.htm).

Insofar as the death date of Gilbert de Umfreville, the first husband of Margaret de Clare, is concerned, it appears that Gilbert was questioned in Parliament held at Berwick 22 August 1296, for striking Hugh de Lowther, an officer of the king. Reference: The Umfrevilles: Their Ancestors & Descendants (1855): 19–20. This is apparently the last date he was known to be living.

It appears that Gilbert de Umfreville died sometime before Easter term 1302, as indicated by an Exchequer of Pleas lawsuit cited below.

In Easter term 1302 Ralph de Grenham appointed in his place Hugh de Uffynton versus Hugh de Glen and Margaret de Umfravill in a Rutland plea regarding an account. Reference: Exchequer of Pleas, E13no25, image 77 (available at http://aalt.law.uh.edu/AALT4/E1/E13no25/IMG_0077.htm).

The lawsuit regarding Margaret de Umfreville in a Rutland plea in 1302, is readily explained by the fact that she held dower in the manors of Hambleton and Market Overton, Rutland as the widow of Gilbert de Umfreville. See, for example, a settlement of lands by Margaret's father-in-law, Gilbert de Umfreville, Earl of Angus, dated 1301-2, which specifically mentions Margaret's dower in these places. That Gilbert de Umfreville, 1st husband of Margaret de Clare, died testate as proven by the following Common Pleas lawsuit:

In Trinity Term 1306 John de Wasteneys, executor of Gilbert de Umfreville, sued Walter de Blaunkenay in the Court of Common Pleas that he should render to him a reasonable account for the time he was bailiff of the said deceased in Hambleton and Market Overton, Rutland. Walter did not appear, and the Sheriff was ordered to arrest him and produce him on the morrow of All Souls. In summary, we see that Gilbert de Umfreville [the younger] died testate before Easter term 1302. His widow, Margaret de Clare, married (2nd) before Michaelmas term 1305 Sir Bartholomew de Badlesmere, 1st Lord Badlesmere.
