Thomas de la Haye of Spaldington: his paternal ancestry

Hello All,

Following on the recent contribution of Doug Richardson, I found
several wills of the family of de la Hay (or Haye) of Spaldington, co.
Yorks. in Testamenta Eboracensia (Surtees Soc. series). Two wills of
primary interest in setting forth portions of the family pedigree are
given below, those of Peter de la Hay (d. bef 31 Aug 1347) and his
grandson Peter de la Hay (d. bef 11 Apr 1431).

I have provided a detailed pedigree at the end of this article:
the following chart indicates the relationships as currently
understood, and also reflects the (non-blood) connection to the family
of Cresacre of Barnborough and their descendants of Bosvile of
Gunthwaite.

Certain issues are as yet unresolved. These include the problem
of clearly identifying the wife or wives of Thomas de la Haye of
Spaldington (d. 1426). His 2nd daughter Katherine (de la Haye)
Hildyard was likely born say 1415/1420, given what is known of her
husband and her issue, but I cannot fix a birthdate for Thomas more
exactly than an approximation of say 1380-1400. We know that Joan,
widow of Thomas, was involved in an indenture of 1433 re: the marriage
of her minor daughter Alice (4th daughter of Thomas de la Haye) to
Thomas Thwaites, minor son of John Thwaites of Denton. Certainty is
not feasible as yet, but given the minimal time between the oldest
likely birth date for Katherine de la Haye (say 1415) and the death
of Thomas following the birth of 3 additional daughters (1426), I am
inclined toward accepting the suggestion of Brice Clagett that Joan,
wife of Thomas de la Haye, was the one wife of Thomas, and the
daughter of Sir William (or Sir Ralph) Babthorpe of Babthorpe.

There is good reason to believe that there was a blood
relationship
between the de la Hays of Spaldington and the Bowes of Streatlam.
There is a grant and quitclaim dated 21 Dec 1379, ' made before the
Corporation of the city of York, by Peter, son and heir of Thomas de
la Haye of Spaldington, to William de Bowes, of his rights on the
manor of Streatlam and Stainton ' [see pedigree below]. "Willelmo
Bowes chr. " had a bequest in the will of Peter de la Hay (1426)
immediately after one to Peter's wife Elizabeth, and before his
stepson Percival Cresacre. The possibility that Elizabeth, first wife
of Peter de la Hay, was a daughter of the Bowes family, certainly is
entertaining: perhaps the quitclaim of 1379 had to do with Peter's
rights to his wife's maritagium. This possibility certainly
deserves
further study.

To the extent that this pedigree clarifies or adds to the ancestry
of the de la Haye family of Spaldington, this will modify the ancestry
of several 17th century colonists to America, not to mention that of
Camilla Parker-Bowles, Prince William, and many more besides.

Notes, p. 11:

(*) The head of a Yorkshire family of some eminence and distinction.
This will makes several additions to the genealogy of the De la Hays.
The testator, it appears, was twice married. His first wife
Elizabeth,
who was probably the mother of his children, was buried in the
monastery at Ellerton. To this second wife he took another Elizabeth,
a daughter of John Woodruffe (of Wolley?), and widow of James Cresacre
of Barnborough, who survived him, and made her will in 1434, under
which year it will be found.
(Sir) Thomas De la Hay, the eldest son of the testator, married a
daughter of Sir William Babthorpe of Babthorpe, by whom he left five
daughters and coheirs, who carried the representation of his house
into
the families of Vavasour, Hildyard, Knight, and Thwaites. From the
date of his own will, and the absence of his name in the present
document, he probably had died just before the date of his father's
will. By his will, dated July 1, 1426, in which he calls himself
Thomas del Hay, son of Peter del Hay de Spaldyngton, he directs his
body to be buried in the conventual church of Ellerton, near Elizabeth
his mother. He mentions his brother Robert del Hay, and Joan his own
wife, and his children. The wills of several other members of this
family may be found in Testamenta Eboracensia, Part I. to which I must
refer my readers.

(+) In all probability the same person who was prebendary of Givendale,
in the church of York, in 1420. He was also rector of Brantingham,
where his father appears to have had considerable property, which he
leaves to him in his will. Brantingham was a living in the gift of
the
prior and convent of Durham; and he was probably indebted for his
preferment to the kind offices of his father, who may perhaps have
held
some office there under the monastery. He died in 1448, and
administration of his effects was granted on the 8th of January,
1448-9, to Thomas Ellerbek, rector of St. Martin's Conystreet, in
York, and William Crosby of Cave.

Elizabeth del Hay, in 1434.
