London (KurdishMedia.com) 29 December 2001: Mr Huseyin Baybasin has
been on hunger strike since 24 December 2001, protesting against his
treatments by the Dutch authorities.
To reason his hunger strike, Mr Baybasin’s lawyers, Mr Tahsin EKINCI
and Mr Ahmet DAG have made the following statement:
“My client Mr Baybasin has been arrested since 27th March 1998 and
taken to Vosseveld Vught Prison in
Netherlands. My client has not taken to public court for about three
years and has been kept in isolation.
Mr Baybasin has not been permitted to communicate to his mother and
children. The reason has been given is that according to Dutch
judiciary Kurdish language is not one of the European standard
languages. Therefore, my client cannot talk to his children. My client
has also physically been abused by prison authorities and his health
is getting worse. This is my client’s third hunger strike and eleven
other prisoners have joined the strike. My client’s human rights have
been violated.”
Mr Baybasin’s sister, Miss Baybasin has told KurdishMedia.com:
“My brother, Mr Huseyin Baybasin was imprisoned on the 27 March 1998.
Since April 1998, he has been held in isolation, at Nieuw Vosseveld
Vught, and has not taken to a public court until January 2001.
His family, friends and community are concerned as this is his third
hunger strike in three and half years, which will have the most
serious effects on his general health. He has already been suffering
from blood-vomiting and severe headaches. However, his lawyer’s
applications for an objective medical treatment has been refused or
awaited for almost four years while he has been imprisoned in the most
terrible conditions. I have been applying to relevant Dutch
authorities regarding the conditions of the jail. So far, the replies
have not been satisfactory. When his trial finally commenced, he was
denied an unbiased trial, as the court refused to admit witnesses and
evidence in his defence. During the transportation to courts, he was
physically abused and mistreated by the Dutch Security Services.”
Mr Baybasin has been forbidden to speak in his native language,
Kurdish. The Dutch authorities’ pretext is that Kurdish is not a
standard language, such as Turkish and Arabic. In this regard, Miss
Baybasin said, “This is a racist policy that has been practised
against a nation of 40 million Kurds. This policy is against the
European Human Right Laws that the Netherlands is a signatory."
“This is a real problem, as my bother’s children, wife and my mother
cannot speak any other language except Kurdish. That is why they have
not been able to talk to him.” Miss Baybasin added.
“My brother has pained an art work for his daughter’s birthday and
written on it in Kurdish, “Happy Birthday”. He was not allowed to send
the painting out of the prison, because “Happy Birthday” has written
in Kurdish, and not in a ’standard language’. This is defiantly a
breach of my brother’s human right and a breach of the European Human
Right Laws. Family and friends from Turkey have sent postcards to my
brother in Kurdish. They have not been delivered. This is out of
order,” Miss Baybasin added.
A Turkish prisoner, Mr Cemal GUCLU was beaten by jails security
officer and he died on 15 September 1999. The commitment of murder was
not even taken seriously to start investigation. The Dutch authorities
have been blaming another English prisoner for Mr Cemal GUCLU death to
cover their crime.
“We have no rest. We are scarred of that whether my brother would be
the next victim,” Miss Baybasin told KurdishMedia.com.
