Wprost przeciwnie.
Wielki fan pewnych audycji pewnego radia, ktore wbrew innym
twierdzeniom mozna bez trudu odbierac przez satelite,
fale krotkie, internet.
Mowie "pewnych", bo nie znam polskich realiow i te audycje lekko

Najslawniejszym w rodzinie jest poki co dziadek Jakub, ktory wygral
przed I wojna w Sosnowcu i okolicy pare turniejow szachowych.

This is a situational update on recent changes made to the citizenship
law of Poland.
The update reflects status as of 1200 GMT Sunday 09 Jul 2000.
*******************************************************************
1. The draft citizenship Bill, previously referred to as Bill #1408
(Druk Sejmowy 1408) was passed by Poland's Lower House of Parliament
(Sejm) on 29 June 2000 by 386 votes to 2, with 2 abstentions. The
proposed legislation is now subject to confirmation, amendment, or
resubmission to the Lower House by the Polish Senate.
2. The draft law in the form passed by the Sejm differs
significantly from the Government proposals in the original Bill #1408.
The full text of the law passed by the Sejm and now subject to the
Senate debate, is available from the Polish Senate website, at:

The law is now known as the "Ustawa z dnia 29 czerwca 2000 r. o
obywatelstwie polskim".
3. The salient points and changes effected along the path of the
proposal through the Polish lawmaking process so far, are:
(a) A Polish citizen is defined by Section 3 of the new citizenship
law as a person holding Polish citizenship at the date the new law comes
into force, expected to be 1 January 2001. As there are no explanatory
notes or transitional provisions, this MAY mean "citizenship as defined
by the new law". Accordingly, the new law is possibly retroactive in its
definition of who is a Polish citizen. On past performance of the Polish
administration of justice, it is likely that holding any Polish
authority to the principle "lex retro non agit" in any particular case,
while feasible, may require protracted and expensive litigation through
Polish courts.
(b) Section 11 of the new citizenship law identifies a Polish
citizen by birth as a person born of at least one Polish citizen parent.
As a consequence of this definition, ANY AND ALL PERSONS WITH AT LEAST
ONE POLISH CITIZEN GRANDPARENT automatically acquire Polish citizenship
at birth (because at least one of their parents had at least one Polish
citizen parent and thus held Polish citizenship by descent).
The old citizenship law generally required both parents to be Polish
citizens (with certain marginal exceptions).
(c) The threat of making all Polish citizens liable for military
service regardless of any other citizenship held, and their place of
residence (Section 50 of the Bill #1408 draft law) has been abandoned.
Until and unless a separate amendment is introduced to the laws covering
national service in Poland (Ustawa z dn. 21 listopada 1967 r. o
powszechnym obowiazku obrony RP), a Polish citizen who is also a citizen
of another country AND resides permanently outside Poland, is exempt
from military service under Section 4, para 1 of the national service
law mentioned directly above.
Important Warning:
==================
The exemption from military service does NOT cover legal liability for
the past actual or presumed evasion of military service in Poland.
Persons who have been born in Poland and left Poland at any age (as
children or adults) without having served in the Polish military forces,
or without having obtained a written clearance from Polish military
authorities, may have been deemed guilty in absentia of evading their
obligations under the national service law.
Evasion of military service is very broadly defined in Polish law and
carries penalties from 3 months to 5 years imprisonment, depending on
the actual circumstances. There is NO statute of limitations on these
offences while the alleged offender continues to reside outside Poland.
Documented instances have occurred, some as recently as July 1999, of
Poland (a NATO member) - prosecuting and jailing evaders of military
service in pre-1989 communist military forces of Poland (then a member
of the Warsaw Pact and a close ally of the then Soviet Union).
Males residing abroad but born in Poland, who for ANY reason have not
served in Polish armed forces would be most unwise to travel to Poland,
unless they are in a position to conclusively prove with documents, to
the full satisfaction of Poland's notoriously suspicious military
establishment, that they had been formally released from their military
service obligation prior to their emigration from Poland.
(d) Renuciation of Polish citizenship requires consent from the
President of the Republic of Poland (Section 18 of the new citizenship
law). The President's decision is an executive order which is not
appealable to Polish courts. Thus an arbitrary, non-explainable and
non-appealable decision of the President of Poland (currently Mr
Aleksander Kwasniewski, a former Communist Party functionary and a
former minister in the communist Government of Poland before 1989), to
grant or not to grant a release from Polish citizenship, may have
serious consequences for citizens of the United States or another
Western country working for their respective Governments in
security-assessed positions of trust, where dual citizenship is
undesirable or serving in their respective Armed Forces.
(e) The President of Poland will regulate in due course (by a
non-debatable and non-appealable executive order) the criteria that must
be met before a release from Polish citizenship is granted (Section 34
of the new citizenship law). Section 35 of the new citizenship law
stipulates that before any such release is granted, the applicant for
renunciation of Polish citizenship must prove:
- his/her citizenship of another country;
- his/her discharge from any outstanding Polish taxation
obligations;
- discharge from any military service obligations;
- absence of any child maintenance obligations in Poland.
Note that the above criteria will be subject to a reverse onus of proof
- ie. the Polish state does not have to prove that the applicant HAS any
outstanding obligations to the state, the applicant is required to prove
to the state's satisfaction that he/she DOES NOT HAVE any such
obligations.
Obtaining such proof can be confidently expected to be a bureaucratic
nightmare, replete with opportunity for administrative runarounds with
extortionate fees charged at every corner, and rife with opportunity for
petty corruption. Under the realities of Polish administration, it will
remain extremely difficult to obtain official certification of no
obligation without the applicant physically presenting him or herself
to a variety of authorities in Poland, or alternatively, engaging very
expensive professional legal representation in Poland.
(f) A person who is a citizen of Poland and also a citizen of
another country shall be guilty of an offence if he/she presents to any
Polish authority any identity document(s) other than those issued by the
Republic of Poland. The offence is punishable by a fine (the actual
fines remain to be determined).
Thus a citizen of the United States presenting his US passport to Polish
border guards on entry to or exit from Poland may be deemed guilty of an
offence and fined, if the Polish authorities claim that the person is
also a Polish citizen.
Important Warning
==================
Reverse onus of proof applies in the presumptive assessment of
citizenship. Polish border guards are NOT REQUIRED to show cause for
their assumption that a person is a Polish citizen. A person claimed by
the border guards to be a Polish citizen IS REQUIRED to furnish
conclusive legal proof that he/she does not hold Polish citizenship.
While the matter is in dispute, the person cannot leave Poland.

as well as by the Polish Deputy Interior Minister Kazimierz Ferenc, who
stated in the parliamentary debate over the new Bill,

that it is intended from the start that the new law be applied
arbitrarily and selectively, at the discretion of low grade,
undereducated and underpaid officials.

new law will strategically overlook the famous, the influential and the
powerful, reserving its full impact for the meek, the defenceless and
the ordinary. It and will also provide an environment for flourishing
corruption and inequity.
