A. NDM Press Release - On Abiola's Posthumous 61st Birthday
Today, August 24, 1998, Bashorun Moshood Kashimowo Olawale Abiola, the
president-elect of Nigeria, would have turned exactly 61 years old.
Unfortunately, he died on July 7, 1998, having been detained by the Abacha
junta since June 1994, and was refused a release by the Abubakar junta
between the day Abacha died (June 8, 1998) and the day Bashorun Abiola
died in the presence of US State Officials.
The death of these two men - one a wicked dictator, the other a rich but
humble man-of-the-people - had no symmetry. Those who thought a level
playing field had been created may yet have more than they bargained for.
The Man may be dead, but the idea of June 12, the idea of a free nation,
free to choose its own leaders, free from the tyranny of the military and
its collaborators from the four winds of Nigeria marches firmly on.
We commend the courage of the family that he left behind, commend his
spirit to his Maker, and urge all Nigerians to re-dedicate themselves to
striving unceasingly to break free from the shackles of tyranny in
Nigeria.

E. Some of the Decrees that Must Still Be Abrogated
1. The Constitution (Suspension and Modification) Decree, No. 7, 1993
Suspends fundamental rights provisions of 1979 Federal
Constitution. Section 5 prohibits the courts from reviewing
any decrees passed by the military government
2. The Government (Supremacy and Enforcement of Powers) Decree,
No. 12, 1994 Removes the jurisdiction of the courts to
investigate any actions undertaken by members of the
government.
3. The State Security (Detention of Persons) Decree, No. 2, 1984
Allows for indefinite detention, renewable every six weeks, if
the person appears to be a threat to the security of the
state, or if it is believed that the person has contributed to
the economic adversity of the nation.
4. Decree No. 11, 1994 amends Decree No. 2 and allows the
Inspector General of Police and the Chief of General Staff to
detain persons considered threats to the state for three
months (as opposed to 6 weeks) before having to renew the
detention order.
5. The Public Officers (Protection Against False Accusation)
Decree No. 4, 1984 Allows government officials to arrest or
detain persons for what they perceives to be "false
accusations," leaving the burden of proof on the defendants.
6. The Legal Practitioners Act (Amendment) Decree No. 21, 1983
Allowed the government to dismiss the leadership of the
National Bar Association and to appoint a commission to
oversee the administration of the Bar. Similar decrees were
used to ban NUPENG and PENGASSAN.
7. The Treasonable Offenses Decree, No. 7 of 1993 Defines
treasonable acts as anything capable of disrupting the general
fabric of the country, or any part of it.
8. The Offensive Publications (Proscription) Decree, No. 35 of
1993 Provides for the proscription, seizure and confiscation
of a publication likely to disturb the peace and public in
Nigeria or disrupt, hinder, or prevent the progress and
peaceful transition to civil rule.
9. Decree No 14 of 1994 Suspended the right of habeas corpus by
amending the Civil Disturbances Special Tribunal Decree of
1987.

F. "That We May Not Forget that These Others Are Still In Jail"
F-1. Journalists In Detention:
1. Joshua Ogbonna, publisher of The Rising Sun newspaper; March 9.
reportedly arrested in connection with several stories he had written
critical of one of Sani Abacha's supporters. He is being held at the
Criminal Investigation Department, in Lagos.
2-4 Anthony Uranta, a reporter with "Abuja News Day", an
independent weekly, has been held at the Abuja prison since December
1997, and John Edward and Ganiye Adeoye, two journalists with "Prime
Sunset", were arrested on 22 March for unknown reasons.
5. Chidi Nwokpara and Donatus Njoku, freelance journalists; March 24.
6. Okina Deesor, broadcasting producer with Radio Rivers (Port Harcourt,
Rivers State), has been held since 31 July 1996 in the Security Forces
Bureau of Kpor (Rivers State). He still has not been charged. Deesor
had broadcast the national Ogoni anthem on Radio Rivers on 18 July
1996.
7. Niran Malaolu, editor-in-chief of the independent newspaper "The
Diet", has been charged with "treason". The journalist was accused on
14 February, by a special military court based in the northern town of
Jos, of taking part in the coup plot of 21 December 1997. On 28
December, Malaolu was arrested without any official reason being
given. He was sentenced to life imprisonment on 28 April 1998. This
sentence was reduced to 15 years on 10 July.
8. Mr. Chinedu Offoaro, Guardian Newspaper (mistaken identity for
Chidi Offor)
9. BODY TO BE RELEASED: Bagauda Kaltho, a correspondent for "News
Magazine" in Kaduna, who was until recently regarded as missing,
allegedly died a few months ago while in detention in the Kaduna
premises of the State Security Services. The security forces recently
reported him to have been blown up in a bomb accident in Kano
Airport, a report strongly and convincingly denied by his employers,
TheNews Magazine.
