VERDICT IN 'HOTEL' CASE RESERVED FOR FEB. 2

Chennai, Jan. 27 (PTI) - The verdict in the Pleasant Stay
Hotel case involving former Tamil Nadu Chief Minister
Jayalalitha and four others has been reserved for
February 2.

After hearing arguments today from counsel for the
prosecution and defence whether Jayalalitha enjoyed any
immunity under Art. 194 of the Constitution, Special
Judge-II V Radhakrishnan reserved his verdict for Feb. 2
in the case in which the former Chief Minister has been
accused of misusing her office during her tenure between
1991-96.

One of the points raised by the prosecution to prove the
alleged `conspiracy' in the case (in granting exemption
in favour of the hotel's promoters to put up a seven-
storeyed building in Kodaikanal) was that an amendment
was passed by the State Assemby to give retrospective
legislative sanction to the exemption order, allegedly at
Jayalalitha's behest.

The judge, who had concluded the trial and arguments on
Jan. 12, had directed re-opening of the arguments on Jan.
24, seeking some clarifications on the scope of Art. 194
which provides that no member is liable to any court
proceeding in respect of any vote cast by him or her in
the legislature.

Besides Jayalalitha, others accused in the case are
former minister T M Selvaganapathy, former municipal
administration secretary H M Pandey and promoters of the
hotel, Rakesh Mittal and Palai Shanmugham.
