California Deputy District Attorney Scott Tsui is handling
a gang war that erupted on July 20 on Milpitas, California
where more than a dozen youths with knives, iron pipes, bats
and machetes fought a battle that left several victims badly
injured and one teenager dead. Now in Santa Clara County
Superior Court,19-year-old Hieu Trung Nguyen of Milpitas is
charged with the murder of Jeffrey Rogers of Milipitas, 17,
who died of stab wounds in that melee. The slaying was
the result of a three year struggle between a group of
Vietnamese-Americans and a mixed-race faction of teenagers,
said Nguyen's attorney, Richard Hamm. Police handling the
case as street brawl was not gang-related because no
street gang was identified. On the day of the fatal battle,
about 30 combatants faced off in a shopping center near the
park. Tsui said that during the melee, Nguyen used a footlong
a footlong kitchen knife to slash Rogers in the stomach.
Rogers bled to death. When police arrived, the two groups fled.
Most were arrested at three locations within a half-mile
of the fight. Some were tried in juvenile court. Four adults
made plea agreements on charges ranging from manslaughter to
assault. Chau Phi, Vu Ly and Quang Vu each received prison
terms. Charles Edward Long, was given time in county jail.
Hamm said Nguyen had arrived on the scene in response to
a phone call from a friend asking for a ride and went to
his car for the knife and waded into the skirmishers to
scare them off. The trial before Judge Edward F. Lee is
scheduled to last a month.

Under intensive questioning by police Sgt. Daryl Sequeira, Nguyen said on the tape
that the fighting was in progress when he came upon a friend bleeding on the ground and
under attack. Nguyen said that as he attempted to aid the friend, he was set upon by several
people and had to strike out with a knife in his own defense. Although some of the assailants
may have been cut, Nguyen said he could not be sure that he stabbed anyone.
