Gaza residents 'live in despair'

BBC News - The International Committee of the Red Cross has described
the 1.5 million Palestinians living in Gaza as people "trapped in despair".

In a report, it said that a main cause was the continuing Israeli blockade.

The report comes six months after the end of Israel's military offensive
in Gaza in which at least 1,100 Palestinians died.

Israel said the offensive was aimed at curbing rocket attacks into
southern Israel by Palestinian militants.

The Red Cross says that the people of Gaza are unable to rebuild their
lives and are sliding ever deeper into despair.

There is not the cement or steel to reconstruct neighbourhoods hit by
Israeli strikes.

Seriously ill patients are not receiving the treatment they need. The
water supply is patchy, sanitation on the point of collapse.

The ICRC statement comes as a UN Human Rights Council inquiry into
alleged war crimes in Gaza and southern Israel holds public hearings in
Gaza City.

South African judge Richard Goldstone's inquiry is holding two days of
hearings in Gaza and will take testimony in Geneva in July.

Israel has refused to allow the investigators onto its territory and has
accused the mission of bias against it.

Worst affected

Poverty in Gaza is at what the Red Cross calls an "alarming" level.

"The poorest residents in particular have exhausted their coping
mechanisms and often have to sell off their belongings to be able to buy
enough to eat," said Antoine Grand, head of the ICRC's sub-delegation in
Gaza.

"Worst affected are the children, who make up more than half of Gaza's
population," he added.

The Red Cross says the crisis is directly linked to Israel's tight
closure of the crossing points into Gaza after the Islamist Hamas
movement took power there two years ago.

The Israeli prime minister's spokesman told the BBC that Hamas is
primarily responsible for the hardship of Gaza's civilian population.

And he said the idea that, should building materials be allowed in,
Hamas would not siphon them off for what he called its military machine
was simply not credible.

Donors have pledged $4.5 billion for reconstruction and rehabilitation
in Gaza following the 22-day offensive which left more than 50,000
homes, 800 industrial properties and 200 schools damaged or destroyed,
as well as 39 mosques and two churches.

What is a Palestinian? by Joseph Farah

Ever since I wrote a column last October called "Myths of the Middle East,"
readers from around the world have asked me what is meant by the term
"Palestinian."

The simple answer is that it means whatever Yasser Arafat wants it to mean.

Arafat himself was born in Egypt. He later moved to Jerusalem. Indeed, most
of the Arabs living within the borders of Israel today have come from some
other Arab country at some time in their life.

For instance, just since the beginning of the Oslo Accords, more than
400,000 Arabs have entered the West Bank or Gaza. They have come from
Jordan, Egypt and, indirectly, from every other Arab country you can name.

The Arabs have built 261 settlements in the West Bank since 1967. We don't
hear much about those settlements. We hear instead about the number of
Jewish settlements that have been created. We hear how destabilizing they
are -- how provocative they are. Yet, by comparison,

only 144 Jewish settlements have been built since 1967 - including those
surrounding Jerusalem, in the West Bank and in Gaza.

The number of Arab settlers is based on statistics collected on the Allenby
Bridge and other collection points between Israel and Jordan. It is based on
the number of Arab day workers entering but not leaving Israel. The numbers
were published by the Israel Central Bureau for Statistics during the
administration of Binyamin Netanyahu and subsequently denied as "recording
errors" by the Ehud Barak administration.

Of course, the Barak administration had incentives for denying the high
illegal immigration numbers, given its heavy political reliance on Arab
voters.

Is this a new phenomenon? Absolutely not. This has always been the case.

Arabs have been flocking to Israel ever since it was created and even
before, coinciding with the wave of Jewish immigration into Palestine prior
to 1948.

Winston Churchill said in 1939: "So far from being persecuted, the Arabs
have crowded into the country and multiplied till their population has
increased more than even all world Jewry could lift up the Jewish
population."

And that raises a question I never hear anyone ask: If Israel's policies
make life so intolerable for Arabs, why do they continue to flock to the
Jewish state?

This is an important question as we see the Palestinian debate now shift to
the issue of "the right of return."

According to the most liberal claims by Arab sources, some 600,000 to
700,000 Arabs left Israel in and around 1948 when the Jewish state was
created. Most were not forced out by Jews, but rather left at the urging of
Arab leaders who had declared war on Israel.

Yet, there are far more Arabs living in these territories now than ever
before. And many of those who left in 1948 and thereafter actually had roots
in other Arab nations.

This is why it is so difficult to define the term "Palestinian." It always
has been. What does it mean? Who is a "Palestinian"? Is it someone who came
to work in Palestine because of a bustling economy and job opportunities? Is
it someone who lived in the region for two years?

Five years? Ten years? Is it someone who once visited the area? Is it any
Arab who wants to live in the area?

Arabs outnumber Jews in the Middle East by a factor of about 100 to one.

But how many of those hundreds of millions of Arabs are actually
Palestinians? Not very many.

The Arab population of Palestine was historically extremely low - prior to
the Jews' renewed interest in the area beginning in the early 1900s.

For instance, a travel guide to Palestine and Syria, published in 1906 by
Karl Baedeker, illustrates the fact that, even when the Islamic Ottoman
Empire ruled the region, the Muslim population in Jerusalem was minimal.

The book estimates the total population of the city at 60,000, of whom 7,000
were Muslims, 13,000 were Christians and 40,000 were Jews. "The number of
Jews has greatly risen in the last few decades, in spite of the fact that
they are forbidden to immigrate or to possess landed

property," the book states.

Even though the Jews were persecuted, still they came to Jerusalem and
represented the overwhelming majority of the population as early as 1906.

Why was the Muslim population so low? After all, we're told that Jerusalem
is the third holiest city in Islam. Surely, if this were a widely held
belief in 1906, more of the devout would have settled there.

The truth is that the Jewish presence in Jerusalem and throughout the Holy
Land persisted throughout its bloody history, as is documented in Joan
Peters' milestone history on the origins of the Arab-Jewish conflict in the
region, "From Time Immemorial."

It is also true that the Arab population increased following Jewish
immigration into the region. The Arabs came because of economic activity.
And, believe it or not, they came because there was more freedom and more
opportunity in Israel than in their own homelands.

What is a Palestinian? If any Arabs have legitimate claims on property in
Israel, it must be those who were illegally deprived of their land and homes
after 1948. Arafat has no such claim. And few if any of those shooting,
bombing and terrorizing Israelis today do either.

JERUSALEM, July 2 (Reuters) - Amnesty International said on Thursday
Israel inflicted "wanton destruction" in the Gaza Strip in attacks that
often targeted Palestinian civilians during an offensive in December and
January in the Hamas-run enclave.

The London-based rights group, in a 117-page report on the 22 days of
fighting, also criticised the Islamist movement Hamas for rocket attacks
on Israel, which it called "war crimes".

Among other conclusions, Amnesty said it found no evidence to support
Israeli claims that Gaza guerrillas deliberately used civilians as
"human shields", but it did, however, cite evidence that Israeli troops
put children and other civilians in harm's way by forcing them to remain
in homes taken over by soldiers.

Amnesty International said some 1,400 Palestinians were killed in
Israel's Operation Cast Lead, including 300 children and hundreds of
innocent civilians, a figure broadly in line with those from the
Hamas-run Health Ministry in Gaza and the independent Palestinian Centre
for Human Rights.

The Israeli military put the Palestinian death toll at 1,166 of whom 295
were civilians. Thirteen Israelis were killed, including three
civilians, during the offensive Israel launched with the declared aim of
curtailing cross-border rocket attacks.

Accusing Israel of "breaching laws of war", Amnesty said: "Much of the
destruction was wanton and deliberate, and was carried out in a manner
and circumstances which indicated that it could not be justified on
grounds of military necessity."

Commenting on Amnesty's allegations, the Israeli military said it
operated in accordance with international law. It said the report
ignored "efforts made by the Israel Defence Forces to minimise, as much
as possible, harm to non-combatants".

"In many cases, the Israel Defence Forces exercised measures of caution,
including warning the civilian population before an attack," the
military said. "The Israel Defence Forces directed its attack only
against military targets."

A Hamas spokesman said the Amnesty report did not place enough emphasis
on "crimes committed by Israel".

"This report equates between the aggressor and the victim and ignores
international laws that guarantee resistance against occupation," the
spokesman said.

U.N. INQUIRY

Israel and Hamas have both rejected accusations of war crimes during the
Gaza fighting. Israel has refused to cooperate with a United Nations
inquiry that is now gathering evidence, accusing the investigators of
prejudice against it.

Amnesty said although rockets fired by Palestinian militants from the
Gaza Strip rarely cause casualties, their use was "indiscriminate and
hence unlawful under international law". The rockets often sow fear and
panic.

It also accused Hamas and other armed groups of endangering the lives of
the Palestinian civilian population in Gaza by firing rockets and
locating military equipment near homes.

The report however dismissed Israeli claims that Hamas had used
Palestinian civilians as "human shields".

Amnesty said it found no evidence that "Hamas or other armed groups
forced residents to stay in or around buildings used by fighters, or
that fighters prevented residents from leaving buildings or areas which
had been commandeered by militants".

But the report said in several cases Israeli soldiers used Palestinian
civilians, including children, as "human shields, endangering their
lives by forcing them to remain in or near houses which they took over
and used as military positions".

Just four years ago, the defense establishment decided to carry out a
seemingly elementary task: establish a comprehensive database on the
settlements. Brigadier General (res.) Baruch Spiegel, aide to then
defense minister Shaul Mofaz, was put in charge of the project. For over
two years, Spiegel and his staff, who all signed a special
confidentiality agreement, went about systematically collecting data,
primarily from the Civil Administration.

One of the main reasons for this effort was the need to have credible
and accessible information at the ready to contend with legal actions
brought by Palestinian residents, human rights organizations and leftist
movements challenging the legality of construction in the settlements
and the use of private lands to establish or expand them. The
painstakingly amassed data was labeled political dynamite.

The defense establishment, led by Defense Minister Ehud Barak,
steadfastly refused to publicize the figures, arguing, for one thing,
that publication could endanger state security or harm Israel's foreign
relations.

Someone who is liable to be particularly interested in the data
collected by Spiegel is George Mitchell, President Barack Obama's
special envoy to the Middle East, who came to Israel this week for his
first visit since his appointment. It was Mitchell who authored the 2001
report that led to the formulation of the road map, which established a
parallel between halting terror and halting construction in the settlements.

The official database, the most comprehensive one of its kind ever
compiled in Israel about the territories, was recently obtained by
Haaretz. Here, for the first time, information the state has been hiding
for years is revealed.

An analysis of the data reveals that, in the vast majority of the
settlements - about 75 percent of the [Israeli] construction, sometimes
on a large scale, has been carried out without the appropriate permits
or contrary to the permits that were issued. The database also shows
that, in more than 30 settlements, extensive construction of buildings
and infrastructure (roads, schools, synagogues, yeshivas and even police
stations) has been carried out on private lands belonging to Palestinian
West Bank residents.

That is because the UN is a laughable, insignificant group
that doesn't say what it means, or mean what is says.
If the UN wants to go to Gaza, they don't need Israel's permission.
Thye merely want assurances that they won't be killed. And that
can't happen when Hamas is in charge.

Who cares what they labelled it as.
When is anyone going to address the ILLEGAL, IMMORAL WARS
that the Arabs started in order to kill the Israeli's and push them into
the sea? Those wars were always started by the Arabs, and they were
always ended when America asked Israel to stop kicking their asses.
During those wars, land was taken from the Arabs in huge chunks.
Most of that land was returned to the Arabs.... Just not the land above
Jerusalem that was used to lob mortars into the Israeli civilian population.

Israel kept some land that they felt was important to their safety.
They didn't have to give back the Sinai Penninsula. They didn't
have to stop the war just a few miles outside of Cairo.

The Arabs should try to figure it out that you shouldn't poke a bear
in the eye with a sharp stick. It pisses the bear off.

How many rockets has been launched from Gaza into
the civilian population of Israel since this "roadmap?"

The article itself indicates that Palestinians are often denied permits
by Israel to build on their OWN lands while IT'S DOCUMENTED that the
Israelis are building even WITHOUT permits on PALESTINIAN owned lands.

Are the West Bank and Gaza "occupied territories" as Palestinain Arabs
assert?
As a result of the Six Day War, Israel gained all of Jerusalem, the Golan
Heights, Sinai, the Gaza Strip, and the West Bank (historically known as
Judea and Samaria). Palestinian Arabs often insist on using the term
"occupied territories" to describe these areas, usually connected to the
assertion that they fall under the 1949 Fourth Geneva Convention. Yet,
Palestinian spokesmen also speak about Israeli military action in Area A as
an invasion, an infringement on Palestinian sovereignty. The use of both
forms of terminology is a contradiction. If Israel "invaded Palestinian
territories" in the present, then they cannot be regarded as "occupied";
however, if the territories are defined as "occupied," Israel cannot be
"invading" them.

Israeli legal experts traditionally resisted efforts to define the West Bank
and Gaza Strip as "occupied" or falling under the main international
treaties dealing with military occupation. Former Chief Justice of the
Supreme Court Meir Shamgar wrote in the 1970s that there is no de jure
applicability of the 1949 Fourth Geneva Convention regarding occupied
territories to the case of the West Bank and Gaza Strip since the
Convention:

a.. ... is based on the assumption that there had been a sovereign who was
ousted and that he had been a legitimate sovereign.
In fact, prior to 1967, Jordan had occupied the West Bank and Egypt had
occupied the Gaza Strip; their presence in those territories was the result
of their illegal invasion in 1948. Jordan's 1950 annexation of the West Bank
was recognized only by Great Britain and Pakistan and rejected by the vast
majority of the international community, including the Arab states.

International jurists generally draw a distinction between situations of
"aggressive conquest" and territorial disputes that arise after a war of
self-defense. Former US State Department Legal Advisor Stephen Schwebel, who
later headed the International Court of Justice in the Hague, wrote in 1970
regarding Israel's case:

a.. Where the prior holder of territory had seized that territory
unlawfully, the state which subsequently takes that territory in the lawful
exercise of self-defense has, against that prior holder, better title.
Israel only entered the West Bank in 1967 after repeated Jordanian artillery
fire and ground movements across the previous armistice lines; additionally,
Iraqi forces crossed Jordanian territory and were poised to enter the West
Bank. Under such circumstances, even the United Nations rejected Soviet
efforts to have Israel branded as the aggressor in the Six-Day War.

Regardless of how many times the Palestinian Arabs claim otherwise, Israel
cannot be characterized as a "foreign occupier" with respect to the West
Bank and Gaza Strip. Fundamental sources of international legality decide
the question in Israel's favor. The last international legal allocation of
territory that includes what is today the West Bank and Gaza Strip occurred
with the League of Nations Mandate for Palestine which recognized Jewish
national rights in the whole of the Mandated territory, including the sector
east of the Jordan River, almost 80% of the original Mandated territory,
that was given to Palestinian Arabs and Emir Abdullah to create the country
of Trans-Jordan (later renamed Jordan). Moreover, the rights under the
Mandate were preserved under the United Nations as well, according to
Article 80 of the UN Charter, after the termination of the League of Nations
in 1946.

It is important to observe that, from the time these territories were
conquered by Jordan, Syria and Egypt in 1948 to the time they were gained by
Israel in 1967, the territories were not refered to as "occupied" by the
international community. Furthermore, the people living in those territories
before 1967 were not called "Palestinians" as they are today; they were
called Jordanians and Egyptians. (In fact, before Israel was founded Jews
and Arabs alike who lived in the region were called Palestinians. The
newspaper was the "Palestine Bulletin" and later the "Palestine Post" before
becoming today's "Jerusalem Post", the Jewish-founded electric company was
"Palestine Electric" and so on.) There was no call for "liberation" or
"national rights" for the Arabs living there and no Palestinian nation was
discussed.

No UN resolution requires Israel to withdraw unilaterally from the
territories, nor do they forbid Israelis from going there to live. In
particular, the often-misquoted UN Security Council Resolution 242 (and
related Resolution 338) make no such demand or requirement. The demand that
Israel stop creating "illegal settlements" is similarly baseless.

Under the Oslo Accords, the "peace process" started in 1991 at the Madrid
Conference, Israel agreed to withdraw from the disputed territories and
Yasser Arafat's Palestinian Authority (PA) was given control over land
chosen so that more than ninety-nine percent of the Palestinian population
lived under the jurisdiction of the PA. But the committment to Israel's
security that was the backbone of the Oslo agreements was never honored by
the PA and Israel was forced to periodically re-enter the ceded territory to
quell terrorism. In 2000, Yasser Arafat rejected sweeping concessions by
Israel at Camp David -- promoted by US Pres. Clinton in an attempt to reach
a final peace agreement -- and the Palestinian Arabs turned again to
violence with the Al Aqsa Intifada. That is, after the PA was governing
nearly all Palestinian Arabs and a generous peace offer with international
backing was on the table, the only response Israel got was increased
violence. This is the sole reason Isreal continues to have a military
presence in the disputed territories.

The best way to straighten them out is to help
