education or slow progress through an organizational hierachy. So by examining

population least likely to commit crime.

Not so fast there. Before we start talking about a black population subset
that claims to have the same level of crime as whites, I'd like to see the
data. First I don't believe this data exists, as I have never seen it.

NASHVILLE - The head of Fisk University's Race Relations Institute asserted
before a legislative committee Wednesday that much of Lt. Gov. John Wilder's
large family landholdings in Fayette County were illegally obtained from
black property owners by Wilder's grandfather and father.
Raymond Winbush refused to present any evidence of his charge, which he made
during a hearing about reparations to African-Americans for enslavement of
their ancestors.
Wilder, described as ''very upset'' over Winbush's assertion, emphatically
denied the charge in a statement issued by his chief of staff, Pat Miller.
''I don't know who Ray Winbush is, or what motivates him,'' said Miller, who
called the charges ''outrageous and possibly slanderous.''
Winbush appeared before the House Judiciary Committee in support of a
legislative resolution by state Rep. Henri Brooks (D-Memphis). The
resolution calls for a state commission to study the impact of slavery on
African-Americans and whether ''any form of compensation to the descendants
of African slaves'' is warranted.
In his remarks, Winbush alluded to Wilder's family as an example of those
who took land from black owners before and after the Civil War. He said he
intends to document it as part of a research project in about six months.
Winbush told the committee: ''We at the Race Relations Institute are about
to undertake a study . . . and we know (in) the state of Tennessee,
particularly in West Tennessee, that our current Lt. Gov. John Wilder's
entire wealth - and that is not an exaggeration - was derived from
systematically taking land from African-Americans.''
Claiming that the land takings started with Wilder's grandfather in the
''latter part of the 1800s,'' Winbush said, ''We are going to document that
and we are going to publish the research.''
Winbush cited a series of articles by The Associated Press, which appeared
in The Commercial Appeal and other newspapers this week. The series
documented how land was taken from black owners in the decades between the
Civil War and the civil rights era through violence, intimidation and other
illegal means. He said the institute he directs at Fisk, and others like it,
helped the AP research the articles.
Wilder, the top officer of the state Senate, was not present during the
hearing. House members of the committee sat stunned and stone-faced, offered
no response and asked Winbush no questions after his brief presentation.
Later, Winbush repeated his assertions to reporters but declined requests to
produce evidence. ''Black residents have talked for years about how the land
was stolen, about deeds being altered. . . . Land was illegally obtained.
It's not my opinion; it's fact,'' he said.
Winbush has been at Fisk since soon after he resigned under fire six years
ago as head of the Black Cultural Center at Vanderbilt University. Winbush
said at the time that he was resigning because Vanderbilt's efforts at
diversity were only ''lip service,'' according to an article in the
Vanderbilt Hustler, the student newspaper.
But the same article quoted Vanderbilt's vice chancellor for university
relations at the time, Jeff Carr, as saying, "Accounts under Dr. Winbush's
control were mismanaged and university funds provided for the center's
operations were misused for personal gain. When confronted with the results
of that audit on June 16, 1995, and given an opportunity to resign, Dr.
Winbush chose that option.''

Test results have found a DNA match that links a Detroit man to the rape and
fatal beating of 12-year-old J'nai Glasker as she slept in her Detroit
bedroom, police said Wednesday.
Evidence found on the girl's body matches a DNA sample from the suspect,
Ricardo Stubbs, 22, according to a high-ranking police official who asked
not to be identified because the investigation is still open. Police
officials say that it could be several more days before a warrant request is
sought from the Wayne County Prosecutor's Office.
Stubbs, who is in custody, was arraigned Nov. 26 in an unrelated case on
charges of criminal sexual conduct and home invasion. Last week Inspector
William Rice said that Stubbs confessed to raping and killing J'nai.
Stubbs' alleged confession is the second in the case, which drew heavy
attention for its brutality and because J'nai's mother fled the home to seek
help after finding her daughter being sexually assaulted.
An initial suspect, who has an IQ of 71 and reads at a sixth-grade level,
confessed to the crime, police said. He was cleared because the DNA test was
not a match.
J'nai's body was found in her blood-soaked bed. Her bedroom walls and floor
were covered with blood; she had been struck in the head more than 30 times.
Just after midnight Aug. 31, 2000, J'nai's mother heard moans and looked in
on her daughter. She saw a man raping her. She ran from their home in the
19300 block of Stansbury screaming for help. She called police at a
neighbor's house and returned with officers to find that her daughter had
been killed.
J'nai, who had just started seventh grade at Beaubien Middle School,
received good grades and was active in the glee club and choir.
Police said Stubbs, who is being held in the Wayne County Jail without bond,
also entered the northwest Detroit home of a woman on June 4, assaulted her
with a blunt object and raped her. After the woman identified him as the
rapist, police said, Stubbs fled to Memphis, Tenn.
Stubbs was extradited to Detroit after being stopped by Memphis police.
During questioning, Stubbs told investigators that he had also raped and
killed J'nai.

A 41-year-old Detroit man who police describe as a dangerous serial rapist
is expected to be charged today with four sexual assaults -- including the
rape of two schoolgirls.
Police said Paul Ellis Smith raped two girls as they walked to school during
the 1998-1999 school year. In addition, police have linked him with DNA
evidence to the rapes and home invasions of two women on the city's far east
side during the same period.
Smith has been charged in a separate case in which an east-side woman
identified him as the man who broke into her home, raped her and then
escaped on a bicycle around 4 a.m. Nov. 26. DNA evidence found on the woman
matches Smith's.
He was arraigned Wednesday on charges of first-degree criminal sexual
conduct and home invasion in that case.
Police initially overlooked Smith as a suspect during the string of
schoolgirl and adult rapes because he was in jail for parole violation.
Smith was convicted of a sexual assault in 1980 and of armed robbery in
1991.
"But back in June, he got out of jail," said Lt. Michael Walsh of the
Detroit Police sex-crimes unit.
Ten schoolgirl rapes were reported during the 1998-99 school year. Most
occurred on the city's east side behind vacant buildings, garages or in
alleys. Most of the girls were walking alone.
Smith was arrested by Grosse Pointe Park police on Nov. 26 for suspicion of
attempted home invasion and obstructing a police officer. While in custody,
Grosse Pointe investigators noticed the man resembled a computer-generated
image of a man wanted in a Detroit sexual assault.
Smith is expected to be arraigned today on charges of first-degree criminal
sexual conduct in connection with the rape of a 14-year-old girl in 1998 and
a 16-year-old in 1999. He also faces arraignment on charges of home
invasion, armed robbery and rape in 36th District Court today in two other
cases. If convicted, he faces up to life in prison.

Teens plead guilty in sexual assault
Ending months of denial, two teenagers pleaded guilty as adults Wednesday in
the sexual assault of a 12-year-old girl at Hutchins Middle School in
Detroit.
Audi Dawson, 15, accepted a deal offered by the Wayne County Prosecutor's
Office and pleaded guilty to third-degree criminal sexual conduct. He
admitted assaulting the girl in a secluded area of the school on May 1.
The agreement means that Dawson would expect to be sentenced to 3-15 years
in prison. But after he completes parole and is released, the charge can be
reduced to a misdemeanor, said his lawyer, Todd Russell Perkins.
Assistant Prosecutor Douglas Baker said his office would not object to the
reduction, provided that Dawson commits no other crimes in or out of prison.
A codefendant, Dominique Brown, also 15, pleaded guilty earlier Wednesday to
fourth-degree criminal sexual conduct, a misdemeanor, in an agreement that
gives her an adult conviction but a sentence tailored to her age.
Under the agreement, Brown will become a ward of the state but will be under
the supervision of the Wayne County Department of Community Justice. She
will be confined for one year at the Vista Maria residential treatment
program for troubled girls in Dearborn Heights and later will be enrolled in
other rehabilitation programs.
Both will be sentenced Jan. 16 by Wayne County Circuit Judge Patricia
Fresard.
Fresard, who will retain control of Brown for the next three years, warned
the girl that if she fails to cooperate with the rehabilitation programs,
she may be locked up under harsher terms.
Brown and Dawson also must register as sex offenders.
Two other youths -- a 13-year-old girl and 14-year-old boy -- have pleaded
guilty to reduced charges as juveniles in the case and face sentencing to
similar rehabilitation programs, although they may not be confined.
Dawson and Brown had been charged with first-degree criminal sexual conduct
involving a child under age 13, which carries a maximum penalty of life in
prison upon conviction.
The 12-year-old girl told police that she was lured out of class by the two
younger teens and tricked into going to an abandoned fourth-floor area of
the school, located on Woodrow Wilson Street. There, she said, she was
grabbed by Dawson and carried over a catwalk to an attic area.
While Brown and the other girl held her, she said, Dawson sexually assaulted
her.
Brown had said she was present but denied forcing the girl in any way.
But Wednesday, she told Fresard a different story.
"I held" the girl "down while Audi had sex with her," Brown said quietly.
Asked by the judge if she was aware the girl was under age 13, Brown said
yes.Sex with a child under 13 is treated as a more serious offense.
Brown heaved a sigh after it was over, the beads in her carefully braided
hair clicking quietly.
Dawson said little except that he had sex with the girl. His mother wept
audibly in the back row of the courtroom as he admitted his guilt.
After the pleas, the father of the victim said he was satisfied that justice
was being served and that the convicted youths would get counseling and
other treatment.
"We want to try to get them some help," the father said. "We relied on the
justice system, and it has not let us down so far."

Testers weigh bias in housing

When a Jacksonville apartment finder kept showing Frank Bernard places on
the Northside two years ago, he said he experienced a subtle form of housing
discrimination.
Bernard, who is African-American, said he asked for locations on the
Southside near Florida Coastal School of Law, where he attends school, but
was not shown properties there.
"I think housing discrimination should be one of the top concerns of
citizens because I think in order to be an inclusive community, we have to
live together," said Bernard, the new fair housing coordinator for
Jacksonville.
Bernard and others who investigate allegations of housing discrimination at
Jacksonville Area Legal Aid sometimes use volunteers or testers to visit
businesses to evaluate whether companies treat people fairly. Testers are
used to check apartment rentals, house sales, insurance, lending -- anything
that has to do with housing.
"Discrimination used to be something overt," said Michael Figgins, executive
director of Jacksonville Area Legal Aid. "Now it's often subtle, and
sometimes the only way you can discover it is through testing."
Jacksonville Area Legal Aid received a federal grant recently that allows
the agency to increase the geographic area where it tests the fair treatment
of consumers. The grant pays for administrative costs, such as supplies and
legal fees, but it also covers stipends for testers.
Legal Aid is working with a grant from the U.S. Department of Housing and
Urban Development for $150,000 over two years, which covers Baker, Clay,
Duval and Nassau counties, and will expire in March 2003. Another HUD grant
for $248,000 will run from April to March 2003 and adds Bradford and St.
Johns counties.
Figgins said his agency is always looking for testers of any ethnic makeup.
Right now, about 20 testers are available.
The 1968 Fair Housing Act made it illegal for housing providers to
discriminate, but people are still denied loans and refused apartments and
homes based on who they are. Testers are needed to help prove cases.
Nearly 50 cases were settled in mediation this year, Figgins said. In the
last four to five years, Jacksonville Area Legal Aid has resolved about six
fair housing cases that went to federal court but did not go to trial.
"In every case, we've been able to keep the housing and get damages awarded
to the individual," Figgins said.
Housing discrimination happens to everybody in the community, Bernard said.
"It's not limited to minority groups."
For example, a white man who is perceived to be gay could be denied housing.
A consumer could be told nothing is available or that a house was already
sold and not know the landlord or seller is lying.
Someone who feels discriminated against can file a complaint. If a black
woman, for example, alleges she was denied an apartment because of her race,
Legal Aid sends two testers to the apartment complex. One tester would be a
black woman and another would be a white woman. The testers would give
scripted information so that their applications would be as parallel as
possible. The testers observe and report their treatment, which is reviewed
by attorneys and investigators.
Discrimination can be based on religion, gender, race, sexual orientation,
whether a person is disabled or a person's country of origin. Since the
terrorist attacks on Sept. 11, more complaints have come to Bernard
concerning discrimination on the basis of national origin.
Bernard and Figgins said another concern is predatory lending, where
mortgage providers offer low-income families high interest rates when they
qualify for a lower rate.
"We're going to make sure you meet the standards; if you don't meet the
standards, you'll meet us," Bernard said.

Shoplifting suspect charged in crash death of daughter, 9

A 42-year-old North Bend woman has been charged with vehicular homicide in
the death of her 9-year-old daughter after crashing into a tree while trying
to avoid arrest on suspicion of shoplifting.
Anita Durrett was charged Tuesday in Snohomish County Superior Court. She
will be arraigned Dec. 18. If convicted, she faces up to 12 years in prison.
On June 9, prosecutors say, Durrett walked out of the Albertson's store on
the Woodinville-Duvall Road without paying for $266.16 in groceries. A
manager followed her into the parking lot and, after a brief confrontation
with him and other employees, she drove off. Her daughter, LaDawna, was a
passenger.
Prosecutors say the manager asked two other employees to tail Durrett and,
in trying to elude them, she drove at speeds up to 80 mph on 156th Avenue
Northeast, a hilly, winding two-lane road. She eventually lost control and
slammed into a tree near 75th Avenue Southeast, about 2-1/2 miles from the
store.
Durrett suffered serious injuries; her daughter died instantly.
Authorities said it's not uncommon for supermarket employees to follow
suspected shoplifters. State law allows them to use reasonable force to stop
shoplifting or retain stolen merchandise.

Towns call school plan harmful

RALEIGH - Wake's ambitious student reassignment plan is getting more
opposition from sources usually friendly or at least neutral: business
leaders and elected officials in the county's small towns.
Resolutions ranging from strong concern to outright condemnation of the
reassignment proposal have been approved by town governments in Apex and
Holly Springs and the chambers of commerce in Apex, Fuquay-Varina and
Garner.
Except Holly Springs, these groups historically have stayed out of the
annual fights over school reassignment. But they say the most recent
proposal, which reassigns large numbers of students to schools outside their
towns, would hurt civic pride and impair the economic development of their
communities.
"Civic pride is very strong in Apex, and that's very good for the schools,"
said Apex Mayor Keith Weatherly. "Apex residents should be able to attend
Apex schools."
The groups are lobbying school officials to modify the proposal before it's
presented to the school board in January. The public has until Monday to
comment on the proposal, which would reassign about 5,800 students to ease
overcrowding, fill new and under-enrolled schools and promote socioeconomic
diversity.
Unlike in the past, this year's proposal moves large numbers of students
from middle- and upper-income families to schools with high percentages of
students from low-income families. Traditionally, the burden of student
shifts to diversify schools has fallen almost exclusively on low-income
families.
The proposal already has drawn opposition from several school PTAs, which
traditionally have also stayed neutral during reassignment. Although their
reasons vary, much of the concern is over how the proposal would reassign
the children of so many active PTA members.
Walt Sherlin, associate superintendent for operational services, said the
system has tried not to send students out of their communities when
possible. But he said that Wake has to think in terms of the whole county
when it assigns students.
"We've got a school system that addresses capacity from a countywide
perspective," Sherlin said.
Much of the concern from business groups involves the consequences of
reassignment on economic development.
"Schools in Apex are very good," said Susan LoPresti, executive director of
the Apex Chamber of Commerce. "It's a significant factor why people come
here. If we can't tell these people that they're going to nearby schools, it
will significantly impact development."
LoPresti said the Apex chamber hasn't gotten involved in reassignment
before, but the difference this time is that so many local students could be
reassigned out of town.
The Garner Chamber of Commerce has launched a petition campaign to block the
reassignment of Rock Service Station area students from Garner High School
to Middle Creek High School.
The Garner chamber also doesn't want the school system to reassign students
from East Wake High School who would increase the proportion of students
from low-income families at Garner High School. The chamber asks that the
system try to make sure every Garner school has less than 40 percent of its
students receiving subsidized lunches.
Students should stay at schools close to their homes so it's easier for
parents to be involved in their children's schools, opponents say.
LoPresti cited the example of how the busing in of Raleigh students to an
Apex elementary school resulted in the children being so far from home that
many parents couldn't attend a recent father-son event.
"If these students are bused 30 minutes away, their parents just can't drop
by," LoPresti said. "They just won't be as able to get involved."
This concern was echoed by Deb Carlton, whose daughter attends Holly Springs
Elementary School but could be bused to Lincoln Heights Elementary School in
Fuquay-Varina.
"How does my daughter benefit if I can't go to my daughter's school once a
week to read to her or to have lunch with her or attend a PTA meeting?"
Carlton asked.
Although the opinion is not shared by all the opposition groups, many say
reassignment from their community's neighborhood schools in the name of
diversity is counterproductive.
The Apex Board of Commissioners declared that "senseless busing of
schoolchildren across all of Wake County merely to achieve arbitrary
diversity goals is counter-productive to quality education, a safe and
stable school environment, a rested and ready-to-learn child, and local
community support."
The Holly Springs Board of Commissioners said that 198 local students are
being asked "to sacrifice their rights to attend a school in their home
communities for the sake of helping Wake County Public Schools achieve this
illusion of balanced educational opportunities."
The board passed a similar resolution last year.
"You should be assured that you can go to the school nearest to you," said
Holly Springs Commissioner Hank Dickson. "That should be a basic fact."
Pressure is being placed on the two junior school board members who
represent the small towns to try to change the proposal. This is the first
reassignment proposal that board members Jeff York and Amy White have
experienced.
White, whose biggest base of support in her campaign was Garner Chamber of
Commerce members, said Wake schools need to take into account the concerns
of her constituents in Fuquay-Varina, Garner and Willow Spring who feel that
their interests haven't been considered in the past.
"What I'm seeing is that they want everyone to be team players," White said.
"Every member has to be strong, and that's not the case."
York said the responsible thing to do is to hear these groups out.
"I want to see if they're taking into account the goals of the school
system," York said. "They may have valid points."

A 13-year-old girl was shot in the leg Wednesday afternoon as she and a girl
the same age played with a .38-caliber pistol at a home in east Mobile,
family members said.
Jawanda Osborne was shot about 2 p.m. at the home of James Jones on Dr.
Martin Luther King Jr. Avenue at Gaston Street. Jones said he owned the
pistol but did not know how the girls found it.
Jawanda was taken to the University of South Alabama Medical Center where
she was treated and released, a nursing supervisor said.
The victim's friend, Octavia Benning, was with her when the pistol
discharged, said Wanda Miller, 32, Octavia's mother.
Octavia was taken away in a patrol car but it could not be determined
Wednesday night whether any charges had been filed. The question of which
girl pulled the trigger was not immediately answered.
Officers at the scene were not permitted to talk with reporters.
Police questioned Jones but he was not arrested.
Jones, 44, said he kept his pistol well hidden in a chimney. "I don't have
no idea" how the girls found the revolver, he said.
Vanessa Osborne, the victim's mother, declined comment.
Miller said she and her daughter live with Jones. She described Vanessa
Osborne as a friend who lives on nearby Kennedy Street.
Miller said she was at work at the Checker's Drive In Restaurant on Airport
Boulevard in the Loop area when she was notified of the shooting.
"I know my daughter was supposed to have been at school, but she didn't go
to school today," Miller said. "They were playing with it (pistol), and I
don't know what happened.
"She just called me at work and told me she made a mistake and shot her in
the leg. I'm just happy she's not hurt any worse."

Michael Howard Anderson's mother said she doesn't understand why someone
shot and killed her son Tuesday.
"I don't know what he was doing," Susan Anderson said.
Savannah police say the city's latest homicide was drug-related.
Anderson, 21 -- nicknamed Mike Coolie -- and Steven McRae, 24, were shot
about 3 p.m. at apartments at the 1200 block of east 42nd Street and taken
to Memorial Health University Medical Center.
McRae, who lives in the apartments where the shooting happened, was treated
and released. Anderson died at the hospital Tuesday.
No arrests have been made. Two suspects were seen leaving the scene in a
light blue Monte Carlo. The car was found later on West 42nd Street, police
said.
Anderson didn't have a job, but had spent a few years as a cook at Mary's
Seafood & Steak House on Abercorn Extension, his mother said.
Susan Anderson said relatives will miss his visits, especially his three
children -- ages 5, 3, and 1.
She last saw her son around noon. He came to her house on Seiler Avenue to
change his clothes and drop off her house key while she was leaving on an
errand.
"I told him I will see him when I get back," she said.

Prosecutors try to tie suspect to three murders

Prosecutors argued Wednesday that Carlos Huntley shot and killed three
people in a home during the morning hours of Feb. 8, 1998.
Witnesses for the state testified about discovering the crime scene at
Felicia Caldwell's home on 37th Street and Wessels Avenue.
They said Caldwell, 43, John Ambrose III, 41, Dana Denise Crosby, 31, died
of multiple gunshot wounds, did drugs together and may have died because of
someone else's drug debt.
That someone -- Marion Myer -- said he knew Huntley had argued and
threatened Caldwell in the hours before her death.
And Myer said he had been threatened by Huntley days before the homicides.
"He was ready to shoot me there that day," Myer said.
The defense painted a picture of a shadowy cast of characters, whose
connections with one another were drugs.
"This case is about drugs," said Richard Darden, during his opening remarks.
"In fact, I'd say that everyone involved with this case, with the exception
of Detective Wilkins, was probably a crackhead.
"There is not one shred of direct evidence putting my client in that house,"
he said.
It was a point Assistant District Attorney Melanie Higgins had already made
in Judge James E. Bass Jr.'s Chatham County Superior courtroom.
"All of the evidence in this case has been pieced together and is
circumstantial," she said.
Huntley faces three life sentences if convicted.

Background check revealed substitute's educational transcript, resume were
false, police say.

AUGUSTA -- A substitute teacher from T.W. Josey High School was being held
in the Richmond County jail Tuesday on charges she falsified her resume and
college transcript, something discovered when she applied for a full-time
position, authorities said.
Investigators say Linda Gail Cannon used the transcript of a woman with the
same maiden name, altering the date of birth and social security number to
reflect her own.
Cannon, 49, of the 2500 block of Lincolnton Parkway, Hephzibah, was called
to the Richmond County Board of Education offices Monday and subsequently
arrested, Investigator Newsome said. She was charged with felony giving
false statements and concealing facts within jurisdiction of state or
political subdivision.
She remained in the jail Tuesday under a $4,050 bond, jail officials said.
School officials didn't check the transcript when they hired her as a
substitute, only when she applied for a regular teaching position, sheriff's
Investigator Greg Newsome said. A background check turned up the
discrepancies, he said.
Justin Martin, spokesman for Richmond County schools, said he could not
discuss the case and was unable to provide information Tuesday about when
and where Cannon had worked.
Cannon presented transcripts stating that she received a bachelor's degree
from Langston University in Oklahoma and a master's degree from Tuskegee
University in Alabama, Newsome said. Both colleges did not have records of
Cannon receiving a degree under her personal information, he said.
Cannon has a maiden name of Linda Gail Latimer and was apparently using the
transcript of a woman with a different middle name named Linda Latimer,
Newsome said.

McKinney, dad cited for conduct at polls

The state Elections Board has cited U.S. Rep. Cynthia McKinney and her
outspoken father for their behavior during an Election Day fracas last year
at a DeKalb County polling place.

In a unanimous decision Wednesday, the state board found evidence to send
several allegations against the congresswoman and Billy McKinney, a state
representative, to a hearing before an administrative law judge.
The McKinneys are accused of illegally campaigning at a precinct at
Stoneview Elementary School on Nov. 7, 2000, the day of the presidential
election. The polling place was plagued by long lines and accusations of
irregularities that evening. Exchanges between the McKinneys and poll
officials prompted DeKalb Republicans to file civil charges with the state.
Witnesses told election board members Wednesday that Cynthia McKinney, a
Democrat who represents the 4th District, used a bullhorn to solicit votes
and that her father, an Atlanta Democrat, joined in next to her. Georgia law
prohibits campaigning at or within 150 feet of a polling precinct.
The board found enough evidence also to accuse Billy McKinney of interfering
with official state election duties. Witnesses said they saw the legislator
grab the lapel of a Republican member of the DeKalb Board of Elections
during the dispute at Stoneview.
The woman Billy McKinney allegedly grabbed also filed criminal charges, but
the DeKalb district attorney's office decided not to prosecute the case.
After the incident at the polling place, Cynthia McKinney wrote a letter to
President Bill Clinton demanding an investigation into alleged violations of
the Voting Rights Act. The congresswoman said some voters were turned away
because of long lines and a shortage of punch-card voting booths.
Neither of the McKinneys attended Wednesday's hearing in Atlanta, nor did
they return phone messages seeking comment.
It's not unusual for the Board of Elections to forward a case to a law
judge, but board spokesman Chris Riggall said he can't recall an elections
case involving a member of Congress in at least five years.
"The vast majority of our cases more typically involve local officials," he
said.
The next step is for an administrative law judge to hear evidence in the
case, probably next year. The judge's findings would then go back to the
Board of Elections, where any fines would be imposed. The maximum fine per
proven allegation is $5,000.
The present board of elections is made up of one Republican and four
Democrats. One of the Democrats was not at Wednesday's hearing.
Cynthia and Billy McKinney are no strangers to controversy. Recently, she
took heat for writing a letter to a Saudi prince that criticized New York
Mayor Rudolph Giuliani for turning down a $10 million donation from the
prince for terrorist victims. Giuliani had taken exception to comments the
prince had made about U.S. relations with the Middle East.
In 1991, Cynthia McKinney, then a state legislator, prompted a walkout by
Georgia House members when she questioned the U.S. attack on Iraq. And in
1996, the congresswoman was criticized for not rebuking her father after he
called her Republican election opponent, John Mitnick, a "racist Jew."

Found funds prove to be counterfeit

The crisp bills found packed into foot lockers at a Doraville storage
facility locker looked like a million dollars to police. They also were
counterfeit.
To the U.S. Secret Service, the cache of phony bills is a familiar come-on
in a confidence game known as a "black money scheme," said Agent Gene Sveum.
The scam targets people "naive, or greedy enough, to believe they can get
rich very quick," Sveum said.
The Secret Service was called in after local and state authorities responded
to what was initially thought to be a possible anthrax scare. Doraville
police Col. Clifford Edwards said employees at the Colonial Storage
warehouse reported a "suspicious white substance" around cellophane
containers of what appeared to be U.S. currency piled high inside four foot
lockers.
The powder was quickly determined to be harmless -- possibly talcum
powder -- another telltale mark of the swindle, said Sveum.
The renter's name and other information provided to the storage facility
were as bogus as the bills, he added. The Secret Service, an arm of the
Treasury Department, has taken over the investigation.
Suspects linked to the confidence game are usually nationals from Nigeria
and Senegal, said Sveum. The con artists make photo copies of genuine U.S.
currency -- which is counterfeiting -- that is represented to victims as
money from foreign companies or governments, he said.
"They'll put black dye or some other substance on the bills, say it is a
precaution to prevent stealing. And they'll add talcum powder in with the
wrapped bills to further discourage the victim from looking closely.
"They'll tell him this is real currency, and if the victim will pay for
chemicals to clean up the money, he will get a percentage, say 20 percent of
what they claim is $50 million," added Secret Service Agent Harold Bibb.
Secret Service officials said that across the country losses to the scam
"runs in the six figures."

while seclusion is the cause of torment.
Happy is the person who finds fault with himself
instead of finding fault with others.
From morning until night and from night until morning
keep your heart free from malice towards anyone.
A perfect Muslim is one from whose tongue and hands mankind is safe.
Islam is purity of speech and hospitality.
Every religion has a distinctive virtue
and the distinctive virtue of Islam is modesty.
Greet those whom you know and those whom you don't know.
When asked what was most excellent in a human being, he answered,
"A friendly disposition."
The best of God's servants are those who when seen remind you of God;
and the worst of God's servants are those who spread tales
to do mischief and separate friends, and look for the faults of the
good.
Whoever believes in one God and the Hereafter,
let him speak what is good or remain silent.
He is the best Muslim whose disposition is most liked by his own
family.
Respect the guest and do not inconvenience your neighbors.
The faithful are as one person.
If a man complains of a pain in his head, his whole body complains;
and if his eye complains, his whole body complains.
He is not of us who is not affectionate to the little ones
and does not respect the reputation of the old.
Truly, the farthest seat from me on the day of resurrection will be
the garrulous, those who talk glibly, and those who talk tall.
And who is it that talk tall? The vain-glorious.
God is gentle and loves gentleness.
Inscribed on the prophet's sword:
Forgive him who wrongs you; join him who cuts you off;
do good to him who does evil to you;
and speak the truth even if it be against yourself.
Whoever restrains his anger when he has the power to show it,
God will give him a great reward.
Backbiting is more grievous than adultery,
and God will not forgive the backbiter until the one wronged has
forgiven him.
Keep yourselves far from envy, because it eats up and takes away good
actions
as fire consumes and burns the wood.

May the Mercy and Peace of Almighty God be upon him
This sermon was delivered on the Ninth Day of the month of Dhul-Hijjah
in
the Tenth Year of the Hijrah (i.e. the Prophet's forced migration from
Mecca
to Medina) in the 'Uranah Valley of Arafat, near Mecca.
After praising and thanking Almighty God (Arabic: Allah), the Prophet,
peace
be upon him, said:
"O People lend me an attentive ear, for I know not whether after this
year I
shall ever be amongst you again. Therefore listen to what I am saying
very
carefully and TAKE THESE WORDS TO THOSE WHO COULD NOT BE PRESENT HERE
TODAY.
O People just as you regard this month, this day and this city as
sacred, so
regard the life and property of every Muslim as a sacred trust. Return
the
goods entrusted to you to their rightful owners. Hurt no one so that
no one
may hurt you. Remember that you will indeed meet your LORD, and that
he will
indeed reckon your deeds. ALMIGHTY GOD has forbidden you to take
interest
(Arabic: riba), therefore all financial obligations involving interest
shall
henceforth be waived. Your capital is yours to keep. You will neither
inflict nor suffer any inequity. Almighty God has judged that there
shall be
no interest and that all the interest due to Abbas ibn 'Abd
al-Muttalib (the
Prophet's uncle) be waived. Every right arising out of homicide in
pre-Islamic days is henceforth waived and the first such right that I
waive
is that arising from the murder of Rabiah ibn al- Harithibn.
O men, the unbelievers indulge in tampering with the calendar in order
to
make permissible that which God forbade, and to forbid that which God
has
made permissible. With Almighty God, the months are twelve in number.
Four
of them are holy, three of these are successive and one occurs singly
between the months of Jumada and Shaban.
Beware of Satan, for the safety of your religion. He has lost all hope
of
that he will be able to lead you astray in big things, so beware of
following him in small things.
O People it is true that you have certain rights with regard to your
women,
but they also have right over you. Remember that you have taken them
as your
wives only under God's trust and with His permission. If they abide by
your
rights, then to them belong the right to be fed and clothed in
kindness.
Treat your women well and be kind to them for they are your partners
and
committed helpers. And it is your right that they do not make friends
with
anyone of whom you do not approve, as well as never to be unchaste.
O People, listen to me in ernest, worship ALMIGHTY GOD, say your five
daily
prayers fast during month of Ramadan, and give your wealth in charity
(Arabic: Zakat) and perform Hajj if you can afford to.
All of mankind comes from Adam and Eve. An Arab has no superiority
over a
non-Arab, nor does a non-Arab have any superiority over an Arab; also
a
white has no superiority over a black nor does a black have any
superiority
over a white --- except by piety and good action. Learn that every
Muslim is
a brother to every Muslim and that the Muslims constitute one
brotherhood.
Nothing shall be legitimate to a Muslim which belogs to a fellow
Muslim
unless it was given freely and willingly. Do not therefore do
injustice to
yourselves. Remember one day you will meet Almighty God and answer for
your
deeds. So beware and do not stray from the path of righteousness after
I am
gone.
O People, NO PROPHET OR MESSENGER WILL COME AFTER ME AND NO NEW FAITH
WILL
BE BORN. Reason well, therefore, O People, and understand the words
which I
convey to you. I leave behind me two things: the QUR'AN and my SUNNAH,
and
if you follow these you will never go astray.
All those who listen to me shall pass on my words to others and those
to
others again; and may the last ones understand my words better than
those
who listen to me directly. Be my witness, O GOD, that I have conveyed
Your
message to Your people."
In the name of Allah, The Compassionate, The Merciful
"When Allah created His creation, He did so while completely
independent of their obedience towards Him and of their disobedience
towards Him. No disobedience can hurt Him and no obedience can benefit
Him. Then He distributed among them their means of sustenance and
placed them on earth.
The people of taqwa on earth are those of virtue: their sppech is
correct; their garments are of moderate nature and their walk is one
of humility. They lower their gazes when they see something that Allah
has forbidden them to see and they give an ear to beneficial
knowledge. They maintain their integrity in both adversity and
prosperity.
Had it not been for the appointed time that Allah had written for them
(death), their souls would not remain an extra second in their bodies,
out of yearning for reward and fear of punishment. The Creator ranks
supreme in their eyes, so everything else becomes immaterial to them.
They are with Paradise as if they had already witnessed it and enjoyed
its presence. They are with Hell as if they have already seen it and
tasted its torment. Their hearts grieve, and their evil is
non-contagious. Their bodies are lean, their needs are few and their
souls are chaste.
They observe patience for a few days and experience everlasting
comfort. This is a profitable exchange that their Lord has made
pleasant for them. The world tempts them, but they do not succumb. It
imprisons them, but they ransomed themselves in exchange.
During the nights they stand in rows and read portions of the Quran.
They recite with proper recitation which grieves their hearts, and
drink it like medicine. If a verse of yearning comes along, they reach
for it and believe it is their destination. If an intimidating verse
comes along, they pour their hearts towards it, and believe that Hell
and its screams are in their ears. They sleep on their foreheads and
elbows (the pray so much that they sleep in these positions) and
implore Allah to deliver them.
In the day, they are tolerant and learned, kind and God-fearing. Fear
has chipped away at their bodies, as if they were arrows. Anyone
looking at them would think that they were sick. But they are not
sick. Some will say that they are confused. A great fear has made them
look like that. They are never content to do only a few actions, nor
do they ask for a great deal.
They condemn themselves, and are apprehensive about their deeds. If
one of them is called ‘pious,’ he fears what will be said
of him, and says: "I know myself better than you do. My Lord knows me
better than I do. O Allah! Do not take me to task for what they are
saying about me and make me better than they think. Forgive my sins
which they do not know about."
Their signs are that they are strong in Islam; resolute in their
softness; firm in their belief. They crave for knowledge, and are
knowledgeable with tolerance; moderate in richness; pleasant in
hunger; forbearing in distress; seeking halal; active in (pursuing)
guidance and they abhor greed.
They perform good deeds in fear (of rejection). They spend the evening
in gratitude and the morning in remembrance. They sleep in alarm and
they awake in joy. If their carnal selves make it difficult for them
to fulfil that which they dislike, they deprive themselves of that
which they like. The apple of their eyes is in what does not perish,
and their abstemiousness is in what disappears. They combine knowledge
with tolerance, and speech with action.
You will find that their hopes are realistic, their mistakes few;
their hearts humble, their selves content; their diets meagre, their
matters simple; their Deen safe-guarded, their desires killed and
their anger subdued. Goodness is expected from them, and evil is
shielded against them. If they are among the oblivious, they are
counted amongst those who remember. If they are among those who
remember, they are not wriiten among the oblivious.
They pardon those who wrong them; they provide for those who deprive
them, and meet those who severe ties with them. They are never profane
and always lenient. Their wrong-doings are almost non-existent, and
their good deeds are always present. They are resolute when the earth
quakes, steadfast in calamities and grateful in prosperity.
They are not prejudiced against those they dislike, nor do they favour
those they love. They acknowledge the truth before it appears, and do
not lose anything they are entrusted with. They do not call anyone
names, nor do they hurt their neighbours. They do not curse at the
time of difficulties, nor do they venture into falsehood.
Silence does not bother them, and if they laugh they do not raise
their voices. If they are treated with injustice, they remain patient
until Allah vindicates them. Their own selves live in toil, while
others are comfortable around them.
Their abstinence from those who stay away from them is their
exoneration (from malice). Their proximity to those who are close to
them is a means of mercy (for those who are close to them). Their
remaining aloof is not out of pride and arrogance, and their being
close is neither a ploy nor scheme."
