Please incorporate:
1. The MRTS operator shall be criminally liable for any loss of life and property on the road below over which the right of way is granted, because of the train escaping the tracks overhead losing control and jumping over the road users or property located adjacent to the MRTS tracks.
2. The consultants and designers shall be specifically and severally be held liable for criminal prosecution if the lives of road users are endangered.
3. Necessary undertakings that design features provide for the safety of road users, who are not metro users, enforceable civil and criminal lability gurantees shall be in position and the BOT operator is held directly accountable.
Siddarth, go to the site and send this clause to be incorporated.
