Trojan Mailer in Drupal

Hello I get php scripts that email spam on one of my drupal setups. I delete them but they come back. I upgraded drupal to the latest but the problem continues. Could this be a simple ownership permission problem? The website is drupal 7 the lastes version both core and modules.

access log show only one entry for the file name and host
