As an IDP participant, you must attend all seven weekly classroom sessions. Each session takes 2 to 3 hours for 16 hours total. When you satisfactorily complete the classroom sessions, your involvement in the IDP will end, UNLESS the program refers you for formal assessment and any resulting treatment.
After assessment, you may be required to complete a formal substance abuse treatment program. If you fail to complete required assessment or treatment, you will be dropped from the IDP and your conditional license will be revoked.
At the time of sentencing, the court may issue you a conditional discharge (CD) that requires IDP completion. The DMV will notify the court if you do not enroll in the program, or are dropped from it. The court then may call you in for re-sentencing.
After enrollment, you also must pay a fee directly to the program that will conduct your IDP classes. The maximum IDP enrollment fee is $233, payable to the program you attend. Payment is expected when you attend the first class. There will be additional fees if you transfer to another IDP or apply to re-enter a program you have been dropped from.
Participation in the Impaired Driver Program is available on a voluntary basis if you have been convicted of an alcohol or drug related driving violation, unless you have participated in the program within the last 5 years, or have been convicted of another alcohol or drug violation within 5 years of the current alcohol or drug violation. However, these limitations do not restrict the ability of the court to mandate participation, even if you have already attended an Impaired Driver Program within the previous 5 years. In such situations, participation will be required, yet you will not be eligible for a conditional license or privilege.
Impaired driving offenders in New York State may be required to undergo a screening to identify risk factors for a substance use disorder either as part of the New York State Department of Motor Vehicles (DMV) Impaired Driver Program (IDP) or by court order. After completing a screening, Individuals found to be at risk for developing a substance use disorder are referred for a comprehensive clinical assessment. New York State residents who are referred for an assessment, must choose an OASAS-approved provider. Based on your assessment, completion of a substance use disorder treatment program may be required by the DMV.

You may be eligible for full non-Commercial Driver License (non-CDL) driving privileges after you complete the Impaired Driver Program (IDP) (previously known as Drinking Driving Program or DDP), all recommended formal evaluations, and any required treatment. Your Commercial Driver License (CDL) or commercial driving privileges will remain suspended or revoked until the end of the CDL suspension or revocation. After the end of the CDL suspension or revocation, you must go to a state or county motor vehicle office to apply for restoration of your CDL or commercial driving privileges.
When the DMV computer system gets updated with your DW conviction (typically takes 12-14 business days after sentencing in the court in our area of upstate NY), you will have to physically go to the DMV to change your PCCL to a PRCL.

This issue is complicated because this is the feeling of some DMVs around the state, but the DMV website claims that the program is VOLUNTARY. It's a difficult issue to navigate because sometimes when people are "supposed" to do something, they don't follow the rules.

If you disapprove of your assessment findings you may pursue a second professional but cannot challenge this subsequent assessment. In order to obtain a conditional license while suspended or revoked (or conditional driving privilege for those residing out-of-state), a driver must take the Drinking Driver Program. For those who are put on probation, they cannot take the DDP without written permission of the court or their probation officer. The New York State Impaired Driver Program is an educational and rehabilitative program designed for motorists who have been convicted of alcohol and other drug-related driving offenses. This program is voluntary, although a judge may convict and impose a conditional/rehabilitative model consisting of a minimum of sixteen hours of classroom activity. This seven week course (16 hours) focuses on alcohol education, decision making and traffic safety, with the goal of fostering behavior changes which will result in reduction of repeated drinking and driving. Participants are also screened for substance abuse problems and referred for evaluation and treatment, if necessary.
Eligibility to participate in the program is determined by the Department of Motor Vehicles. If a motorist chooses not to participate, they will not eligible again for the program or a conditional license for the next five years. Upon completion of the program, rehabilitation and treatment (if indicated) and any other restrictions as determined by DMV, full driving privileges may be returned. Most drivers who attend the IDP classes are granted limited driving privileges through a Conditional License until their full licenses are restored.
The current cost of the program is $234.00 which includes the educational component, workbooks and other materials. Payment is due prior to the beginning of the first class and must be in the form of a money order or certified check.
After my alcohol related conviction am I eligible for Conditional License?
In order to become eligible for a conditional license, with one exception, you must first be convicted of an alcohol related operating offense. You must then enroll in the New York State DMV Drinking Driver Program (DDP). If you enroll and continue to participate in a DDP program, including any additional treatment mandated by the program, you will receive and continue to enjoy the conditional license.
According the NYS Department of Motor Vehicles, the Drinking Driver Program helps the participants examine the arrest experience and the reason for their arrest. It also helps them learn to make appropriate driving decisions for the future. During the DDP introductory session, participants are asked to consider the reasons and goals of the program, and its requirements for completion. Under the guidance of the director and staff, the participants discuss the social, medical, legal, and driver safety problems caused by alcohol and other drug abuse. The program includes classroom education, screening, and evaluation and treatment if warranted.

When you enroll in the DDP you must pay the DMV a nonrefundable fee of $75. After enrollment, you also must pay a fee directly to the agency that will conduct your DDP classes. The maximum DDP enrollment fee is $225, payable to the program you attend. Most programs charge a $175 fee.
