 have taken a deposit of usd 85,000 from Chrts Nusantara Garuda
Service,
Jkt for
 the purpose of securing the first of four vessels in the
contract
signed in May 2009
 for carriage of 50,000 mt nickel ore Indonesia / China.

James have given excuses after excuses for the delays which caused
Chrts
shippers, consignees and all concerned undue stress and damages both
direct
and indirect.
James asked Chrts to give Owrs 30 more days for Owrs to fulfill
their
contractual
obligation to the contract in 2009. That was on 3rd March 2010. Now
James still
promises as can be seen in his email as appended below.

This confirms receipt of msg received from charterers .

Owners have just returned to work today Tuesday which is the same day
as we did after taking time for Easter .

Wishing you all the best .

Have discussed the situation with owners today and have requested the
situation be resolved one way or another as already mentioned in
earlier msgs.

Owners will have have 2 vessels during the month of April.
One of 49,000 dwat grbr , and one of 41,000 dwat description we shall
receive over night and shall pass to you still within wednesday
charterers time.

The freight rate as per market levels that all parties are aware of
are usd 18/19.00 per mt , for Coal/Nickel ore
Humidity content never to exceed 1% for nickel ore, master will refuse
loading otherwise

We are brokers and have always made it clear that this is what we are.
We have nothing to gain promoting the owners returning or n ot
returning advance payment received and we are working for nothing if
all is settled by a simple refund.

So please follow our thinking and try to understand / sympathize with
our position

If one vessel of the 4 vessels coa originally agreed is performed
then charterers will deduct usd 80, 000 advance payment .
Owners stated today that they wish to perform all 4 voyages as
originally agreed , naturally the laydays and cargo rotations will be
adjusted to reflect the changes agreed.

On the basis that 4 vessel/voyages are performed advance deductions
will reflect the scope of coa , i.e. ,25% deduction of usd 80,000 per
voyage.

Trust the above will be acceptable to charterers .

We shall provide during wednesday vsl details which trust will meet
with charterers approval

Please confirm charterers agreement
