FYI, in looking over the Conservation Restriction on file for the Shelton Cove “Riparian Management Area”: This is not a conservation easement like we normally have. The permission/enforcement mechanism is first via the homeowner’s association and then:
“Additionally, the City of Shelton Inland Wetland Commission and the City of Shelton Planning & Zoning Commission shall have the right, but, not the obligation to enforce the Conservation Restriction…” (Nowhere in the document is there a reference to either Conservation or the Board of Aldermen).
Also:
“Except as reserved herein, there shall be no cutting of trees or plants, spraying with pesticides or insecticides, disturbance or change in the natural habitat, with the exception of the removal of dead trees, without the express written consent of the Shelton Planning & Zoning Commission Agent or Inland Wetlands Commission Agent.” My understanding is that Ron Baia at IWC already signed off on the project.
I am more than happy to point out any good native plants they should try and save and give some guidance on how to handle the invasives I’m sure are a problem. Just be aware that, under the document that was filed in the land records, neither the Conservation Commission nor the Board of Aldermen appear to have any enforcement or review authority. -Teresa

The Shelton Cove HOA (560 River Road) wants to trim trees and cut vegetation along their property, especially along the Housatonic River. The Shelton BOA has requested the Conservation Commission to review the plan and comment on their plan. Teresa and I will meet with Nancy Motyka at Shelton Cove to review their plan. All Commision members and others are welcome to join us at 11:00 am tomorrow (Tuesday). We will meet at the mailboxes for the community. The results will be discussed at Wednesday's meeting and a second site review may be scheduled.
