Have I been conned?

Hi All,

I've cross posted this to 4 groups.

I need some help.

Scots Law Question.

On 30th July this year, I had a second-hand engine fitted to my car.
I only went for it as the garage owner said "It's the best engine I've
come across in years, I can guarantee it is in perfect condition."
The garage is a Rover specialist and has been in business for just
over 30 years.

I paid £550.00 fitted.

In the 8 weeks I've had it I've done around 4,000 miles and changed
the engine oil 3 times.

I've had it back 4 times with what appeared to be a sticking hydraulic
lifter. Most of the time it was OK, it just knocked occasionally. It
had been good for 5 weeks up until yesterday when it started knocking
very badly then the engine just stopped, no warning no misfire it just
stopped, the car will not run now. I tried to contact the guy who
fitted it but he was unavailable.

What I need to know is, do I have any comeback or am I stuffed with a
shit engine.

I don't know the legal situation - but NEVER buy a 2nd hand engine without a
guarantee.

Is the garage a member of a trade Association like Scottish Motor
Trades Ass'n (If they still exist ) -if so contact them or trading

Go to your/his local Trading Standards/Consumer Protection Officer at your
local council. If you paid with a credit card, you should also inform
your CC company, as they will have joint liability with the trader. Make
sure you preserve any written documentation, especially if any description
as to condition of the engine is on it. If the trader is a Rover franchise
then Rover may also want to know; if not, they may still take an interest
if the trader is using their name or trade mark in a way which suggests
any approval by them. Any evidence (adverts etc) of a claim to be a "Rover
specialist" should also be preserved as a trader claiming to be such when
they aren't often finds it to be the noose which hangs them in court.

I think you should contact the Guinness Book of Records, as the
condition you describe ("stuffed with a shit engine") sounds as if it
would be anatomically impossible.

Hi,

Thanks everyone for your help.

I threatened the guy with Trading Standards and The Sunday Post.

He's currently re-building my engine at no cost to me, except for the
oil (I only use synthetic), all in all a good outcome.
