Someone makes statements against an organisation that the organisation
claims is defamatory.
The organisation decides to take this person to court for defamation.
Two of the witnesses are the female CEO of the organisation and a male
described as an "independent expert witness".
Some days before the hearing the defendant receives a phone call from
a woman, who refuses to give her name, saying that the independent
witness is not as "independent" as he might seem. He has left his
wife and is "co-habiting" with the CEO of the organisation.
During the subsequent hearing the defendant, who is representing
himself, asks the expert witness under oath if his home address, which
he has given to the court, is the only address at which he stays. He
replies "yes".
The organisation wins the case against the defendant.
This is then reported to the police, complete with the court
transcript. They decide to take no action as they say it might not
have affected the outcome of the case.
However, if the expert witness was lying under oath in the dock, would
this not amount to perjury?
