USNA Nigger wiggles out of Rape Charge

WASHINGTON -- A military jury yesterday acquitted former Navy
quarterback Lamar S. Owens Jr. of rape, but found him guilty of two
lesser charges.
The trial judge this morning denied a defense request to throw out
those two charges - conduct unbecoming an officer and violating an
order to stay away from his accuser.
The judge, Cmdr. John Maksym, said Midshipman Owens engaged in
"disgraceful conduct" when he entered a younger midshipman's
dormitory room in January to have sex with her.
"Navy officers are held to a higher standard," Cmdr. Maksym said.
But the judge also differed with the prosecution on how long a
sentence he would consider.
Prosecutors asked for the maximum 21/2 years, but Cmdr. Maksym said
his interpretation of the guidelines calls for no more than 11/2
years.
The sentencing hearing continued this morning as The Capital went to
press.
Last night, defense attorneys said they were breathing a lot easier
after the four-man, one-woman jury cleared Midshipman Owens of the
rape charge.
"We are enormously relieved - the rape charge carries up to a life
sentence," said defense attorney Reid Weingarten.
The jury deliberated about 91/2 hours before delivering its verdict
at 7:30 p.m.
A Navy JAG officer in Washington, who asked not to be named, said
Midshipman Owens likely would serve any incarceration in a brig in
Charleston, S.C., the closest prison that houses officers.
Midshipman Owens stood at perfect attention in his crisp white
uniform and looked straight ahead while the jury foreman delivered
the verdict.
His family sat behind him with tears in their eyes. After the
courtroom emptied, his father stood alone, looking toward the front
of the room.
The accuser and her family, who have attended much of the trial that
began on July 10, were not in the courtroom when the verdict was read.
Prosecutors and a Naval Academy spokesman declined to discuss the
case.
The jury consisted of officers assigned to the Naval Academy. Four of
the five graduated from the school.
Midshipman Owens was charged with entering the woman's room in
Bancroft Hall in the early hours of Sunday, Jan. 29, and raping her.
He testified she sent him an instant message inviting him to her
room, and she consented to sexual intercourse.
Midshipman Owens and his accuser testified the sex act lasted only
about 2 minutes, because the woman passed out or went to sleep. At
that point, Midshipman Owens left her and went back to his room.
Witnesses, including the accuser, said she had engaged in underage
binge drinking at Acme Bar and Grill a few hours before the incident.
Witnesses also testified the accuser had a history of binge drinking,
followed by blackouts where she would continue to function, but have
no memory of her actions.
One woman who attended nearly every day of the trial as a spectator,
Washington resident Arlena Chaney, a teacher at Bolling Air Force
Base, said she was stunned by the findings of guilt.
"I just can't see how you could not convict (on rape) and convict on
(conduct unbecoming an officer)," she said.
The jurors began deliberating at about 9:50 a.m. yesterday and seemed
to struggle through the day with the conduct unbecoming an officer
charge. The count stated Midshipman Owens did "wrongfully enter the
room ... without permission and wrongfully engage in sexual conduct."
At 12:45 p.m., the jury sent Cmdr. Maksym a note, asking how broadly
they could interpret "without permission." Cmdr. Maksym said it was a
term of art with a specific meaning. Also, the government claimed two
wrongful acts, he said - entering the room and wrongful sexual
intercourse - and had to prove both elements for there to be a
conviction.
"That is the horse the government rode in on, that is the horse they
have to take into the stable," Cmdr. Maksym said. "As Christ said to
Peter, he who lives by the sword dies by the sword."
At 4:35 p.m., the jury again asked about the conduct charge,
indicating it was having trouble understanding if it was to convict
based on wrongful sexual activity, or wrongfully entering the room.
Mr. Weingarten argued during trial that midshipmen may visit each
other's rooms regardless of gender. Certain procedures must be
followed during these visits, such as knocking before entering, and
leaving the door open.
No one testified Midshipman Owens violated those requirements when he
went into the room, Mr. Weingarten said.
Prosecutor Cmdr. David Wilson disagreed, saying it was clear the jury
thought Midshipman Owens didn't announce himself before he entered
the room.
Cmdr. Maksym has said he considers the third charge, that Midshipman
Owens violated an order to stay away from the alleged victim, as
frivolous.
He said the order was meant to keep Midshipman Owens from harassing
or harming the woman.
Prosecutors brought the charge after Midshipman Owens walked by the
woman's room once. The defense said it was an accident.
Midshipman Owens' attorney, Mr. Weingarten, is from the firm of
Steptoe & Johnson, and has represented such prominent clients at Tyco
International's Mark Belnick.
Mr. Weingarten said John E. Nolan, a senior partner in the firm and a
1950 Naval Academy graduate, brought the case to his attention.
"He represented to me there may be an injustice going on at the Naval
Academy," Mr. Weingarten said. "I met Lamar, and concluded that he is
a wonderful kid." Citing attorney-client relations, Mr. Weingarten
declined to say if his firm was representing Midshipman Owens at a
reduced fee.
