Mr. Suresh Gogia

MD, Ascent Buildtech Private Limited

Noida, Uttar Pradesh

Dear Mr. Gogia:

As you are aware, the Electricity Consumer Grievance Redressal Forum (Meerut) has passed an order dated January 19, 2016, under which electricity and maintenance charges cannot be clubbed and collected from residents in advance through prepaid meters.  This means that prepaid meters can be used only for electricity consumption charges; separate arrangement needs to be made for collecting maintenance charges because the latter are governed by section 22 of the UP Apartment Act. This decision came in a case filed on behalf of ghaziabad4u against Express Garden Residents Welfare Association, Express Projects Pvt. Ltd., and PVVNL.

Taking this order into account, Ascent needs to immediately stop collecting maintenance charges through the pre-paid meter. In the event, the above mentioned order is not complied with immediately, we would be compelled to approach the CGRF (Meerut) after a period of 7 days.
