Any idea on heavy maintenance charged while giving possession in Tower A in Satya ville de

Hi,

Just wanted to raise the high maintenance charged by Ascent builder while giving possession, any idea whether anybody has raised\opposed on this issue.

However i have met them in their office and mailed the concern on mail to pr@ascentlimited.com . Also they unnecessarily charged interest on me :( I have told them no way i am going to give interest and will go to court for this.

Let me know if anybody else too faced the same issue.

Did any of the owner of Tower B2 received any further demand note after 15% payment ?

not so far. Even the way they raise demand is very un-professional. they called you and want to submit in a week's time.
 
they are not raising demands through written letters and , last time i went and forced them to write a letter for demand and then receipt.
 
Please let us know , in case you need any co-operation from our side.
 
Maintenance is way beyond high ,We should speak to them ASAP.

In latest, I talked to them and waived most of the interest charged (from around 5lac to 15k). Where in for my 1526 flat they charged me following maintenance charges for 2 years:

58598 - maintenance (This is pure maintenance for cleaning, security, sweeper etc...)
15600 - sinking fund (this say is for any emergency maintenance if not used will be transferred to association later)
18000 - backup for common area
35000 - electric meter charges (they say govt didn't provided connection yet from main road till inside, so had to do it on their own so are charging this )

I tried convincing them that they should charge it monthly then instead charging for straight 2 years. but they are not listening, for now they said provide the check and it will be in cashed once i get the key and will start charging. But my concern is they should start charging or deducting maintenance once they have provided possession to all flats in tower A. for now they have provided only to low floor flats say till 3rd or 4th floor.

Dont know how to proceed further :(  People should gather as one and should talk to them.

Hi,

Just wanted to give people latest update of my story so that people can be more aware and cautious and don't do mistakes I did:

After i was charged high maintenance and Interest of around 5 lac on me. I fought them and they finally offered last offer of interest of 15k on me. I got greedy to get possession soon as MY flat is A210 and did the mistake of paying all dues. But this was the beginning of issues.

I paid my dues in Feb 2st week and yet they are just delaying to give NOC to me. 

I also got to know that KDP has falsely mentioned a claws in possession letter, where you can use any service in KDP though builder only means e.g any person has TATA SKY and he want to transfer it to KDP while shifting to his flat, HE CAN"T, believe me he cant even going legal cause the if builder has tie up with reliance digital, you have no other option then to buy Reliance to watch TV inside KDP.

I got scared so I asked them a copy of all clauses of registry and Possession etc so that i can go through them to see if any deadly clause before signing it. As it is time taking process to read and understand all of them, so i asked my father to review all of them. Her is what the scary output came out which i didn't know. I am only mentioning few example clauses are as follows out of the reviewed one:

1. The KDP issue with any service to be taken through builder is also mentioned in our Ascent builder clauses.
2. They are saying in parking clauses that we will not be owner of our parking space and just will be the usage person of it. Builder can anytime build something on it and shift our parking to other place. They actually built 2 extra shops in common area already.
3. You\flat owner are not eligible to ask for detailed or any info on maintenance expenditures later and builder will not provide any.

I wanted to write more scary clauses but i am only writing which i remember now as my father is already gone to bed. 

My Father has already told me to mail builder all this issue and if required go to legal in group with other flat owner so that it makes large effect on builder.

Please come forward to this, else everybody will suffer. I think gather as much flat owner in satya ville as you can and provide this information to them.

B2 demand received and service tax is asked for full amount , but last time it was only on the amount you pay as installment.
anyone notices and rectified.

Yes it was charged for initial amount only but final settlement they included all for Tower A too. One more new thing I came to know is that they are claiming Swimming pool maintenance is other than the maintenance charge they are charging for 2 years after possession.

They have charged service tax on total amount but I have already paid amount on 15% and they have not calculated that.
I let them rectify this and now they are revising the demand.
They never let us know the last date or any time frame to pay.
I find it little un-professional.

I have consulted to a Real State field Lawyer and given him all documents to review. Request to All Flat owners to unite, else as a single fighting would be tough. if you have any query  to be clarified by lawyer, let me know if I can get answer.

I have taken NOC from them and FLat is ready for Posession and Registry but I have denied registration for now. I have faced same issue as by everybody else e.g. interest charged, possession delayed, building/Flat poor quality, Built up area, Common area within super area not defined, no proof/blueprint provided for society to people while registration, Clauses in all agreement (sale deed, parking, maintenance, registry) are like we are defined to be beggar in it. They had promised me wallpapers while booking but now denying the same.

For now I am trying to review all agreements (sample taken by a person who is already registered in Tower A) and given a copy to Lawyer to verify all clauses so that in future we will face lesser issue.

We need to create RWA ASAP and need to handover form builder to face lesser issue.
