We strongly condemn below mentioned dual standard operation of the prevailing management committee at that time, for the reasons known to them & same brought to notice of the general body in AGM in past, as pointed out now by our office-bearer in the appended message:

For example, plot no: 33: NOC for transfer of plot was issued to Mr. Tyagi by MC in Apr 2016, without a member clearing his dues, as the buyer of the plot was an office-bearer of the society (Dr. Garain). 
This NOC is attached for B's reference. Furthermore, note that the sale agreement for plot no. 33 was executed in March 2019.
 
Furthermore, we put this on record as the other members desiring to sell plots were not issued NOC by the same  MC at that time, even after the seller member clearing his pending dues to the society.

Kindly note that our request for transfer of share & interest of plot no. 45, purchased by us from our past member Mr. Deshpande is still pending (since 2013 ~ 14), even after compliance to the advised matter by the prevailing MC at that time, as necessary. This was repeatedly brought to notice general body during AGM / special GM in past.
 
In view of the above, we again intend to submit a detailed request for the same soon.
 
We request the managing committee & general body to expedite the matter soon.

Dear All.                                                                                                                                                                                                                                Good day,

Kindly note that the hard copy of maintenance bills for the subject periods (2019 – 20 & 2020 – 21), were sent to you, in the last week, by speed post / courier on your registered address with the society. In case, if you have not received a hard copy of the maintenance bill, then kindly send your present details of correspondence address, e-mail ID & contact number, so as to enable us to update society’s records and also facilitate future correspondence with you all.

For the society’s general body awareness of individual member’s outstanding maintenance dues & to have some idea related present financial health of the society, attached kindly find all the society member’s bills, as generated on 1st Apr 2019 & 1st Apr 2020 (for financial years 2019 ~ 20 & 2020 ~ 21), for your perusal and kind understanding. Attached also please find all member’s ledger financial years 2017 ~ 2018 & 2018 ~ 2019, showing maintenance charges, payment received, interest charged etc.etc.  Please note these are attached for member’s reference and cross checking only.

Furthermore, kindly be advised that the base of the individual member’s attached ledger, was the accounts data provided by society’s past treasurer Dr. Garain to our Ex-chairman Mr. Nageshwar Rao, in chair at that time. This data was then given to our society’s accountant, as necessary for maintaining accounts.

We sincerely request all the society general body, to go through all the attached maintenance bills (besides your bill) and review them carefully so as to clarify their doubts, prior to raising any query / concern related to the subject matter. In addition, this exercise will also definitely help to understand some aspect related to financial health of the society, which presently is utmost necessary for the satisfactory running of our good co-operative housing society.

Furthermore, in view of queries / concerns, as now received from few members related to subject matter, kindly make a special note of the following:

1)      These queries are mainly related e-payments, where either name of the sender is not matching with any of our members, or plot no. not mentioned on this e-transfer or etc. etc.  For your information, there is no query where the payment was done by cheque mentioning all the necessary details. It is  observed that Cheque payment makes accounting easier and no suspense account of payment received.

 

2)      Kindly be advised that the queries related to payment done by members, in the subject period and is not being in reflected in the bill / ledger should be sent in writing to the secretary & must be accompanied with payment details & corresponding bank statement / passbook copy, for cross verification purpose. On behalf of management committee, we shall take care of queries on its merit basis, as deemed necessary & further decided by the managing committee' if necessary. The outcome of the query will be sent to the concerned member in due course, as early as practically feasible.

 

3)      Due to prevailing COVID 19 situation, there was unavoidable delay in generation of said bills. We regret this delay and sorry for the inconvenience caused, if any.

 

4)      Almost all the queries put forward by members towards “PREVIOUS GENERATED  MAINTENANCE BILL FOR YEAR 2018 – 19”, was addressed by us. Thus we hope that the members, those who did not pay their of old / previous outstanding dues fully, were at least agreeing to & are well aware of their previous outstanding amount due to the society. By this time, it was expected that such good members should have cleared their outstanding dues, to avoid interest on the old outstanding payment.

 

5)      Please note that we did not ask members, to pay any maintenance charges for financial years 2019 ~ 2020 & 2020 ~ 2021, earlier.

 

6)      As per society’s accountant, we need to raise maintenance bill of at least Rs. 1/- from the society members for the last 2 financial years, which was utmost necessary for calculating interest on the pending dues, for that financial year 2019 ~ 2020 and also for subsequent years to come.

 

7)      In view of the above, we have now raised maintenance bill of Rs. 1/- each, for the last 2 financial year 2019 ~ 2020 & 2020 ~ 2021.

 

8)      REGARDING NEW MEMBERS WHO HAVE PURCHASED & TRANSFERRED PLOTS IN OUR SOCIETY:

a)      Please note that, it was observed that the bills were still being generated in the names of old member, due to improper up-keeping of society’s files & not updating of the related records, as necessary.

        

        For example, plot no: 40This plot was transferred in year 2013 by Mr. Hawaldar to Mrs. & Dr. Garain. 

        Refer this member’s ledger for F.Y. 2018 ~ 19, the name of Mr. Hawaldar was still being reflected instead of Mrs. / Dr. Garain. To ensure that the 

        generated bills reach timely to present plot owners, we have taken necessary corrective steps, if known, so as to reduce total member’s 

       outstanding dues to the society.

 

b)      Kindly note that in case of transfer of rights & property of society plot and especially if incase NOC was issued by the society, very well in advance (say more than 12 months – annual billing cycle) and member desiring to sale plot has not cleared his dues, it is responsibility of the buyer to confirm with the buyer / society, whether the seller has cleared all the pending dues with the society, prior executing sale agreement by buyer & seller, towards compliance of the NOC, as issued by the society.   In case of  any ambiguity arising of such payment already done by the outgoing member but is not reflecting in society’s record, the buyer member needs to procure the payment details & corresponding bank statement / passbook copy from seller member and furnish the same to the society, for cross verification purpose. Failure to do so, then buyer will be fully and solely responsible to pay all the outstanding dues of the seller with the society, as was made applicable for the previous incoming members in the past.

 

        For example, plot no: 33: NOC for transfer of plot was issued to Mr.

9)      Furthermore kindly note that the last date of making payment of old (previous) outstanding dues is kept as 31st March 2021, for accounting purpose and towards preparation of balance sheet for the financial year 2020 ~ 2021We hope the above clarification is very much sufficient for kind understanding of the concerned members. Furthermore, we sincerely appreciate and thank members, those who are paying their bills very regularly and timely. This is presently helping the society, to take care of routine expenses. These members have got outstanding bill of Rs. 2 / - only. For such members & for ease in accounting, we suggest it is not necessary to pay such small pending bill of Rs. 2 / - presently.

10)    At the same time, we on behalf of the management committee, sincerely request all the members to pay their outstanding dues prior 31st March 2021 and pay society’s maintenance bills timely to avoid future penalties / action as deemed necessary, towards compliance of CHS bylaws, which is utmost necessary for satisfactory running of co-operative society.

 

11)   Kindly note that due to COVID situation in Mumbai / Navi Mumbai & around, presently we are facing difficulty to conduct management committee meeting & so also pending AGM for the last year, very much necessary to take timely decisions on few important pending matters.

In addition point no. 8, for clear understanding of the society’s general body & timely action from us, we also request, kindly posting accounts related queries along with copy of payment evidence attached as necessary, on society’s google group, keeping Chairperson / Secretary in CC on following e-mail ID’s varshaw...@gmail.com & govar...@gmail.com respectively. As requested by few members, we intend to send this message to all the member's on their registered e-mail ID.

Lastly we sincerely thank our general body for their kind understanding of the prevailing COVID 19 conditions & appreciate timely support given by all from time to time, as necessary.

As pointed out by Mrs. Suvarna D. Wathodkar / Dhananjay V. Wathodkar (Plot no. 36, 37 & 45), we also fully agree with their comment of dual standard operation of the prevailing management committee at that time in issuing NOC without asking members to pay his outstanding dues, for the reasons known to them. Other members were always asked to pay maintenance dues but  sometimes even after paying dues, NOC was not issued to them. Example: Plot no. 42 & 45, Mr. Deshpande. (around Mar ~ Apr 2014)
 
Kindly note that our request for transfer of share & interest of plot no. 42, purchased by us from our past member Mr. Deshpande is still pending (since 2014), even after compliance to the advised matter by the prevailing MC at that time, as necessary. This was repeatedly brought to notice  to the general body during AGM / special GM in the past.

 
In view of the above, we again intend to submit a detailed request for the same soon.
