We wanted to share with you an analytical note we have drafted on the recently adopted CEDAW General Recommendation on Rural Women. We hope this analysis can be useful to your advocacy efforts.

 

For now it is only in English and Spanish, but we hope it’ll soon be ready in French as well. Please feel free to disseminate it widely and let us know if you have any comments.

Rights of rural women finally addressed in General Recommendation No.34

Welcoming the adoption of the first international instrument to address the rights of rural women, FIAN International examines the core elements related to the human right to food and nutrition contained in the General Recommendation No. 34.

In March 2016, the Committee on the Elimination of All Forms of Discrimination against Women (CEDAW) adopted its General Recommendation No. 34 on the Rights of Rural Women. Its adoption is nothing less than the outcome of over three years of work by the Committee with support from civil society and social movements. 

The General Recommendation is particularly significant because it is the first international instrument that specifically addresses the rights of rural women. Furthermore, it is the first that explicitly recognizes the human right to adequate food and nutrition of rural women within the framework of food sovereignty. 

The adoption of this General Recommendation will continue helping raise the visibility of rural women’s human rights on the checklist of issues that the State parties must pay attention to when reporting to the Committee. In turn, it will enable civil society to hold their respective governments accountable for the human rights violations of rural women. This General Recommendation can also play a key role in informing and serving as a basis for upcoming and developing processes at the national, regional and global level.

On this note, FIAN International issues an analytical note that examines the elements related to the human right to food and nutrition that are contained in the General Recommendation. More specifically, the note focuses on: (1) the explicit recognition of the right to food and nutrition within the food sovereignty framework; (2) the recognition of the right to access, control, manage and own all natural and productive resources on which rural women depend; (3) the guarantee of decent work for all rural women workers, including access to social protection; (4) the recognition of the “intertwined subjectivities” of woman and child during pregnancy, childbirth, and breastfeeding and their framing through the lens of women’s rights throughout their lifespan; and (5) the protection of rural women’s roles in the production, processing, distribution, market access, trade, and investment related to the food systems from private actors.

Los derechos de la mujer rural son abordados en la Recomendación General No. 34

Acogiendo la aprobación del primer instrumento internacional que aborda los derechos de la mujer rural, FIAN Internacional examina los elementos relacionados con el derecho humano a la alimentación y la nutrición reflejados en la Recomendación General No. 34.

En Marzo del 2016, el Comité para la Eliminación de la Discriminación contra la Mujer adoptó su Recomendación General No. 34 sobre los derechos de las mujeres rurales. Su adopción no es nada menos que el resultado de     más de tres años de trabajo del Comité con el apoyo de la sociedad civil y movimientos sociales

La Recomendación General No.34 es especialmente importante ya que es el primer instrumento internacional que trata de los derechos de las mujeres rurales y, además, el primero que reconoce el derecho humano a la alimentación adecuada y a la nutrición de las mujeres rurales en el marco de la soberanía alimentaria. Esta seguirá ayudando a mejorar la visibilidad de los derechos humanos de las mujeres rurales en la lista de los asuntos a los que los Estados Partes deben prestar atención cuando entregan sus informes al Comité y por lo tanto permitirá a la sociedad civil pedir cuentas a sus gobiernos respectivos. Además, también puede desempeñar un papel clave en informar y servir como base para diferentes procesos a nivel nacional, regional y global.

En este respecto, FIAN Internacional publica una nota analítica que analiza los elementos relacionados con el derecho humano a la alimentación y a la nutrición que figuran en la Recomendación General.  Más específicamente, la nota se centra en: (1) el reconocimiento explícito del derecho a la alimentación y a la nutrición en el marco de la soberanía alimentaria; (2) el reconocimiento del derecho de acceder a, controlar, gestionar y poseer todos los recursos naturales y productivos de los cuales las mujeres rurales dependen; (3) la garantía de un trabajo decente para todas las trabajadoras rurales, incluido el acceso a la protección social; (4) el reconocimiento de las “subjetividades interrelacionadas” de la mujer y de sus hijas e hijos durante el embarazo, el parto y la lactancia dentro de un marco basado en los derechos de las mujeres durante todo su ciclo de vida; y (5) la protección para las mujeres rurales  en los papeles que desempeñan en la producción, el procesamiento, el acceso al mercado, el comercio y la inversión relacionados con los sistemas alimentarios contra los actores privados.
