We are responding to the ACS email of May 8, 2026 regarding Proof of Age Audit, signed by Cristina Smith on behalf of the Summit at Saddlebrook community.  The letter in that email is attached.
 
In 2024, we complied with Saddlebrook's HOA Board requirements, and provided proof of age to Heather Kloer.  Verification was provided to her in the form of a signed Certificate of Occupancy, a signed Age Audit Affidavit, and a Georgia Drivers License.  We have been assured that all the records collected at that time are now in the secured facility at ACS.
 
Linked below is the Code of Federal Regulations, Title 24, Subtitle B, Chapter I, Part 100, Subpart E, Section 100.307, updated as of June 6, 2016.  Under (g)(2) of that Section, it states --- 
 
(g) "If the occupants of a particular dwelling unit refuse to comply with the age verification procedures, the housing facility or community may, if it has sufficient evidence, consider the unit to be occupied by at least one person 55 years of age or older. Such evidence may include:
(2) Prior forms or applications

Consequently, there is no need under the current law to repeat the stipulation of the Board for a picture ID, or any other signed forms or affidavits.  The Board has the records it needs for our occupancy to comply with any age audit by the government.

The rule also says:

The procedures described in paragraph (b) of this section must provide for regular updates, through surveys or other means, of the initial information supplied by the occupants of the housing facility or community. Such updates must take place at least once every two years. A survey may include information regarding whether any units are occupied by persons described in paragraphs (e)(1), (e)(3), and (e)(4) of § 100.305.

The law (Title 24, Subtitle B, Chapter I, Part 100, Subpart E, Section 100.307) provides for the homeowner to submit a signed survey, certification, or affidavit to satisfy the biennial age updates.  As stated in our initial email, it also provides for refusal on the part of the homeowner, if the community has sufficient evidence from prior forms. 
 
However, the law does not allow the Board to compel homeowners to transmit PII for age updates, especially via such an insecure method as the Board has required, I.e., unencrypted email.
