Re – Difficulties faced by Persons with Disabilities in Registration of Scooter with Side-Car/Wheels

 

Sir, pardon but I am sure keeping your reputation of task master & implementor of out of box ideas, you will definitely take interest in resolving trouble & harm being done to Persons with Disabilities (PwD) by your Department / Ministry from 2002. Just in brief; prior to 2002, the modified / altered vehicles (like scooter with sidecar or side wheels) were registered by RTO after proper inspection / examination & trial by RTO inspector of such vehicle & user possessing medical fitness certificate to drive 3 or 4 wheeled hand operated vehicles & things were going well & smooth. In 2002 M.V. Act’s Sec. 52 about alteration of vehicles was amended & thus Ministry prevented / stopped registration of vehicles used by PwD though same M.V. Act allowed registration of Invalid Carriage on par with past practice.

 

Sir, realising the problems, sufferers like me & other PwD started representing & chasing Ministry but in vain. This draconian decision affected only very small percentage of population & remained ignored by Govt. as well as TRP chasing media. But, slowly developing pressure of individual user PwD & State Govts., Joint Secretary in your Dept. initiated some action in 2007. On 2/5/2007 meeting was held by Dept. of Road Transport & Highways at A.R.A.I., Pune; in which some new (faulty / incomplete) rules were framed. As keen observed & user I had presented my Observations / Objections to concerned JS through my enclosed representation dated 7/9/2007 (enclosed). As expected Dept. ignored such observations / objections & without understanding difficulties & ground realities, JS issued Gazette Notification dated 23/7/2008 No 11012/12/01-MVL, implementing faulty procedure. In next few years Ministry realised it’s mistake & tried half hearted correcting through Circular dated 5/5/2011 (enclosed), which again was faulty & incomplete to resolve issue.

 

Sir, now to mitigate the hardships faced by PwD, I request for your kind intervention specially as there are only handful of Side-Car & Side-Wheel Retrofitment Kit manufacturers having ARAI’s approval. Thus initial pricing of kit is exorbitant (as monopoly product) & no after sales service, this puts PwD at receiving end. For e.g. in entire MMRD region there is only one vendor in Navi Mumbai for PwD residing in Mumbai, Thane, Palghar, Raigad, the next nearest is at Pune & that too only for side-wheels kit. Further, new Online Registration Procedure of RTO has deteriorated the situation as Kit is not supplied by OEM & Road Tax Exemption issues.

   

Sir, easiest is to revert back to Pre 2002 procedure for registration of Invalid Carriage specially as there is no adverse data about accidents of such vehicles. Sir, alternatively, you may force SIAM members & 2 Wheeler Makers to supply Company Fitted Side-Car or Company Fitted Side-Wheels. In return such Auto Makers may be given some incentives / benefits in Taxation, CSR, etc. I am sure with you at helm, you may come out with some better viable solution apart from above to mitigate problems.
