Hello Mr.A S Hada Ji and team,

Firstly thanks for much awaited 30th June held AGM minute of Meeting (MOM), which has been circulated on 27th July where ideally it should have be provided within 15 days of post meeting.  Well. We can understand your situation for delay and the reason to alter the dates (12-07-2013) in circulated MOM.

Second big thanks for sorting out water problem, which is the first and foremost update in your circulated MOM.  According to you we have sufficient water supply in the society and all issue with the water equipment etc. has been sorted out by your team.  Without a doubt it's great news for all of us.

Based on the same should we all assume that Rs. 300 which has been added along with monthly maintenance (Rs. 700) on account of water problem should be taken off? It’s clearly mentioned by the management that additional Rs. 300 charges will apply up "UNTILL WATER SITUATION GET IMPROVED”. Just to remind/add here that in AGM of 24/6/12 the hike in maintenance charges from Rs. 700 to Rs. 1000 got disapproved by the house and despite that the society members are paying the charges. We can read from the MOMs that this has not been addressed, but at the back of improvement in the water situation society members are now liable to pay only Rs.700 as a monthly maintenance charges instead of Rs. 1000. That's indeed is a very good news for everyone.

Let's move further with Critical point number "6" of long pending Court Case. As you have stated in the document "in the absence of proper information no action taken", are we saying here that management still doesn't have clarity about the case even after Rs. 30,000/ per society member was demanded and has been paid against settlement money a year ago? If your team had a desire to resolve this issue then you would have approached Delhi high court during your tenure of last one year for final judgment and action should have be taken to close down this important point instead of writing groundless statement to take as granted. Moreover from where this new 50 Lakh figure come into your mind? When on the other hand you are talking about absence of genuine information? Please make your stand clear here, from our understanding it's just a way to collect easy and fast money!

Another important point to add is: if the management was unclear about correct dues to be paid by individual society members, how come they are then considered someone as a defaulter? If the payments are not clear to management then how can society members be now stopped form either voting or for putting their nomination of management team? Please explain here......???? What we take out from this inappropriate action?

Let's move further and talk about your team. We the members of society are still unclear about the current management committee members. Why in the AGM, you did not update the house about who all are our office bearers, who have resigned, co-opted and what's the current management strength? Why this important information was kept hidden from the house? We know it's a very important piece of information and many things are depended on the same.... under the RCS guidelines less than 5 members management have no existence and the fresh team have to be elected, the day (25-Oct-2012) when Mr.G S Sidhu, resigned and MC became short numbered, you should have informed the RCS , submitted your and team’s (other three members) resignation and requested RCS for Fresh MC election under DCS 2003. But you continued the management without the minimum members.... which is illegal!!

 

Regarding the Election/Returning officer's appointment, which was also hidden from the house irrespective of him appointing on 26th May, well before the AGM on 30-June-2013?

It is the duty of management to announce this important piece of information during the AGM at least, we demand explanation as to why was this information not shared with the house?

Not just the above, we the society demands the answers to all question listed below:

 

·         Which Rule book of Delhi Cooperative Society Act / Rule / Bylaws you have followed.

·         How can a resident / spouse of management committee member be an Election/Returning officer..???

·         Is returning office know about any of these rules & his duties? We hoping he should be and still be part of this illegal show so in our view he part of your group and in the legal action he will drag into as well.

·         What’s the take we should get from this illegal way of management and the elections conducted???

·         No matter what, we do not accept the results of the recently held elections and will make sure that the matter is taken to the appropriate authorities.  Which is already commence and you know it better.

 

Although you don't have any rights to conduct the elections and appoint management members illegally, despite that if you do not prefer to go the judicious way, we assure you and others that the fight between your illegal ways will continue with our legal on an appropriate legal ground till end results.

If you want to do some repair work in your home and the management wants Rs 5000 for that is not the tax which you have mentioned it is called HARZANA or ZURMANA in Urdu.

We should thank Mr Hada and his team for improving the situation of water in the society as now on one hand we will be saving Rs 300/p.m which we were  asked to pay towards water charges till the situation got improved in the society in addt to the maintenance charges of Rs700/p.m which was fixed by the previous management and besides this we will also be saving addt money which we were incurring individually in procuring water from private vendors

I mean to say that apart from the maintenance charges of Rs 700/ we were paying addt Rs 300/p.m towards water charges i.e total Rs1000/p.m and let me clarify further that this amount of Rs 300/p.m was Rs 400/p.m as was demanded by previous management for procurement of water and as soon as Mr Hada took charge he reduced it by Rs 100/ and asked us to pay Rs300/.Since now as the situation of water has improved it is fellt that
we will not be asked to pay the water charges from July 13 onwards and it is only the maintenance of Rs 700/p.m which we will have to pay as any increase of maintenance amont was turned down in A.G.M of 2012 and in 2013 it was not proposed.

Dear all Rs 700 will come down further, how I will explain you ! Year back mr hadda had not agreed with previous management to pay even Rs 700 per month for maintenance charges, he had paid only Rs 500 and he challenged that within that could manage society monthly expenses(before election 2012), when he was elected as a president and evident that in his due was more than Rs 20000 against maintenance due and lift charges 1.4 lacs ( even though he was not defaulter and election officer also the same mr Manoj only! Total fraudulent election and now any one can challenge through court to decent this entire MC ) So he has to openly announce Rs 500 per month as a maintenance charge and where ever LIFT's are working they have to keep separate meter to pay the electric bill charges as suggested mr Hadda and mr.Ramnath kumar
Finally if go with their calculation and valid suggestions from them lift installed block. Rs 500 and others blocks Rs 400per month another Rs 50 could be reduced if remove the office Air condition.

Here we talking about genuine information and the correct approach
based on documented rules instead of baseless groundless activities /
rules created and following by current management.

We all are part of the same boat from long now and if we keep continue
like this fashion by blindly accepting all demand and action of the
current management then those days are not far when you will need a
another saving account to serve notice demand from authorities on all
illegal actions of mangement.

From our view..the way things are going....we need to think what
should worry us the most the act of god or the act of our management.

Its quite clear that management knows nothing about the rules and
regulations, what is legal and illegal and above all what is
inconvenience and punishment.

Just to add as you always ask only for this, its a public news paper
for the benefit of innocent people (AAM AADNMI) to get to know about
both side of coin and its depend on people to people to look for
valuable content from the news paper and support the same if they
agree instead of putting more interest of the author for no benefit to
group.

Let's talk here with facts and support to the right thing to make a
common voice. If you can challenge any of the documented point then
come up with facts instead of diverting the motive of the
communication.

Have you gone through the MOM which they circulated yesterday with back dated sign in which you could understand they mentioned 49 members attend the meeting and all most all the points were agreed by all the members this itself totally manipulation total attended members were around 40 people( members as well as their spouse and children) and most of the members are not at all agreed their points and not return the questioner. However to make it into their favour with pre texted intent and collect the money from the public the entire record have been manipulated and published through MOM . So we request you to ask the MC to publish the questioner who are all submitted and what's their view so you come to know why the RWA intervening to bring the figure and facts In front of us

At last we have received MOM, I could remember Mr Ramnath kumar raised his voice through mail (ref appended mail dt 19th may12.he should read once again and ask the same question once again himself to correct him self after read ) to “ previous management”. This mail sent by Shri-Shri Ramnath Kumar before AGM. Just go through it and make a note that Man changes with seat. In this he was asking Account statement 10 days before AGM. And now when he is in MC, Account statements have not been given even 50 days have past, after the AGM .Leave the Account statement, even the Minutes of AGM have been circulated yesterday, while Minutes are to be circulated within 15 days of AGM as per "Delhi Cooperative Societies Act, 2003"He raised Question on increasing the Maintenance to Rs.1000/- (on 24th June 2012). But himself increased it in July 2012.Now you please enjoy reading Mr.Kumar's mail. Now he himself calling as a secretary in the current so called MC ( minority illegal Group ) and unable to circulate the MOM timely ( so busy to conduct the VP election to bring the chadda from the back door entry) manipulated the record by issuing the MOM in back date . These groups are openly started doing their own way of manipulation. Dear residents pls wake up to take appropriate action against them

The MC have announced the AGM for the 24th June 2012. Agenda is as follows, please see my comments and request members to come oujt with their comments:
 
1. Confirmation of the proceedings of the last AGM held on 15th May 2011.
 
Comments: This is a standard procedure.
 
2. Consider and approve balance sheet, Income & Expenditure account and receipts & payments acccount for the period 1.4.2010 to 31.3.2012.
 
Comments: Why not the accounts upto 31.03.2012? We dont have thousands of entries. There is a clear 3 months' time between the account closing and the AGM and I dont find any reason why not the balance sheet be presented until 31.03.2012, even if it is not audited. This is very essential for two reasons, viz (1) this is the election year. New Team will take over and it is essential that full and final accounts are presented to the AGM as well as the new Managing Committee; and (2) as you are all aware, during the period 20112012 enormous funds have been collected by the present MC for verious items. The amount collected is in 7 figures. We have to know how much was collected, where it was spent and what is the balance. We cannot let go the present MC without submitting all these accounts. Even if it is not audited, we must have all the accounts as an unprecedented amount has been collected from members. MOST IMPORTANTLY, WE NEED TO HAVE THE ACCOUNT STATEMENT ATLEAST TEN DAYS BEFORE THE AGM SO THAT WE HAVE ENOUGH TIME TO GO THROUGH THE SAME AND COME OUT WITH PROPER QUESTIONS, IF ANY.
 
3. Court Case: Now that we are totally freee from the case, this needs to be talked about.
 
4. Installation of lifts:
 
Comments: The MC has been very sluggish and letharigic on this issue. Year after year, we have been forming committees and recommending various steps, bu the President refused to budge an inch for reasons known to him alone. One lift was installed as early as August 2011, completed after three months and took another 3 months to complete formalities and the lift finally started function 9 months after the lift was moved into the society premises. A handful of people have been pressing the MC very hard to order three more lifts and start the work for months now. They atlast startd digging two days ago, but we are still not aware if they signed the contraft for the other three lifts for three blocks where most people have paid. Once the work starts meaningfully, others will automatically pay up. This lethargic attiitude of the MC is very disturbing.
 
5. Allotment of Parking Space:
 
This is being talked about for three years now. A committe of 35 members discussed and finalised that the parking should be allotted forthwith by draw of lots and the modus operandi has been discussed in depth and accepted by all. Until now nothing has been done., Week after week a handful of people lietrally fight with the MC, listen to their promises and come back empty handed. A circular was issued last month giving the date for final payment towrads lift /parking as 15 May. People are not interested in paying anything because the MC is too lethargic and dont take any action on any issue. One more AGM, one more time talking the same thing and no results.
 
6. Realization of the dues from the defaulters:
 
COMMENTS: The MC means by defaulters members who have not paid/refuse to pay various dues. Severe penalties should be imposed on the defaulters so that the members pay up. Are you all aware that few D E F A U L T E R S  are deliberately omitted from the list year after year for over 9 years who owe the society over 50 lacs? The Audited report mentions this for the past 9 years. Nothing has been done on this. A member of the MC, when asked replied "why nothing was done by the previous MCs?". In 2002, once this was brought to the notice of the then MC by the Auditors, we found that the ex-President Mr. S.K. Sharma owes over 50 lacs to the society and the MC blocked the sale of many flats supposed to be under the control of Mr. Sharma. Not a single flat is left out. Systematically NOCs have been issued to the "owners" of the flats and they have all been sold. Shockingly even the flat in the name of Mr. Sharma has also been released. All during 2003 and 2012, out of which Mr. Rana has been the President for 6 years. WHY THSE DEFAULTERS ARE NOT EXHIBITED IN THE LIST? WHAT ACTION IS BEING TAKEN FOR THE PAST 9 YEARS TO RECOVER THIS MONEY? WHEN WAS THE NOC ISSUED TO MR. SHARMA FOR HIS FLAT?
 
7. Increase Maintenance to Rs. 1000?
 
Comments: Why? This was increased to Rs. 700 only recently? What are you doing with this money? Are you paying higher wages to the guards, electrician, plumber? Have you done any maintenance work in the society for the past three years? Even the drains are chocking and the MC is doing nothing to clean it up and the back flow leaves a stench in homes. Why then the increase? Why the MC refuses to give accounts for this?
 
8. Parking fee for the 2nd, 3rd and 4th vehicle:
 
Comments: Absolutely needed.
 
9. OTHER ISSUES:
 
>I have personally been pressing the MC to send out Demand Letter to all members fo rthe ground rent. The President point blank refused. He said the members should pay up on their own. Who can make him understand? How much money is due to DDA on this account? How much and upto what period it has been paid?

How much ws paid to the DJB? What is th ebalance to be paid? How much was paid to the Lawyer, mind you , this was completed in 3 hearings and we have not hired Manu Singhvi or Harish to pay in lacs per hearing. How this money was utilised? We need to have a complete answer on this.

Dear Members, please give your comments. We MUST PRESS THE MC TO PROVIDE US WITH THE ACCOUNT STATEMENT UPTO 31.03.2012 ATLEAST TEN DAYS BEFORE THE AGM.

ARUL, I THINK, WE SHOULD ALSO TRY TO GET INTO THE MANAGEMENT SO THAT AT LEAST THE LIFT IN OUR BLOCK STARTS FUNCTIONING. 

IN any case the warantee of the lift will get over in one year and we may end up paying repairing charges even before it becomes operational... Merry Christmas  ... Jayaraman

Yes sir we hv to call all the members who are all paid for lift charges and ask MC to start the lift or to stop the others blocks lifts where the lifts are currently in operation( until others blocks lifts commissioned with proper statutory compliance) .
These lifts are operational without license I do not know Mr hadda and group are more interesting in doing all illegal things. If MC declared in MOM that 5 lifts where successes fully completed in the last one year performance if it is so than why the lifts are not commissioned in the other four blocks except Mr Ramnath kumar block! what is the special only Ramnath kumar tower had given the priority to start the work and commissioned first & also running without license. let MC to clarify the mystery to the residents .
And if they are not taking any action we hv to call police and register the case against them

I absolutely agree with you.  The MC should  (a) Put the lifts already installed into operation and start pushing for the money from the residents who have not paid yet, (b) Start paying interest till the lifts are put into operation to the members who have fully paid  or (c) refund the money to us and we will manage without the lift, the way, we have been managing all these years.  

I suggest that we meet on Saturday 3rd August to take a call on these issues. If needed we can go to the police station to lodge complaint on the same day.  Regards...Jayaraman

We understand your raised point about the lift as a major pain area and respect your plan of action to work in tie up with management to resolve the same.  In our point of view, here current management itself is a root of all issue instead of talking to just one “Lift” problem.

There are list of their illegal action / extortion cases / creating animosity amongst people / un- authorized construction / illegal water connection / Selling of society assets / only followed their own rule book / bring discomfort in the society etc …..Has been observed by all of us and in some manner and to be part of the evergreen society will be liable to pay the penalty to authorities of their own illegal actions.  That’s the truth and we have to live with it because we are the one who put them onto our head by vote.

It’s time to group together and works toward to resolve the root problem instead of talking individual problems by couple of effected people.  Just to keep you aware the current management has loosed his existence in very early time of their appointment and running illegally since then.  Let’s join hand and save society & our hard money.

As we already stated in last email that we have already initiated the legal way in that direction and we request people to join us and achieve the result together.

Dear All,
This is to inform you that for the past several days we are getting contaminated water in our homes , now it is confirmed that the water which we are getting is mixed with sewage water as a result many people have started having irritation in their skin and having stomach problem, this is a serious problem kindly suggest what can be done in this regard.

Dear residents 
The contaminated drinking water supplied to the residents  is major threat to the human health. This water may contain very dangerous bacteria  E Collies which is main cause for intestine disease  E Collitus  which is incurable and may damage whole digestive system. Myself and Mr Ravi (flat85) met the management committee including Mr Hada Mr Kumar and Mr Chadha and apprised the seriousness of the problem. One point near flat 151 was repaired but still the problem is persisting.  It requires immidiete attention to resolve the serious problem of unhygienic water. I request all the residents to come forward and help to resolve the problem by providing their valuable know how and expertise otherwise we all will be affected by consuming the unhygienic water.

I think we all must meet the Government authorities before it becomes an epidemic and ask the government of Delhi to provide us clean water till the time this issue is not resolved.

Yes it is good idea to meet the CONCERNED Govt officials or even our MLA .Because it is question of health of about 600 - 700 residents which includes infants and old people who are more likely to affected by consuming such bad quality water which even not fit for animals consumption. Already 
there is report of stomachache from some elderly people of the society.

Dear All,

This is really a very serious issue which is still not been rectified by our plumber. I don't think he is capable of finding out the exact spot from where the sewage water is getting mixed. Our management people also not taking it very seriously to sort it out. May be there are getting fresh water from any other source. I request all our members to come forward to lodge a complaint with the government depart. Also , if any one advise the detail of the department where we can lodge our complaint immediately.
