SHOW CAUSE NOTICE
Whereas, Evergreen CGHS Ltd. Sector-7, Plot No.9, Dwarka, N.D.-75 is registered vide registration No. 837 with this department under the provisions of the DCS Acts and rules made there under.
And whereas, Election of the Managing Committee of the society was conducted in July 2012. Vice President and two other members resigned from the MC in the same year i.e. 2012. Thus, the No. of members of the MC reduced to 04(Four).
And whereas, the society came into the minority because of Section 23(1) of New Bye-Laws of CGHS Ltd. which stated that "the Managing Committee shall consist of at least 5 members of the society and not more than 15, over the age of 21 years including a President and Vice President".
And whereas, the R.O. appointed by the MC on 26/05/2013 to conduct the bye-election for the post of Vice-president, scheduled on 28-07-2013 but MC had not even informed of the appointment of R.O. to AGM held on 30-06-2013. Election Notice was issued by the R.O. on 07/07/13 and defaulter list was issued on 15-07-2013 which is not in accordance with the Para 3 of Schedule-II (Rule-53) of DCS Rules, 2007 which states that "defaulters list shall be prepared thirty days before the date of the election and displayed at the notice board of the co-operative society and a copy shall be sent to the Registrar in duplicate, one fore record and the other for display on the notice board in the office of the Registrar "

Now, therefore, I, Tajom Taloh, Registrar Co-operative Societies in exercise of powers vested in me under section 37 of DCS Act, 2003 hereby call upon the President/Secretary of the above said society to show cause as to why the Managing Committee of the society should not be superseded. The explanation of the President/Secretary should reach the undersigned within 10 days from the date of issue of the notice and they are also afforded an opportunity of personal hearing on 15-02-2014 to present their case. If they fail to submit the written submissions within stipulated period and also fail to appear before the undersigned on the above mentioned date & time, it will be presumed that they have nothing to say in this matter and ex-parte decision will be taken without giving any further opportunity.
