Greetings..
A group of buyers of Aqua CASA project met you on 24th June 2017 and had raised various concerns as recorded in Minutes of Meeting circulated thereafter.
One of the key points discussed was to move forward with an open heart and expedite the delivery of the project, which I believe was in the interest of both the ends (builder and Buyer).
We were promised by Mr. Khurana that a list of construction milestones of next quarter for Phase one will be shared with the buyers which will be monitored on fortnightly basis and the first monitoring meeting was fixed for 15th July 2017.
After few reminders we did receive the plan for the quarter on 13th July 2017, however the monitoring meeting scheduled on 15th July 2017 was cancelled by you. The plan also didn’t have a fortnight milestones and the same was highlighted by one of the buyer on the same day.
Since then, your only interaction seen with the buyers is the demand for the money, however, no visible efforts have been seen to meet the group of buyers or all the buyers on the activities planned and gain the confidence of the buyers, who till now had stood by you and trusted with their money on you and had fulfilled all the demands timely. No efforts have been made by you to re-gain the confidence of the buyers. Instead the communications sent were more of the threat that if the “demands are not paid, nothing will moves”.
Dear Mr. Khurara, We buyers still want to believe your skills of management and are wishing that we get our dream home through your honest efforts, and are ready to move forward with you, however the first step to gain confidence has to come from you. Can we plan a meet on the coming Sunday i.e. 30th July 2017 to see the viability and accomplishments of the plan submitted?
We are also very much concerned with the various reports published on various sites like sites of Greater Noida Authority which says that there is Rs. 50 Cr over due on this project, including penalties, and some newspaper reports which says that there is Labor CESS overdue on Rudra Buildwell, especially with the arrest of Directors of Amrapali, we are really worried.
Would you recommend a refund with interest, in case the project plan as per plan submitted by you is not executed? It’s a known fact that till date this project has had many deadline miss.

About time that you remembered "Agreement". Hope you also remember that the BBA also has a delivery date, which you have been defaulting on for last 2 years. As per the same agreement, I should have been living in my flat for long time now.
Start to honor the agreement yourself before you site it for me. I have, still been paying, even though you did not deliver the flat even after 2 years from due date. How long do you expect me to keep paying you while you continue to default on the agreement?
This can't go on one-sided.
Sir, with due respect, it is you who is defaulting. It is time that you show us with your work that you are committed to deliver before expecting further payments.

Thanks for sharing the project plan. Not to mention, it was late by a week’s time. You followed your track of now delivering things on the promised time.
As per our agreement in last meeting, the plan was supposed to be a measurable plan for next 3 months which could be tracked every 15 days. You have submitted a plan which doesn’t have fortnightly measurable and traceable steps.
There are other aspects as well, which are not clear in the plan. The club, services and amenities will be ready by 1st Sep 18, without mentioning anything about development stages of club and separate services and amenities.
Talking about communication gap, please note that it is not us who are mum for last 5 years, it’s the builders who are sitting on our money without delivering the project on promised time as per BBA.
Regarding continued support, please note that we have continuously supported you for last five years with all the payments even though you failed to honor the agreement. It is the builder who has jeopardized this project and not the buyers. Hope you will be careful in using such words.
We have paid aprox 85% of the amount and you have hardly completed about 45% of work. Simple mathematics says that you don’t need finances till you reach 85% of project completion. This may not be exact calculation, but it is fair estimation of the financial equation.
In the end, let me re-iterate our understanding. Rudra as a builder needs to take definite steps and show considerable progress in the project before expecting any further payments. We as buyers are of view that until we are satisfied with the output, we are not going to release any further money.
Looking forward to our next meeting on 15th July 2018. Please confirm the same ASAP.

We, the group of buyers went very satisfied after the meeting with Rudra Management on 24th June 2017. However, the feeling is otherwise at this stage.
We are writing this with a very heavy heart as Rudra and this time also defaulted on their commitment. Till this hour of 9th July 2017, we have not received the quarterly plan as decided and proposed by Mr. Khurana in the meeting held on 24th June 2017. We think all other schedules would now differ due to non-availability of the project plan, like meeting on 15th July 2017.
We always carried the feeling that Rudra says a lot but when it comes to pinning down it in writing or acting upon it, it shy’s away from it. Which is evident with the action and your reply of the revised minutes of meeting.
Minuets of the meeting contains the important points discussed, brought forward, decisions takes and action plan. However, the minutes of meeting shared by your team was merely a convenient once sided decision of the meeting.
Believe us, we buyers are more disappointed with your reply and especially your denial of acknowledgement of the discussion of points, and your inaction till date. We are sure you realize that a mere minutes of meeting would not corner you, but your denials of facts and inaction would corner you and raise doubts in your intensions and actions. In a relation (business or otherwise), when both parties are trying to reach at a common result, denying things in writing which you admit in discussions, would break the dialogue.
We would like to reply on each points denied by you:-
- The revised MOM was corrected as it didn’t reflect all the points raised and discussed in the meeting. The MOM submitted by you was only one sided, conveniently placed decisions.
- The work has started only in 2014 was mentioned by you in the minutes of meeting. Just in case if you had missed, Mr. Vibhor had sent the construction update on 11th Jan 2014 giving the status of project where excavation was going on, which can be shared to you if you do not have it in your records.
- The issues of early demand was brought up and it was backed by proofs. The Rudra management went silent on it once the proofs were shown. Even on the current demand, photos were shown dated 11th June 2017 and there was no answer to it. We would request you to please rephrase this as per your convenience. However, this is an important issue and has to be a part of the MOM.
- On point no 7 and 8, you requested for the release of current demand and we as buyers are effected party, put our point forward. Where is the confusion in these points?
- We are am sure you would have appreciated that MOM contains your version of quality of material used, which was missed out by you.
- We are sure you would appreciate that we kept Sept 2018 as delivery date intact as mentioned by you in MOM, whereas Mr. Khurana had clearly said that he is trying hard to deliver by March 2018.
- We are assuming that all other points which were amended are accepted.
In the event of this confusion on discussion points, We would request that further meeting should be video recorded so that no confession prevails in future meetings.
We Buyers are also trying to understand at what kind of business relationship is this where the party who is defaulting is trying to penalizing the effected party in the way of:-
- Buyers are suffering both in terms of rent and EMI. Average loss to each buyer is of Rs. 4-5 lac yearly due to non-receipt of flats timely
- There is extra out flow of money due to increased taxes, which could have been avoided, provided there was timely delivery of flats
We am sure it would be both ethical, moral and correct if Rudra bears this additional burden due to their incapability in providing timely delivery.
We buyers are the affected party and are forming a buyer’s association for a better representation. We are still standing with you, however we understand that it is within out rights to keep all our legitimate option open if the mistrust increases on you due to inaction or trying to be politically correct and not delivering.
We being the creditors to Rudra Buildwell and affected party would also like to join the meeting planned between you and bankers on 16th July 2017.
15 buyers has visited the site today. The situation is more or less like it was on 11th June 2017. The person accompanying us did mention that there are about 350 labors. However when the labor attendance report was submitted to the byers by Mr. Himanshu and Mr. Akash, it had only 140 labor for Phase 1 and 24 labor for phase 2. We are just curious if this strength is enough for the completion as per dates mentioned by you.

Now that there is a change of Tax from 4.5% to 12% with effect from 01.07.2017 on every demand. Those who are holding unilaterally the payment of demands already raised will have to pay enhanced differential tax of 7.5%.Please release the payments without delay.

I can understand the confusion and anxiety created with the New tax regime of GST. Hope the industries will have clarity on it soon. Hope it would help all the stakeholders including you and we buyers since now multiple takes like Excise, VAT, CST, Service Tax, import duties would be merged into one and you would get 100% modvt of the stock purchased in last one year and future purchases against your deemed sales which is mandatory to be declared every year.
We are also hopeful that since cost is deemed to get reduced due to this, appropriate benefits would also be passed on to the buyers who have been standing with you since last 5 years.

I would like to meet your management along with 20 other buyers this weekend to understand the progress of the project, it's project plan, delivery timelines and we as buyer group demand to monitor the progress on fortnightly basis.
6. Also, i feel no shy in saying that any money now given to you would yield any results as you have failed on every steps and ready with bunch of lies. Since the project timelines have been delayed to more than 60%, it is fair to adjust the delay penalty in the further payment as i see no other option of recovering of it otherwise. Please calculate the delay penalty till now and till the estimated time of possession and adjust it from future payments. We buyers can appoint an individual auditor to help you in this.
Action required from Rudra:-
1. Clarification on penalty charged and its reversal
2. Submit the report on start of external plaster, whenever it happens
3. Arrange a meeting on this weekend with the group of buyers. ( I can help coordinating it with buyers)
4. Submit the dues and overdue with GNIDA.
5. Calculate the delay penalty and submit the report.
As it is evident form your reply and architect report submitted by you, the demand is an early demand and therefore stands null and void.

2) As per the architect’s report submitted on 2nd May 2017, the internal plaster is in process in T7 Tower on 9th Floor. Which clearly means that external plaster has not started and that this time you have raised every demand as usual. Bad habits die rarely, right? I have raised this issue earlier as well, and seems always fall in deaf ears.
-The architect report attached is dated 01st June’2017 and the external plaster work has started on 4th June’2017. I will share one more Construction Report of Aquacasa dated mid-June’2017 which will have the construction status of external plaster also. Till the time, I have attached the picture (T7-external plaster) for your reference.3) You had audacity to threaten us on cancellation on nonpayment when-

:Total amount paid till date is INR 40,54,379/- (excluding service tax) which is 87.31% of the flat cost.(b) It is an early demand. Project has not reached the stage as stated in demand

(d) You should have started paying the Delay Penalty, which has not been paid yet

- The UP government has not constituted a RERA and appointment of staff is yet to start.
5. My father bought this flat from you in October 2012 with a promise of it to be delivered in 3 years. Since farmer Agitation was already over by then, your team was confident in delivering it on time.
- Agreed6. Your immoral intentions were made clear when you took 1 year in signing the BBA and added the date of delivery to be 3 + 6 years from the signing of BBA. A clear cheating which was highlighted to Mr. Vibhor (then Project Manager).
- Your BBA was executed on 05th September’2013 which is duly signed by the customer and the company which complies that you agreed to the terms and conditions of the Agreement7. You had always raised early demands and objection has been raised by me in all occasions, where you have later admitted your fault and have later revised the demand.
- Demands are raised giving 1 month of advance time. However, whenever the construction work was not up to the level of demand note, no payment were asked for the same. There was never the pressure to make the payment.
8. The site visit on 13th May 2017 post your architect report highlighted the situation as pathetic and alarming. Even after four and a half year of booking, the project has not been erected fully.
- Kindly visit the site again.9. Reach the stage for which the demand has been raised
- Clarification given in Point 2.10. Get the project registered under RERA
- Clarification given in Point 4.11. Give details of any amount which is pending to be given to Authority. Since I have already paid more than 89% of payment, my assumption is that you would be clear on this part.
- There are no dues pending in the Authority. File attached for your reference.12. Since the project has been considerably delayed, it is fair to ask for the monthly delay penalty as we have not got the flat and are paying regular EMI. Adjust the delay penalty in the demands as per RERA. Non-payment of delay penalty staring from October 2015 onwards, immediately would levy a compounding interest at the similar rate.

This is a critical stage for me and I would like to make my position clear. Which is as under:-

As a buyer, I demand the following before making any further payment to you:-
1. Reach the stage for which the demand has been raised
2. Get the project registered under RERA
3. Submit the actual delivery schedule
4. Give details of any amount which is pending to be given to Authority. Since I have already paid more than 89% of payment, my assumption is that you would be clear on this part.
5. Since the project has been considerably delayed, it is fair to ask for the monthly delay penalty as we have not got the flat and are paying regular EMI. Adjust the delay penalty in the demands as per RERA. Non-payment of delay penalty staring from October 2015 onwards, immediately would levy a compounding interest at the similar rate.
Without fulfillment of above requirements from Rudra Buildwell, I as a buyer will not be responsible for delay in payment of this demand or further demands and any interest/ penalty arising out of the delay on payment of the said demand (S)
