 As per BBA you have to give possession in March 2016 and as per trailing mail you have written for giving possession in Sep'18 so it is already 2 and half years delay as per your convenience without our consent and I borrowed so much amount from bankers needless to mention here I already paid interest to bank for delayed period..
Now I have no fund for such a delayed projects and I have Rs.8.14 lacs interest due to you as on date.Pl adjust due amount 3.68 lac from interest due from you on delay of project and rest amount can be adjusted in next installment.
 
Please complete my project without any further delay.

The demand that has been raised is in accordance with the Payment Plan opted by you at the time of booking. All the previous payments were also made by you on the same basis.
The work of the said demand has been fulfilled and the same is being reflected in the Architect Report which you can also cross-verify.

Ref.your demand letter received towards 'start of Top Floor slab',you may note that you had to complete the projects in 36 months with 6 months grace period  i.e.March-2016 as per terms of BBA agreement.Your project has been delayed already by 15 months and during this period I have paid interest to banks for delayed period which has increased my cost.

 

Further I personally visited site on 21st May 2017 along with 8 buyers and observed that there is no work-in-progress at site ..You must note here that all buyers have booked a flat in a ''Rudra Aquacasa'' which shall be a complete project rather you present me a tower/flat work in progress and demand money. I have already paid Rs.36,37,483/- and Now further demand Rs3,68,053/- will arrive at 90% payment.

 

Since you had to give possession in March 2016 and I had paid you money much before that and bearing a burden of interest charged by bank on money borrowed. Therefore please adjust Rs 8,18,433/- towards interest @18% on Rs.3637483/- paid since March'16 and refund me the balance amount Rs.4,50,380/-.

 

I further request you to complete the above projects in all respects so that my dream comes true.

I am awaiting your reply whether you will refund balance money Rs.4.46
lac to me or you will adjust in my future installment. Because as you
have registered this project in RERA Authority showing completion date
31.12.2020 which is totally embarrassing to all buyers who have been
awaiting for their ''dream home'' since March-16(your project
completion date as per BBA).

Dear Ms Aditi,

With ref.to your REMINDER -1 received on 21.08.2017,I am surprised to note that you have registered in RERA showing project start date 2014 and declared a projects completion date as December 2020 which is totally a misleading statement not as per BBA, while actual date was October 2012 and March 2016 respectively. Moreover demanding installment at this stage has also disappointed me .Therefore please reply what will be due after adjusting interest for delayed period from March-2016 to December-2020 which comes Rs 1162401/-(paying bank interest amount Rs 20393/- p.m.) and penalty for late delivery of projects and wilful harassment which costs can't be calculated right now. Please note here my flat value is 44.0 lacs and I have paid 36.37 lac, hence the amount recoverable from you is 3.99 lac(i.e.44.0-36.37-11.62).

Buyers have also inquired into opening an escrow account and your balance lease rent payable to Authority,our electricity and water connections etc. which are also very serious points to be replied to all buyers.

Finally please do not remind me again for due payment but pay me the balance amount 3.99 lac immediately which I suffered for investing in your projects and inform time of possession of flat with complete project.

Dear Ms Aditi,

With ref.to your e’mail and REMINDER -1,2 and 3 received in the recent past and my reply against your demand via e’mail dated 29th June, 12th July, 12th August  and 24th August 2017 ,I am surprised to note that you have registered in RERA showing project start in 2014 and declared a projects completion date as December 2020 which is totally a misleading statement not as per BBA, while actual date was October 2012 and March 2016 respectively. Moreover demanding instalment at this stage has also disappointed me. I have started to pay since 11th October 2012 Rs 3,00,000/- as advance money and have been paying all due instalment in time from booking date uptill ‘start of 15th floor slab’ on 31st Oct.2015. Since then there is no work at site and till date after completing 5 years there is no sequence of projects completion and possession as well.

Needless to mention here that I had booked one 3BHK Flat no.503 in Tower-4  in ‘Rudra AquaCasa’ and I have paid almost 85% of total amount. I am getting reminders for the balance payment now which is not digestive. Possession date for my unit was Mar’16 ,One and half years already passed and the project is nowhere near completion then why this demand has been raised. This demand should not be raised till the project is ready for the possession.

 

It was established in the meeting held on 24th June 2017 in your office (along with many buyers) that this demand has been generated even without reaching the stage and your subsequent architect reports confirmed the same. Mr Mukesh Khurana assured us that the demand will not be asked till the completion of projects as per BBA and the said demand shall be withdrawn without any delay.

I have gone through your architect report and also visited site 12.08.2017. Even the brickwork of floor 15-20 is yet to be completed. Here, I must clarify that your company has already taken 85% of the total cost by just standing the RCC structure. Nothing has been done towards internal and external finishing works (i.e, internal and external plaster, Flooring, Kitchen work, Tiling, plumbing, Whitewash, wood work, Society Road, Common area, Rooftop Restaurant, Jim, Business Launge,Parks, Shopping Area provision of light and water, park, swimming pool, club facilities, Lake(for making a first lake city), and other statutory charges, etc.). Nothing has been done in this area till date.

 

It has also come to my knowledge that your company has not deposited the due lease rent to the GREATER NOIDA AUTHORITY till date. Whereas, the payment of lease has also been taken from me with my dues. Please clarify the details of payment made towards lease rent by the builder. Kindly provide the details of total lease rent payable and amount collected towards the same.

I have come to know that the project start date reported by you in RERA is 2014, which is a false statement. In my case, the project was booked in October 2012 and the excavation was happened in March 2013 even you had taken payment up to   ‘start of 5th floor slab’ till 2014. Either those demands were false or the representation in RERA is misleading.

 

Buyers have also inquired into opening an escrow account to deposit the buyers money collected till date and explain utilisation of money for construction of flats and of course to complete the projects i.e.Rooftop Restaurant,Jim,lake, Business Launge,Parks,Shopping Area,Roads,Security etc and balance lease rent payable to Authority, our electricity and water connections, which are also very serious points to be replied to all buyers. Now you please share details of your Escrow account declared by your company under RERA registration and utilisation of fund to my projects. Although you have mentioned in the earlier mail that you shall pay penalty amount to me but what if the project is further delayed beyond Sep’18. By making this payment, I shall be making almost 100% payment and still there is no guarantee or visibility about actual possession from your end.

 

Therefore please reply what will be due after adjusting interest for delayed period from March-2016 to December-2020 which comes Rs 1162401/-(paying bank interest amount Rs 20393/- p.m.) and penalty for late delivery of projects and wilful harassment which costs can't be calculated right now. Please note here that demand as per your letter is Rs 368053/- and after adjusting this from interest due from you ,please return my balance money by a demand draft in my name for a sum of Rs.794348/- .
