Dear Ms. B. Jayanti,
This is to bring to your attention that WAORTP has been illegally pasting the notices on the notice board of Block 1, Raintree Park claiming dues from the residents which are not legally due to your society WAORTP. You had also been threatening the disconnection of services which neither you own, nor authorized to occupy.
1. Please be aware that I am the resident of Flat 401, Block 1 and also the power of attorney holder of the said property. You are unknown to me, the said property was purchased from SITCO India Pvt Ltd. and as per the term of registration of the property, the SITCO was to provide maintenance Point no 7 of the registration document which states
- " the JVCO shall maintain the common facilities, amenities in each of the blocks, drive ways, drains, culverts, water-mains and sewage plants and such other common facilities in each of the blocks for which the purchaser/s shall pay the requisite maintenance fees periodically, as my be decided by the JVCo”
2. As such neither you have any locus-standi on the matter, nor you have any authorization to occupy the common properties of DG residents including Club House 1. You had been making false claims as being the only authorized society under AP Apartment Act 1987 and also that The WAO-RTP is entrusted with the responsibility of maintaining the entire township.
Your assertion is totally false and attempt to intentionally mislead and cheat the owner/residents as born out of the property registration papers and also your own submission to hon'ble court of the Ist Additional District Judge, Ranga Reddy at L B Nagar in OP. No. 277 of 2013. Whereby you have submitted that you have no ownership whatsoever of any common areas of Raintree park and that you provide maintenance services for your members. You also submitted patently false affidavit in Hon'able High Court in WP 18366 of 2013, claiming complete jurisdiction of Raintree Park thus attempted to mislead court and tried to take ownership of property of owners of Raintree Park.
3. You have been trying to control the whole Raintree Park residents by virtue of illegal control of public road and controlling the ingress/egress by way of your security agency and enforcing the dictates of WAORTP by you use force.
4. I am concerned that you are trying to extort money illegally from the residents including me, by pasting notice showing dues and threatening disconnection of services incase those dues are not cleared.
5. Please be aware that I, as registered power of attorney holder for Flat 401, Block 1 is not a member of your society. You had collected huge some of monies from me already by making false claims. I have already served legal notice to you in this context and in absence of any reply from you and your continued threats; I am constrained to instruct my attorney to immediately initiate remedies available under law including civil and criminal actions including but not limited to civil recovery suit and also criminal case for cheating, extortion, criminal intimidation and illegal occupation of property for which, you would be solely responsible for all the costs and consequences arising thereof.
