Dear Madam,

I am constrained to send this email to you to COMPLAIN to you regarding the Non Disposal of my First Appeal by the FAA of your Commission.

As you can very well see from the trailing emails (copies of all emails and letters have been marked to you !), there has been an inordinate delay in disposing off my first appeal. Since this matter pertains to Corruption in the CIC, there is no doubt in my mind that the disposal of this first appeal is being delayed on the prodding of the corrupt persons working in the Central Information Commission.

If you recall, I had also called you about a month ago, before Mr Dash demitted office, and you had assured me to look into the matter and get this matter disposed at the earliest. 

However no such thing happened !

As you can clearly see from the above table, I have tried my best to follow all rules
and procedures as well as send timely reminders to the FAA to get his orders implemented.

However, I am now convinced that both Mr A K Dash, the former Adnl Secretary 
cum FAA and  the present FAA Mr Beck, are both part of the same 
CORRUPT MAFIA , existing in the Commission.

Madam, you are part of the Central Information Commission, the apex body for deciding
second appeals / complaints under the RTI Act. If your own senior officers:

- do not follow the time lines specified in the RTI Act 2005
- are not able to enforce their orders on their own subordinates
- do not even reply to 5 reminders over a period of 5 months

then with what face and authority can the Commission direct officers of other public 
authorities and expect the compliance of their orders ?

Since Mr Beck took over as the FAA of the Commission, I have called him more than 15 
times and he has never ever come on the phone. 

His email, as given on the website of the Commission, keeps bouncing.

Madam our Prime Minister keeps talking about "courteous behaviour" of Government
officers towards citizens, but surely, not responding to 15 phone calls cannot be termed as 
"courteous behaviour".

I therefore URGE and REQUEST you to immediately remove such an officer from
the post of FAA and reassign the duties to some other officer who can at least
return calls from applicants/appellants who have been waiting for an order
since more than 6 months.

I also did call you once and left a message with your PA, but the call was
not returned.

Ms T Y Das, Secretary of the CIC, has been "prematurely" repatriated by an order of DoPT.
So, now, No Chief, No Secretary.

Headless chicken has also become boneless !

What next ?

Maybe birdflu striking the chicken ?

Slowly CIC will have one IC, one jr.clerk and a peon and big office at public cost.MP and other states had no Commission functioning till high court intervened.In Gujarat Info Commission at least 3 PILs had to be filed for each time getting additional ICs to clear backlog. Now time-lag is 3 years at GIC. With  BJP govt at center, CIC will meet fate of GIC and other BJP ruled State Info Commissions. In fact BJP hates RTI as it is UPA baby. May be BJP thinks that Indian citizens are not mature enough to enjoy transparency in governance.

Let us hope writs in Delhi and Madras High Courts bear fruit in the interest of good governance, accountability and for containing corruption, transparency etc which BJP had been repeatedly shouting in election campaigns and manifestos.

The RTi Act Amendment Bill shows us that all political parties are
opposed to RTI.This includes Congress as well as BJP. Not even 1 major
political party, CPI was an exception, was prepared to submit to RTI.

The courts are the MOST CORRUPT institutions in India and are hardly
RTI friendly - IMHO courts should be avoided as their sting is always
in the tail of their judgements. Ultimately it is for the RTI users to
make the best of a good law with a poor regime.

Its very good that all those people in CIC have been repatriated.
Perhaps it has something to do with the emails I am sending everywhere
about the scams in CIC HQ (sub-standard) construction.

This should be sent to the Registrar of the Apex court as public opinion on Courts.

Attached is an order of the Mr Rs Girdhar, CPIO, DoPT.

- No subsection of Sewc 8(1) given while denying information
- The reason given for denial is incorrect and has been struck down by several 
   High Courts

Something more than meets the eye....in this whole appointment of CIC appointment.

When ever information is to be hidden for inaction, hidden agenda or vested interest, PIOs normally give funny reasons so that you have to move to first and second appeals, which will be heard after 4-5 years without any chance of penalty by IC. Matter ends by that time. PIOs forget that they are discharging quasi-judicial duty and not administrative one under RTI Act. This is good governance, transparency, accountability, containing corruption etc etc as far as RTI is concerned. We have experienced it in Gujarat for a decade. Let us not blame poor CPIO, DoPT since he has to serve in Delhi Central Govt. He must be under pressure for achhe din of common Indian!BJP is not walking the talk made during election campaigns and in manifestos. Only light at the end of tunnel is higher judiciary, if it works with bullet train speed as it did in case of Salmanbhai. Delay and dirt are our national diseases.
