Please see email below that we received from Attorney Gottlin who is now representing the Estate of Abraham Cogan.  Bob and I have discussed her response.  We wanted to inform you and the Board that we do not intend on reducing our fees as there is simply no basis for such a reduction.  There is absolutely no financial hardship here.  I have reviewed the probate documentation which revealed a close to $5 million dollar estate, all of which is all being left to charitable entities.  Mr. Cogan disinherited his only living relatives.  As you may be aware, Mr. Cogan had a home health aide who convinced him to execute certain estate documents which financially benefitted her.  However, the documents were discovered rather quickly and there was only a small amount of money transferred. That health aide has since conceded to not contesting the probate proceeding which removed her as executrix and trustee and admitting Mr. Cogan’s original Will leaving his estate to charities.  Additionally, I do not have a clear indication of when a payoff is forthcoming as this attorney was just assigned the case.  From our analysis, there is simply no reason for either our office or the Association to take any reduction in what is owed.  Based on the foregoing, would you please present the issue of the late fee waiver to the Board for consideration and advise of their decision so that I can speak with Attorney Gottlin.  Also, immediately before Attorney Gottlin was substituted into the case, we were about to commence a foreclosure action.  Assuming a payoff is not forthcoming in the short term, how does the Board wish for us to proceed?

Thanks for the payoff.  Under the circumstances and given Mr. Cogan's long term residency (since 1974) I would ask the association to waive the late fees and reduce the attorney fees.

Thank you for your email. I’m out of office now, but wanted to reply before day’s end. 

Please note I was just appointed yesterday as the fiduciary for Mr. Cohan’s estate. I intend to marshall the liquid assets post-haste, but it may take a bit given the financial institutions legal review, etc. I presume your client will extend the courtesy of patience knowing they will be made whole in due time and it will not be necessary for the estate to incur legal expense to have any court action suspended under the circumstances. I will be back in office tomorrow if you wish to discuss further. Please do forward me the current ledger/payoff.

Hi David,
What is the amount of late fees owed at this time?
Have we been charging late fees since his passing?  If so, I am fine waiving anything after his passing.

As for prior to that, I believe the estate should be liable.
But would like to know how much we are talking about.
