I am writing to advise of a situation the Residents Association has been drawn into.

 

On 11th August, 2009, the gardener employed through  'Gardens By Design' to cut the verges and do low level maintenance work, fell into a partially uncovered ditch. The ditch had been dug to alleviate water problems and was apparently about 0.7m deep. It had been fully covered, but somehow part of that had been knocked away. Sometime later several injuries presented themselves to the claimant, and we have been cited as 'responsible' under various pieces of legislation, and what could be broadly described as 'health and safety' issues. Our insurers have taken this up and are defending us. Alan Street is continuing to act as coordinator for us.

 

The matter is now approaching court. For any who are aware of this process, it is heavily paper intensive and requires considerable effort. Our insurer appointed lawyers are defending us, there is no excess for us to carry, and the case could go in our favour or not. If not, the totals involved could be as much as £30,000 to £50,000.

 

There is little we can do to either expedite this, or give greater clarity for everyone. However, any of the committee will be happy to answer whatever questions we can. This court action may well have an impact on future insurances.

  

In the meantime we will, of course, let everyone know how this all plays out at court.
