2014年1月30日，民主党占三分之二的参议院（State Senate）以27票赞成9票反对通过了由民主党参议员赫尔南德斯（Ed Hernandez）提议的加州宪法修订案SCA 5，旨在推翻1996年加州公投通过的209提案公共教育领域废除平权措施 (Affirmative Action）的条款。SCA 5下一步即将被提交到州众议院（State Assembly）投票。此提案如果在州众议院获得通过，将於今年11月被交付全州公投。如果公投通过，加州公立大学会实行所谓的平权措施(Affirmative Action），这必将导致亚裔招生人数受限。

1996年加州通过了209提案，该提案在加州的公共就业、公共教育等领域禁止基于种族、性别等因素的歧视或优待。这使得加州成为全美第一个禁止公立大学以种族决定入学的州。这对加州乃至整个美国社会都有重要影响，对美国的高等教育系统的影响尤为突出。

民主党籍州参议员赫尔南德斯（Ed Hernandez）提出的SCA 5加州宪法修订案，允许加州公立学校、学院和大学依据性别、肤色、种族或原国籍对任何人或团体作出合法的岐视或优待。加州宪法修正案可以由两种途径提出，最后由选民投票表决，超过50%选民票同意就可以修改宪法。第一种途径是 两院中的任何一院提出, 在两院中都获得2/3多数同意后可以进入最后选民表决。另一种途径是由一定数量的选民签字提出。SCA 5采用第一种途径，由州参议员提出。此提案已经在州参议院获得2/3多数通过，并被送到众议院表决。如果众议院也以2/3多数通过此提案，它将最快于今年11月被提交选民投票。考虑到加州各族裔的人口比例，一旦提交公投，SCA5极有可能以超过50%的赞成票获得通过。届时此提案就将被写入加州宪法，从而允许加州公立高等院校和其他公立学校招生以种族等学习成绩和表现以外的条件为依据。目前加州大学（University of California）各校中亚裔学生比例远超过加州亚裔人口比例。一旦SCA5成为法律，加州大学亚裔入学人数势必受到排挤，亚裔学生在申请大学时将面临自己族裔内的激烈竞争，加州大学的亚裔学生比例可能会从36% 降到13%。

加州参议院对SCA5表决时体现了鲜明的党派分别：民主党议员赞成而共和党议员反对。加州众议院共有80席，其中55席为民主党人，25席为共和党人。通过这个法案，需要54票赞成。所以必须有 至少2 位民主党议员投反对票，才可以让此提案止步于州议会。
