APAPA will have a Town Hall Meeting about SCA 5.
 
Date/Time: Monday, March 10, 2014 from 5:00pm to 8:30pm
Location: APAPA National Headquarters
                  4000 Truxel Road, Suite 3, Sacramento, CA 95834

I just spoke with Amy Tong, APAPA National Vice Chair, and confirmed the following for the meeting:

1. The panelists would be Senator Bob Huff; Ling-chi Wang, Associate Professor Emeritus, UC Berkeley; Assemblymember Mariko Yamada; Joe R. Hicks, Vice President of Community Advocates, Inc. Some of the Asian and Pacific Islander Assembly Members would at least make appearances. APAPA is still working on having Senator Hernandez, or at least his representative to attend the meeting.
2. The format would be the same as the Cupertino one. We are allowed to write questions to the panelists.
3. All the mean stream media (ABC, NBC, etc.) are invited to the meeting.
4. I asked whether we can have some folks stand outside of APAPA headquarter with banners and slogans to have our voice heard? The answer is yes.
5. APAPA need to know the number of our attendees as soon as possible. Some folks from Bay Area who didn't get a chance to attend yesterday's meeting want to come to Sacramento town hall. APAPA want to make enough room for our local people first. The capacity of their Conference Room is 250.

As such, we need to start our meeting preparations accordingly:

1. Everyone, please let me know how many people you know or from your organizations could join us by close of business tomorrow. We need parents and teenagers. We need other ethnic groups as well. Chinese Schools, please be the role models! John and I think our goals should be at least 200 attendees. So we can tell APAPA our local communities are active, and 50 of our Bay Area peers can be accommodated.
2. We will have our preparation meeting on Thursday March 6 at APAPA Headquarter Conference Room.
3. We need to collect questions that are right to the point.
4. This is our great opportunity to have our voice heard by our target assembly members and mass media. We need to organize our team, both inside and outside of the building.
5. Please start to prepare banners, slogans and flyers, etc. We need talents to give some designs. Any ideas and suggestions are welcome. Remember, we only have 6 days left!
6. Last but not least, please ask every participant to stay calm and respect the panelists.

Please add if I miss anything.

An Educational Town Hall Forum regarding SCA 5:

a constitutional amendment that would repeal portions of Proposition

209 that prohibit the consideration of race in recruitment, admissions

and retention programs by state universities and colleges in California

Don't miss this opportunity to hear the real facts about the intent of SCA 5 language
and hear the pros and cons of SCA 5 from academic experts, legislators, educators, advocates and opponents.

NOTE: APAPA is a non-profit, non-partisan and grassroots organization and does not endorse candidates.

APAPA is conducting a series of "SCA 5 Town Halls" throughout California because we understand and appreciate how fundamentally important education is to all Asian & Pacific Islander (API) Americans. Just a few years ago, APAPA spent a lot of time and energy on an "Education Equality Project" aiming to overturn the 2012 UC Freshman Admission Policy which could adversely affect API Americans. In addition to asserting our rights in Higher Education, it is also APAPA's mission to conduct Voters Education, promote API American Civil Rights, and actively participate at every level of our government.

SCA 5, as authored by Senator Ed Hernandez, D-West Covina, contains intentions and languages that attempts to promote diversity at higher education in California which, if properly worded and carried out, could benefit all ethnic minorities including certain segments of the API American communities who are currently underserved by our universities and colleges. However, APAPA has strong concerns about some of the language in SCA 5 that can be misinterpreted to allow universities and colleges to resort back to a "quota" mentality that will unfairly shift enrollment priorities to the detriment of other eligible groups of student applicants.

APAPA wants our members and fellow API Americans to be well informed and armed with complete information each time they go to the voting booth. SCA 5 is a very complicated and complex issue and to understand all aspects of this Amendment, we have invited expert panelists to frame the background, and to discuss the pros and cons of this Amendment. We also want to learn from these experts if this Amendment could be altered such that it would promote a win-win situation for all minority groups.

For the above reasons, APAPA's goals in conducting these town halls is to educate our voter population about the facts surrounding SCA 5 with the hope that there will be an educated conclusion and strategy on how to proceed to address the concerns of our API community.

Yes, it's a good thing they did not claim SCA5 is perfect.

In my opinion, in politics, to "modify" means to sugar-coat it to make it easy for you to swallow.

Let's not buy it when they say it has flaws and let's fix it...

Even though Prof Wang's and Mr. Henry Der are not on our side, they expressed strongly that the current SCA5 has serious flaw. 

This is good sign.  I dare any Asian Assemblies would to vote Yes to the current SCA version.

There were two arguing for SCA5. 

Prof Wang's main argument is basically 饮水思源 (his own words) - Asians benefited from affirmative action in the past; now it is time for us 对 less advantaged 拉人一把 (his words).

Mr Der's main point goes - the real issue is the lack of funding in education; universities are giving the seats to international and out of state students to make more money. 

Believe it or not!

In addition, they maintain that the bill does not say Asian admissions will be "rationed". The bill won't hurt Asians the way we see it.

 关于第7点--有人著书证明,经 Affirmative Action 入学的学生以后成功,等等。辩论这一观点时,一方面强调加大早就照顾穷苦家庭和实现Diversity 和 高中10%已经包送;另有一点,大学教育使人终生受益,这正是关键所在,正是因为高等教育的价值,大家才去竞争。如果没有research证明经 Affirmative Action 入学的学生比正常如学的学生更成功,那么只能说他们的成功就是所有大学生的成功,反映高教的价值。

这是一场奇特的辩论:为严重损害亚裔利益的SCA5法案极力辩护的,是两位华裔人士;而有理有据奋起捍卫公平正义的,却是两位异族人士。感谢Cupertino Townhall Meeting的组织者们,让我们能有机会欣赏这场精彩的辩论。也让各地的华人与亚裔聚集一堂,显示我们的力量,发出我们的声音。这声音震耳欲聋
:人人平等的美国建国原则绝不容受损,种族歧视的死灰绝不容复燃。当我到达会场时,辩论即将开始。会场外抗议SCA5的人群大约有两三百人,围成方阵,打着标语,喊着口号,启发群众。会场内也有两三百人,挤得满满当当,过道上都站满了人。人群中我看到了州参议员竞选人Peter Kuo,联邦众议员竞选人Ro Khanna,四点左右出场时似乎看到了San Jose City Councilman Kansen Chu.
辩论的结局出乎意料。我从来没有看到一场政治辩论像今天这样,某一方占据如此显著
的压倒性优势。最相似的是不久前的Super Bowl比赛,Seattle Seahawk以43比8完胜
Denver Broncos。不同的是Denver毕竟还得了8分,而SCA5的支持者们始终没能找出任
何有力的论据。反SCA5 的加州参议院共和党领袖Bob Huff和政治活动家David A. Lehrer的主要论点:
1. SCA5发起人Ed Hernandez利用错误的数据,误导Senate通过SCA5。Hernandez声称
Prop209通过后,少数族裔的入学比例急遽下降。事实完全相反。所有少数族裔的学生

2.SCA5违背美国的建国准则:"All men are created equal" (Declaration of 
Independence)
(个人评论:"All men are created equal"和宪法Fourteenth Amendment “Equal 
Protection Clause”是我们占据道德至高点的两面大旗。但注意不要说SCA5违宪,它
只是为种族歧视打开大门)
3. 针对SCA5支持方的”Diversity”大旗, Lehre指出,加大已经被纽约时报评为全美
最具Diverity的大学。加大有各种Program照顾经济困难学生入学。4. 针对SCA5支持方的GPA和SAT并不能准确反映学生素质的论点,我方反驳加大早就加上其他标准综合考量,和这些其他标准不同的是,皮肤颜色绝不是学生素质的反映。5. 针对SCA5支持方的SCA5并不等同Quota的说法,我方反驳SCA5的发起者还没傻到把
Quota放到提案里的程度(备注:大学设Quota早被联邦最高法院判定违宪)。从加大现有各族裔的人口比例,很容易看出亚裔将是SCA5通过后最大的受害者。(个人评论:SCA5的发起者们大幅压低亚裔入学比例的企图从他们自己的原话里已经昭然若揭:
Hernandez: “California’s public universities and colleges should have all
tools at their disposal to ensure their campuses reflect the demographics 
of our state.”
Sen. Ricardo Lara:"We need to ensure that the students reflect our 
changing population" )
6. 关于SCA5的进程:Huff指出SCA5已在参议院通过,即使Hernandez本人也无法撤回。SCA5在众议院的议程未定。(个人评论:我们既要高度警惕Assembly突击通过,也要做好持久战的准备)
7. SCA5支持方差点加分的机会,在Processor Wang提到Harvard和Princeton的两位校
长(?)所著的书中,描述了 Affirmative Action来自贫苦家庭的受惠者们在毕业后的种
种成功经历。我方防守反击再度强调,加大早就照顾穷苦家庭和实现Diversity。而且不管Harvard和
Princeton是否实行Affirmative Action,和它们不同的是,加大是我们这些纳税人供
养的学校,理应在录取标准上对纳税人一视同仁。而作为SCA5支持方Role Model的
Harvard和Princeton,几十年亚裔的录取比例一直没变,而同期全美亚裔人口比例增加
了一倍,它们对亚裔的歧视显而易见。四点不到我有事离开。不过到此辩论大局就像本届Super Bowl第三节结束之时,已无任
何悬念。但是反SCA5的战斗才刚刚开始。我们取得了一些进展,但胜负依然充满悬念。我们的对手远远强于今天SCA5的辩护者们。我们应该借着本次Townhall Meeting的鼓舞,继续集思广益协调作战,继续给Assemblymen写信打电话施压,继续向所有亚裔宣传,继续团结一切可以团结的力量,彻底击败悬在我们后代头上的这条邪恶法案SCA5。

I totally agree. Furthermore, in fact, there are a quite number of law school graduates among the second generation chidden while our first generation parents are mainly professionals trained in science and engineering. 

As the issues in front of us are very much in the domain of law, registration, public relations, etc. Their involvement and contribution using their legal training and work experience will certainly have a big impact. My two cents.

I went to attend the town hall meeting on SCA5 in Cupertino on Sunday.  It was the first such meeting I went too. I feel it is a rare opportunity for our children to learn about American way of life - how policies are made, how different views are expressed, how democracy works, how real debate is carried out, etc. - because the issue on the table is what kids can relate to. I suggest that we encourage all our children to attend the upcoming meeting  in town on 03/10. Whatever position you hold regarding this issue, I believe your kids will learn a lot by participating the meeting.

On January 30, 2014, the California Senate approved Senate Constitutional Amendment No. 5 (SCA 5). If passed in state Assembly, the state voters could amend the California Constitution to REPEAL provisions of the California Civil Rights Initiative (Proposition 209).
Recall that Proposition 209 passed in 1996, amending the state Constitution, PROHIBITED race, gender, and ethnicity discrimination in public employment, public contracting, and PUBLIC EDUCATION.
SCA 5 is an attempt to revive racially-based admissions to the University of California and California State Universities and make merit irrelevant!
Race-based quotas for admission to universities and colleges affront our long-held belief that all men are created equal and they will not be judged by the color of their skin but by the content of their character. Race-based favoritism was OUTLAWED by the Civil Rights Act of 1964, and explicitly prohibited by the California Civil Rights Initiative.

SAN DIEGO - Former California Republican Party Chairman and candidate for Lt
. Governor Ron Nehring today issued the following statement concerning the 
effort by Sacramento Democrats to repeal parts of Proposition 209 to allow 
for the reintroduction of racial discrimination in college admissions:

"Fairness is a key principle upon which our educational system should be 
based.  When students work hard and achieve so they can get into a good 
school, they should have equal opportunity at admission regardless of 
ethnicity or gender. This important principle is one of the key reasons 
Californians originally passed Proposition 209 and it remains important 
today.  SCA-5 is intensely controversial because it would undermine this 
basic principle of fairness and for this reason it should be rejected.

"There is a lack of fairness in our educational system today: many of our K-
12 schools, including large numbers that serve principally our African-
American and Latino communities, are failing our students, leaving them 
unprepared for college, vocational training, and the workforce.  As a former
school board member, I know the answer here is not to reintroduce 
discrimination in college admissions, but to give students and parents new 
options and alternatives too choose a better school when the school they are
now attending is failing or not a good fit.  That's why I support expanding
school choice and charter school alternatives.  No student should be dealt 
a setback in life because the school the government has chosen for them is 
not a good fit or is failing.
