Hi All Following legitimate complaints from various property owners
that use the servitude gravel track to access their properties and also
used by heavy vehicles to and from the clay mine, inspections were done
by Roads officials and it is confirmed that repairs are necessary in
order to restore accessibility by two wheel drive vehicles. In terms of
the Conditional Use approval conditions, your Directorate is requested
to instruct the applicant to immediately commence with repair work of
damage done by heavily loaded trucks and a tracked vehicle related to
the mining activity. Should immediate and effective repairs not be
undertaken by the applicant, T.R. & S. strongly urges your Directorate
to withdraw consent for the activity. Regards Colin

I refer to our earlier discussion and per the subjoined e-mail could you
please intervene as with regards to this matter. We are still awaiting a
response from the Roads and Stormwater Department .We need to draft a
response to the complainants, who have already indicated that they have
escalated this complaint to a political sphere. We have served notice on
the owners for the non compliance of the LUPO conditions and will
forward this matter to court once the notice expires. We cannot do more
at this stage. However, we do require the input of the Roads and
Stormwater Department.

The e-mail below and the previous correspondence with Mr. Marrow,
refers:

In order to address the e-mail below and to avoid undue negative
publicity to the City due to inadequate monitoring of its LUPO
conditions, it is recommended that the information (points 1- 9 below)
be sourced as a matter of urgency, in order to determine the following:

1. Provide speedy and factual response to the complainant; and

2. Determine whether Council should act on Condition (q) of the
Conditional Use or approach legal services for a court interdict to
prevent further erosion from occurring on the road.

In view of the above it is suggested to co-ordinate our actions as
follow:

* The EHRM Department (this dept) to source the information for
points 1 - 3 (Katy Spalding);

* Road and Stormwater Department to source the information for
points 7 - 9 (Johan Massyn);

* Building Development Management (BDM) to inspect and verify
compliance with Point 6 (Benito Cogill);

Cleary Mr. Marrow has now escalated this complaint to the political
sphere. As such a response to the information requested should
preferably be provided as soon as possible. Can we therefore aim to
provide the same by Tuesday 23 March 2010, in order to address the
e-mail below from Mr. Marrow.

The opinion is held that the Land-Use Inspectorate (Sharon Damon) should
co-ordinate the proposed combined city response.

Hello Ms Spalding, Ms Damon, Mr Massyn, Mr Viljoen -

Thanks for your previous attention.

I am reading the application for conditional use to permit clay mining
on Portion 26 of Farm 22 Zouterivier (attached) in closer detail, and I
find to my interest that the Council has a number of obligations. I
would like to be sure that the Council is fulfilling its obligation.
Please can you therefore supply the following material to me, that
correspond to the application that was granted:

1. A copy of the Environmental Management Plan as submitted and
supported by the Department of Mineral and Energy Affairs.
2. Written evidence that Cape Nature Conservation is satisfied with
this plan.
3. The name and contact details of the Council representative on
the Monitoring Committee, and complete minutes maintained by the Council
of meetings held by the Monitoring Committee.
4. Written evidence that waste and refuse disposal are to the
satisfaction of the Engineering Services Department.
5. Written evidence that water potability is to the satisfaction of
the Health Services Department.
6. Written evidence that ablution facilities meet the requirements
of the Engineering Services Department, the Executive Director: Health
and Housing and the National Building Regulations.
7. Written evidence that the upgrading and maintenance of the
existing access road is to a standard satisfactory to the Director:
Engineering Services.
8. Written evidence that the operator acknowledges legal
responsibility for the condition of the road.
9. Receipts and/or invoices of a financial guarantee made to the
Executive Director: Engineering and Planning in respect of maintenance
of the road, and evidence that this amount is still held by the Council
for the purposes defined.

As the application for a conditional use to permit clay mining on
Portion 26 of Farm 22, Zouterivier, was approved by the Council, then
all the above items are the obligations of the Council.

I therefore seek immediate reassurance that the Council is fulfilling
its obligations in respect of the conditional use.

Please supply me with the above items by return of email. If necessary,
you may post the evidence and material requested to my questions to the
below address, but please ensure that I am informed of the date of
postage by email or by phone.
