Unfortunately I've just discovered an existing patent covers my "new" idea. My idea does include "bells and whistles" not covered under the existing patent - but they are design features rather than features of functionality. My idea also hones the patented concept for a particular application. It does not appear that the original inventors have exploited the patent yet (even though it has been registered since 2007, first on a provisional basis) as I cannot see anything like it on the market. I don't expect that I will be able to have my idea patented because while it is different in design, it functions the same as the patented idea. I feel like it would be a waste to just move on if the original inventors have not exploited the patent or have not thought of the design features/application I have. Should I approach them or should I return to the drawing board?
