Good morning neighbors.
One of the last projects the Board was working on before my term expired was negotiating a Right of Entry Agreement (ROE) with Comcast. ROEs are legal agreements that allow service providers access to Planned Unit Developments such as the Reserve for the purpose of providing broadband cable services.
Basically, ROE agreements grant cable companies access to the area under our streets (without committing trespass) to maintain their cable lines and provide cable video service to our residents. Because access to our property is a valuable right, Comcast will be compensating our Association at least $40,000.00 over the next 4 to 5 years. Current Board member Reno Dagostino recently received our first payment of $22,770.00 and submitted it to our property manager.
Our negotiations with Comcast were based on the number of homes in our development that currently subscribe to Comcast. Though our residents may choose to have any television and/or internet provider, our compensation will increase as the number of our residents subscribing to Comcast increases.
The Association can only receive compensation from video service providers, including both traditional cable companies and telephone companies that provide video service. A telephone company, particularly Verizon, is currently deploying unregulated services such as internet and video in our development without an ROE Agreement with our Association. Verizon is regulated by the Public Service Commission (PSC) and only has a right to provide telephone service. Therefore, we are currently negotiating with Verizon as well. Since satellite providers, such as DIRECTV and Dish Network, attach their equipment directly to individual homes, we cannot negotiate with those companies.
Many Homeowners’ Associations are not aware that they have the right to negotiate and receive compensation from video providers. Our management company was not even aware of this right. However, our Board consistently sought to reduce expenses and constantly researched and explored ways to increase revenue in an effort to keep our fees from increasing. This is another example of the Board’s efforts.
If you have any questions about the Agreement, please contact our property manager. If you have questions about your cable service, cable bill, or require in home service, please continue to call Comcast, not our manager or an individual Board member.
