Believe me, that is not an overstatement – and here’s why:
As you know, living and working in the UAE, has many advantages. It’s so easy to take your eye off the ball and forget to take care of things…
…like making a Will…
If you die, whilst a resident in the UAE - and you don’t have a will, you could leave your loved ones with a truly nightmare scenario.
Even if you have a Will previously drawn up in the your own country, it may be invalid because you have changed your personal circumstances. Here are just four examples:
* You now have money, assets or property in the UAE
* You have married or divorced in the UAE or elsewhere
* You now have children in the UAE or elsewhere
* You haven’t changed or updated the guardians for your children
(The latter point above is worthy of a special mention. Because, without this instruction being clear, decisions about your children’s future could be decided without any input from the family).
There are many other similar personal changes, too, that can affect things, because the whole process is much different in the UAE.
If you die without a legal last Will and testament in your own country, your estate will probably remain tangled up in probate for up to 2 years. Which is bad enough.
But, if you are an Expat, and die without a legal Will and Last Testament, then your loved ones are going to face very serious problems that can remain unsolved for years. Perhaps never.
Put simply, on your death, your assets will be dealt with in accordance with Islamic Sharia Law.
This law is vastly different from most legal systems. There have been many, many examples in recent years of expat families enduring long and costly legal battles, to try and secure what is rightfully theirs.
