Dropbox implementation of reCaptcha breaking ToS?

Dear Community,

The privacy policy states “You agree to explicitly inform visitors to your site that you have implemented the Invisible reCAPTCHA on your site and that their use of the Invisible reCAPTCHA is subject to the Google Privacy Policy and Terms of Use.” 

Now, looking at the dropbox site here: https://www.dropbox.com/login; they have chosen bottomright as the data-style. But then set the display of the container to none. Whilst displaying a simple blurb stating "This page is protected by reCAPTCHA and is subject to the Google Privacy Policy and Terms of Service." This looks to me like it goes against the ToS. Thus, is this type of useage okay due to the blurb or is it still not acceptable and thus dropbox are breaking the ToS here?
