Is it against illegal to hide the reCAPTCHA badge?

The badge that is rendered along with an invisible recaptcha is great on a desktop site, however, it is extremely obtrusive further down the breakpoints. I have read and seen Googles own terms of use, but could I hide the badge and include the privacy terms in my own privacy policy?
